Charlie … Chuck Knight here. I just want to tell your KZfaq folks you are 100% the real deal in all regards!!! Not only are you a highly skilled craftsman, you are a tremendous musician and music writer to boot along with being a world class human being!!! Before I bought my flute, you answered all my questions (several most dumb) in a most thorough, polite and respectful manner!!! I’m not gonna say I can play music yet, but I make a joyful and piercing noise. Your answer to that question with this video was spot on. My BlueBear flute is one of my most prized possessions!!! Robert from NJ Thank you so much Charlie for the information,. You are awesome. I’ve been trying to trace the Native American part of my family for some time. Now my grandfather was Blackfoot and Cherokee and I was told I would have to search the scrolls to find his tribal affiliation. It’s so difficult so thank you for the information. Peace be with you, I can’t wait to receive my flute from you I can’t wait to play it

Доброго всем времени! Спасибо за информацию. Я нахожусь в другой части света, создаю флейты по виду и звучанию похожие на Ваши. Последнее время я говорил заказчикам ,что это просто деревянные флейты из веток. Уважаю культуры коренных жителей, но мое мнение- как ни назвать вещь, суть останется такая же. Когда звуки и вид инструмента трогают сердца- не важно ,кто сделал его. Важнее всего как преподнести это! С уважением, Ваш поклонник.

To be considered legally "Native American Made", the maker must be an enrolled member of a Federal or State recognized tribe, or certified as an Indian artisan by an Indian tribe. Anyone who isnt one of those 2 thing cannot claim their product is "Indian Made". That is the law.

It is quite ironic that you say that dwayne! I say ironic because it's exactly what I posted my video. I would also like to mention that you posted three things, not two. This would be Federal indian, State Indian and certified. I am of course paraphrasing because you didn't use all those words but it is how you meant it I'm sure. There's also a loophole in the Arts and Crafts act that allows actual natives to sell non-native items as Native American which is very unfortunate and I have fought it for many years. Even in recent times, they've tried to redefine that and include more non-native made items which I just finished a video today mentioning.

If I wanted to make/produce my own native inspired flutes, the only way I’d be able to legally do it is to get certified by a tribe? I’m not even sure how I’d do that

That's a great question! Although you should really check with a legal adviser to be certain, many people get through this in the case of these wonderful instruments by calling them "Native American style." If you'll notice, I don't call mine Native American "style". It is truly a gray area and to be honest with you, this law does more harm than good in my opinion. And of course making them yourself is different than marketing or selling them yourself. Lot of things to consider.

Hi Charlie, it’s me again Robert from New Jersey I have a question is there a reason why ancestry DNA has a disclaimer stating that it cannot be used to authenticate someone as native American ( only) referring to the authenticity of Native Americans? It shows all of my bloodlines pointing to Native 0:12 Americans, but we’re unable to use that as a means to authenticate us?

Because DNA markers only suggest where heritage may come from, it doesnt say for a fact that youre "X" percent this or that. It simply says, "Compared to others who might have similar markers, you might be this". There is no tribe or government (in the USA or Canada that I know of) who will accept DNA as a proof of lineage.

Cynical side, damaged by the society we're surrounded by, when i hear that question aimed at someone like you, knowing the answer is so easy to find, i can't help but see them challenging your validity. same thing as saying "he don't look red -enough- to me" or 'he shouldn't date her, their kids won't have enough blood left".

So someone who descends from, say, the Chocktaw, and has no proof, they can't sell something as authentic. Correct?

Unfortunately that's correct. They can be certified however through and official Choctaw tribe or even may be able to join said official tribe depending on its requirements.

I imagine its to protect against the amount of people who would be like well im 1/64th Apache so its native American made.

@Blake-jl8lh Actually, it can't legally stop those folks. As a matter of fact, there is a political leader from a specific federally recognized tribe (whose name I'm not going to mention) who is less than 1/1000 Native who likes to call other Native People phonies! Like I said, I could go into depth with this video, but I mainly wanted to share the answer to the question I posed. The whole "blood quantum/percentage" is a colonizer idea, not a Native one.
