Nicolae Miu, 54, is charged with first-degree intentional homicide and multiple counts of attempted first-degree intentional homicide that could send him to prison for life if he is convicted. Miu took the stand in his own defense on April 9.
Miu is accused of killing Stillwater, Minnesota, native 17-year-old Isaac Schuman and wounding four others - Dante Carlson, Tony Carlson, Ryhley Mattison and A.J. Martin - on July 30, 2022.

I think he lied because it was 13 against one and was afraid he’d lose regardless. If he knew the video would be floating around he probably would have told the truth so now that doesn’t look good for him say he don’t remember any of the lying. Sure he must have been in shock and adrenaline rush still but didn’t help his case

Jury got it WRONG. Not Guilty should have been the verdict. It sucks that a death resulted but if you want to play stupid games be prepared to win stupid prizes. Unbelievable miscarriage of justice here.

Both sides were stupid, the kids behavior was awful but the man did not need lethal force. He knew it himself and that is why he lied initially to the police that they had knives too. He stabbed a girl in the back as well. I think Jury got it perfectly right, not murder but wreckless homicide

​@@billd3060 If Nicolae had legimate business to tend to such as searching for his friend's phone as well as allegedly needing to retrieve a snorkle from this group of teenagers, then it's difficult to interpret the initiative to leave as HIS. And if I heard everything correctly, it sounds like a heart health-stricken Nicolae didn't resort to a bladed-weapon until after Maddison both became physically aggressive AND was waving her fellow companions over (who at least some of which turned out to have a similar demeanor as her). And it certainly didn't help being trapped from some other direction by the teenagers. Lastly, although lying was counterproductive, perhaps that could be a whole seperate charge. Regardless, being so well outnumbered by people whose judgement is questionable...(both opposing parties of the defendant's), it still seems just to grant him something of leniency here too...less than his seeking of a knife, but still something of significance.

Crazy, isaac had his hands on miu's neck when he recieved the fatal blow. Dont be drunk in public, dont treat violence casually and youll save yourself a lot of trouble.

Defense went out of their way to make it seem like Isaac choked him out. The slide they showed was the placement of isaacs hands as he shoved miu. They failed to show that his hands were on his neck for less than a second

He has a right to search anywhere he chooses. Those two girls had no right to tell him to leave. Madison and Riley are responsible for escalating the issue and the results that followed. He couldn't escape anymore. Self-defense was his only option.

I can see giving him a year or two for taking it to such an extreme. But there is no denying he acted in fear for his personal safety. Who wouldn’t be scared in that situation? People get killed in situations like this every day. This could just as easily be the other way around

I think the defense should call a psychologist to explain how trauma effects people's memory. I don't think losing memory after a traumatic event is uncommon at all.

Watching the video i felt so bad for him. Why tf were they so hostile over an older man looking around for a phone? Not just that but accusing someone of being a “pedo” than spreading those lies and pushing him down and laughing trying to humiliate him? Ganging up on him. Like wtf? I think he just got scared and acted out of defense ofc like anyone would. “Walk away” yes so easy to walk away when you’re ganged up by strangers accusing you of being a “pedo” when you’re just trying to help your friend by finding his phone. I don’t think he even realized that he had severely stabbed them and was in shock. Poor guy and shitty situation.

I'm 60 years old and l wouldn't have gone over to another group of tubers. I have gone tubing and we have lost several items in the rivers you don't bother anyone else PERIOD and stay with your own group. None of this would have transpired if he had #1 stayed with his group #2 continued to walk away the 1st time #3 looked for the phone when the area was clear.

Yikes this is a bad argument because the answer is it would of been absolutely no different! Knife, fist, or safety scissor. The weapon in question is not the aggravating factor it’s motive/intent. No need to search for the phone. Lying and evading police. Discarding crime scene evidence (knife). Stabbing after supposed threat ended. No confession or surrendering to LE (very diff to Rittenhouse who actually followed every step to having a good self defense). No need to be in kids vicinity as proven by his own friends. I can keep going.

After seeing the slides this was 100% self defense. Also clears up the only thing I didn’t understand which was why he initially grabbed the tubes which was because he slipped. NOT GUILTY

That was after he had already stabbed everyone. You can see then the girl stabbed in the background of that photo (next to Nicolaes friend) when that neck push happens. That wasn't any kind of strangle hold. And that appears to be from someone who had been stabbed in the back already.

The prosecutor was throwing a lot of bullshit questions and statements at him and that's how you know when the State is more interested in getting a win than they are about actual justice. In this case, they may be worried about getting sued for denying the man a speedy trial. He sat in jail for two years before even getting a court date.

He didn’t like the comment after what the young adult said it , and he came back to retaliate and be menacing as well. He admitted on the stand that he hit that woman and stabbed the other one. He stabbed people that weren’t even that didn’t even hit him. and I thought the prosecution made a great point that he had his back to the so called “threatening mob” ? 🧐✍️ if it was threatening why’d, you have your back to them. Because he was cool as a cucumber with that knife. 🔪 you can’t stab people for something. They said … and he already admitted on the stand that only one person hit him. So it wasn’t the mob attack theory that you all thought. He stabbed people that never even hit him. And people think he’s innocent you’re off your rockers. in self-defense, you have the burden to prove that you are not an aggressor in the crime. And well, we know he was menacing. He came back. He pulled the knife out before anyone even hit him. And he admitted that on stand. He lied multiple times about what the teens were doing and young adults in the crime. and he shared his feelings in the police interview video about how he felt about these young adults. And what he felt about the comment they made. And then so he goes back to the group. Bumps their tubes with the teens think that it’s silly and strange to do that.. so he stays around some more and they ask him to leave and he doesn’t and he ends up, pulling up a knife on two females. And hitting one and stabbing the other and then gutting everyone. Who tried to get him down on the ground. I mean, the young adults aren’t perfect but damn they was just trying to get the big boy down. He’s a psycho. With a knife, you can’t kill somebody because they said something to you don’t like. If an inert object like alcohol is the culprit then what do you suggest we do with alcohol? Do you use the same reasoning for gun control? Do you think people who drink drive shouldn't be held accountable for any harm caused during the act? Just curious how consistent you are and what you think the implications of your claims are, or should be. This "innocent" man started striking people he was having a verbal altercation with. When someone hit him in response to his unprovoked attack and started stabbing people. Alcohol may have been part of the equation, but the KNIFE and intention to use it was the crucial element. Without the knife this would likely have played out like thousands of verbal -- even physical -- altercations play out in America and elsewhere every year: people get insulted, even bruised, but they all walk away alive at the end of it.

Absolutely not guilty of anything but fearful true self-defense. Only thing he could be found guilty of is changing his story about the knife at the end of the traumatic event in fear and shock that something terrible had just occurred but he cannot be charged for misstruth after such an event. These prosecutors and the Judge should have never put this poor man on trial after the true evidence came out in this case. The prosecutor and Judge are misusing the Justice system for their own weakness and fear of addressing the parents of the boys and admitting what they all did along with the fact that their drunkenness and drug use most likely also caused the incident. None of the morons in the general public truly understand “shock” and trauma until they are in the middle of it. Jahvan Cockfield should be prosecuted for inciting this entire incident and causing the 2nd degree unintentional manslaughter of his own friend and the injuries to the other drunks that he called over to incite his lies to along with his other lying, screaming little drunk and high instigating friends.

At no point was deadly force implied or explicitly attempted against him, so the claim that deadly force being used by the defendant was necessary for "self defense" is not credible. The defendant was the person who started assaulting people, and the only person to attack anyone in a life threatening manner. I don't know if what he did meets the criteria of the specific charge, but it's insane that anyone would be allowed to get away with stabbing 5 people -- killing one -- in a verbal altercation where they were not trapped, or pursued and their life wasn't threatened.

They then pushed him again and when he got up, Madison slapped him. Those kids were reckless bullies, and while nobody deserved to die over that, this man was frightened and overwhelmed. He’s not blameless by any stretch but he’s certainly not a murderer either. These kids own plenty of accountability, yet were held to none. “Plain and simple”.

They were being verbally disrespectful, but there's zero evidence that they issued any verbal threats of violence, and the violence done to him was not life threatening and was in response to his physical violence. Even after he started stabbing people, nothing they did threatned his life. He could have walked away at any point (and did, eventually) but chose to escalate, eventually to a deadly degree. It doesn't seem like anyone is being their "best self" in the video evidence, but the idea that you would allow a person to get away with a stabbing spree because they'd been insulted by people who posed no clear physical threat is not compatible with a civilised society.

People will make any jump in logic to not feel responsible for their actions. The way those kids were acting was stupid af and they earned his response. Raise your kids better. Everyone needs to learn how to de-escalate. All they had to do was say they hadn't seen his friend's phone, and if he was still there and it made them uncomfortable, they could leave. If they thought he was trying to make them move, and that was annoying, they could have just called the cops themselves. They knew he wasn't creeping around. At most, he was being obstructive to their activities. That didn't merit the hollering or the mobbing, much less the physical altercations which the girls 100% started. Miu had the right to look for that phone. Miu didnt scream back or threaten them, nothing he did merited the physical altercation.

Sad that he hasn't seemed the slightest bit remorseful about the result of all of this. Even if I were defending myself, I would feel terrible if someone lost their life during the altercation. Literally showed more emotion when seeing a photo of his dog than he ever did when talking about stabbing multiple people and killing one.

She was called to testify. If I remember correctly, she denied having video and it wasn’t entered into evidence for some reason. Also, Maddie claims to have had pics of her injuries on her phone but claims to have deleted them. There’s no physical or video evidence of any injury to Maddie, not even something from the police. It’s really strange that she was allowed to lie about or delete evidence in a homicide case. Maybe the green swimsuit girl was too.

No doubt he was bullied, no doubt he was harassed, no doubt of pack mentality behaviour that put the accused in a position of self-defense and there is no doubt that bullying/harassment caused the escalation of this crime. The accused is not guilty of murder he did not go out there with an intent to kill anyone. This case will come down to self defense and whether the jury believes the actions of the accused were reasonable/not excessive or unreasonable and excessive after reviewing all of the evidence. In considering a self defense plea what will be most scrutinised here is the accused's actions after the fact and the jurys decision will come down to how they view that. They may consider a lesser charge of manslaughter based on the evidence. Laws are certainly flawed and right or wrong it will all come down to this. The best that can come from this case is that it is used in schools to highlight the dangers of bullying/harassment. Further awareness of these toxic behaviours needs to be taught in schools and at home.

If you were afraid for your life you would smile, open a knife and stab 5 people, 2 of them disemboweled? He kept escalating the situation. Never did he choose to leave. He walked away and came back to confront the teens. His “lost cel phone” is bull, and I do not doubt that he was using his snorkel gear to look at the youngsters underwater. If he was or wasn’t, he should have left as soon as his creepy behavior was called out. He stuck around and clearly wanted a confrontation with the teens. The slightly older 2 ladies were protecting Miu from what might have happened by his escalation. He attacked the ladies. Whether the teens were bullying or not, he chose to stay and confront them. That’s not self-defense by any stretch of the imagination.

I’ve watched the victim testimony and Nicolae’s testimony and after listening to him. Without a doubt he is guilty in my opinion. The thing that solidified my opinion when they showed the picture of Nicolae opening the blade and you can see it. I think if he intended to not harm anyone he would have pulled the blade out and then tell them to get back he has a blade.

The judge told the prosecutor the same things MULTIPLE times. He sustains and overrules for both attorneys. He's a very fair judge.

I think he's pretty fair actually. He clearly has a bias, but it's not towards the prosecution nor to the defense, it's a bias for reasonable argumentation within the bounds of the law AND an orderly and respectful courtroom. You'll notice that after the first 2-3 times the judge would sustain an objection against the defense or overrule one of their objections, any time the defense or prosecution would ask to approach (which is where you're supposed to present your argument as to why you think his ruling was incorrect, NOT in front of the jury and cameras) the judge would almost immediately grant it. It's obvious that he just wants people to be respectful of the process and wants to make sure everyone is playing within the bounds of the law, he's done a very good job IMO. Also just to be clear, I personally think this guy innocent of murder and that this was a case of self defense

The jury have a lot more information, time to study the case and generally a lot higher intelligence than the average Fox News viewer. The problem here is that Fox News is full of angry old men with an irrational hatred of younger generations, particularly when they're out having fun. Nick Miu is effectively a stereotypical Fox News viewer. Fortunately the jury were not biased and Nick Miu is facing the consequences of his actions.

Drunk young men and women started the entire event at / in the Apple River that day. Mr Miu was on his own, well behaved, minding his own business, not disturbing anyone and looking for something with his goggles in shallow water. It was totally unnecessary to be confronted by drunk youths, who also unnecessarily started horrible name-calling and harrassment of Mr Miu. Soon gradually joined by equally drunk youths, the harassment continued and escalated. Mr Miu did not bring a knife on that day, planning or hoping to injure, or kill, someone. It apears that the sport "tubing" requires knives for cutting ropes, etc. Like other people, Mr Miu was in possession of a knife for that purpose. Mr Miu was a single person, being confronted and aggrevated by a group of very loud drunk people, also having knives in their possession. It was, however, wrong swinging the knife, injuring people. On the other hand, If the drunk youth minded their own business and left Mr Miu alone to enjoy his day at the river, the entire horrible event would certainly have been avoided !!!!!!!!!!

Exactly. Made me sad because i just thought of my own brother or dad being in his shoes and made me so angry the way he was being treated. In law it’s about proportionality. He didn’t even try to run away. In his eyes you can see the pure aggression boiling the whole time. He stayed in the situation because he was hurt by the things those teens said and searched for a reason to give it back to them. Why would you have a knife with you in the first place. If getting pushed in the water and receiving a slap justifies stabbing multiple people we have much more of those „self defense“ cases.

The cross examination is getting me so riled up, particularly when he keeps mentioning the females and the 115lb weight as if that makes her untouchable. I'm 5ft6, 114lb, and I'm strong. I've never been in a fight but I've witnessed plenty of girl-fights over the years, of shorter teenage female vs female, and woman vs woman... they can be vicious and pound the hell out of someone. Add booze and I wouldn't want to even be a 6 foot male up against a physically threatening female. This whole situation is messed up but considering many factors raised and seeing the footage, I'm not siding with the teenagers, and I don't blame this guy for defending himself when things turned violent towards him. This all happened so quickly, so chaotically, so unpredictably - were there other choices they all could've made, yes. Nicolae could've walked away earlier but he wasn't doing anything wrong. They had no right telling him where to go and what to do. They were all laughing while Nicolae seemed stunned and in freeze mode at first. If he yelled back at them at any point, good for him. It's not like he could've run away as it got more heated... try running in even knee deep water, knowing you've just had a quadruple heart bypass.

While not dry land a key mess up was Mr Miu saying it was ankle high water. It wasn’t as shallow as assumed. The cross was brutal to his claims even with the mountain of objections

Exactly painting him to look like he’s lying when it was such a traumatic situation. Don’t even need to hear his point of view when there’s a whole VIDEO showing how he was being bullied and tossed around in water falsely accused aswell causing others to be agressive.

I feel bad for all involved. When I was a teenager. I was a completely different person than I am today. Life lost. Many shattered. It's a shame. I don't know why this case grabs my attention. I never watch stuff like this...

Pushing, punching, choking…that breaks bones. He had quadruple bypass and a bunch of hyenas are surrounding him and assaulting him. Take the emotion out and try and put yourself in his shoes, geez. I still want to say RIP to Issac, he should have been with better friends that day and didn’t need to die.

Exactly this has nothing to do with bullies verbally harassing, and everything to do with Miu being physically assaulted and fearing for his life being surrounded by attackers. After watching the video I totally changed my (uninformed at the time) opinion

Instead of being a stereotypical overly emotional Woman, you might want to ask yourself why a bunch of adult parents would allow their minor children to get shit faced drunk on a tubing recreation day? It was not self defense! Kyle Rittenhouse WAS self defense…he was running from the mob and acted in fear for his life. The prosecution proved that this man did not act from fear, but from anger. I wish people would look past the sympathy for this man…he was treated badly, but they did not threaten his life….but he chose to act with deadly force with a dangerous weapon. We can defend ourselves still…we just need to understand the law.

The prosecutor is trying to establish “guilt” because he a) went to look for the phone, b) because he was in a river near drunken teens (who btw don’t own the river); and c) because he had a pocket knife. Pathetic

I don't suppose he had remembered to bring a ziplock bag to put the knife in, before putting it back in the pocket. Also washing it seems awkward as well. I don't think he felt too comfortable to come back to his loved ones with a bloody knife in his hand. Etiquette is a complicated thing.

He lied about more than that, he told three completely different stories. First said he wasn't involved at all, then that someone pulled a knife on him and he turned it into their stomach, and now that he knows about the video he says he was defending himself.

This poor guy. I feel so bad for him. He was ganged up on and fought them punks off of him. He had every right to defend himself. But he's been sentenced to prison for life while those punks walked away without any punishment for what they did to this man, well they did get stabbed and one died. But they didn't get charged with ganging up and pushing this man into the water. I hope his wife sues them in a civil case
