They managed to check my operators ID name on PNC at the road side and then wanted me to show ID to prove it matched myself as the flyer (which is doesn't need to by the way). They issued a producer at the roadside to make sure I did provide my name (very bad practice). You do not need a flyers ID for a 249g Drone, and as long as the Operator ID is displayed on the outside, then your following the law on that one. Line of sight, well if they have someone willing to make a statement or video evidence then that could be an offence but it didn't look a massive area from your footage and you certainly didn't go out of sight on the footage you published. So this makes very little sense to me. I think his Ego got the better of him and he couldn't stop until he had your details. This station is firmly on my list for when I return. Great video mate. ❤

Most definitely unlawful. Plod can NOT arrest simply to obtain details, they can only demand details AFTER an arrest for a specified offence.

That Officer should have exercised his right to silence. He has incriminated himself with his own words. He admitted he has presumed you guilty without reasonable grounds, and he admitted that he would let you go if you gave your details, which means he was using the arrest to coerce you into giving your details.

It's disgusting how they can just dump you miles from where you were. What would have happened if you didn't have the funds to get back to your car? When you sue them, make sure you include the time it took to get back to your vehicle and the cost incurred. Tyrants indeed.

First thing once arrested, Never talk, everything you said in the car is and will be used against you. Once you get to custody ask for a duty solicitor, even if you don’t intend to use that solicitor or if you have your own solicitor they have to call them. All this is free whilst in custody. If like in the video he never read you your rights when arrested he has illegally detained you. Always remember the police are never going to work on your behalf or admit they are wrong. They DO NOT have your best interests in mind. Sue sue sue

Did he just say, " you've been arrested for failing to provide your details do you understand that ?". so that would be an unlawful arrest then, he kidnapped you and the entire time tried to use it to force you to give him your name, imagine if a member of the public kidnapped someone for not telling them their name, how many years do you think they would be serving, but when the police do it they get a promotion, rewarding criminal behaviour is not how you stop it.

No don't bother with the complaint. All it will do is delay the civil claim as that will have to wait for the complaint to finish. Go straight for the civil claim. Plus with a complaint nothing happens to the constable, and you don't get anything. But with a civil claim nothing happens to the constable, but you get something.

The very first sentence spoken during any caution is "you have the right to remain silent". That means you do not have to give any details. Other than asking for a solicitor, stay silent. Tell them you will give your details to the solicitor and will only provide them further on his/her advice. Don't even try and have a conversation with them. Remember, ANYTHING you say may be used against you!!!! The MAXIMUM they can hold any suspect without charge is 24 hours. If they intend to hold you any longer, they have to pursue permission from a prosecutor and need a good reason to do so. Beat them at their own game. Don't even accept any food or drink and the sh!t will hit the fan pretty quickly when they realise they are not going to get things to go the way they want!!!! Strange him saying you can't film in a police station custody area as it is a secure area, when we see them all the time on their "hero cop TV programmes", like interceptors or road wars!!! On release, before leaving the station, go to the front desk and make a subject access request for the custody suite CCTV and the officers bodycam if he was wearing one. Once outside, you should have taken your drone out and flew it over the station. Really rub some salt in their wounds!!!

Payday Reggie. Copper thinks he knows a bit of law and even when you Google it to show him he's too pig-headed to call someone to check. Then thinks he can just arrest someone for refusing to give details when they have committed no offence, simply because he can't be bothered to find out. Not being able to check the operator/flyer ID (you don't need the flyer ID if you are the operator) is absolute nonsense, there is no legislation requiring you to show it to a police officer. He should be checking the law. Edit: don't get hung up on giving your operator ID, it's not relevant. Not giving your details can only be a secondary offence, he has to be sure about what the primary offence is first and have reasonable suspicion that you were committing it. Having a suspicion that there might be an offence that you might be committing doesn't meet the requirements.

That copper is fixated on flyer ID. For a drone 249g or under, whether it's a toy or not and has a camera, no flyer ID is required. That comes straight from the CAA.

Refusing to give details is a secondary offence once arrested. If it were the law to provide ID upon request without any reason whatsoever we could deduce that we are in fact living in alternate reality and lost WW2.

I agree, but a lot of European countries being on the winning side of WW2 actually actually have rules to give details to the Police when asked, but only verbally: - name - date of birth - address (UK and USA is the special ones.)

@bob scott In Belgium you even need to ID with a card, when asked by Police. All of Scandinavia must answer verbally when asked by Police. France, Germany, Spain and Italy all have systems around the same. UK and USA is special. (Your references to contracts doesn’t make any sense - I’m talking about Police vs the public.)

You have a good chance of a civil claim. 9 hours? That'll be a grand or two. HNK solicitors. But for this any no-win no-fee solicitor will happily take it on because the compo is big enough that it will make it worthwhile for them.

What he said he arrested you for doesn't exist in legislation, therefore this was an unlawful arrest, false imprisonment and breach of article 8 of your human rights. The constable is 100% incorrect about the drone which ONLY applies to +250g drones and you are not required to have a flyer ID, only operator ID on the drone and it's certainly NOT an offence to not have a flyer ID for a sub 250g drone. This constable should have checked before arresting you and not found out after the fact. NNY had a similar incident for which he is making a civil claim for I believe. You should do the same.

'This' came in years ago. Also, they now have 'released under investigation' as a weapon to cause maximum inconvenience. It could be weeks/months or even YEARS before they drop the non-existent investigation. Meanwhile, you are still marked on their system, and they hold onto anything they seized.. They do this so often now because they were told to stop abusing police bail - but at least bail had a time limit, RUI doesn't.

I got done once for a cheque that was forged only because the cop asked me if it was my signature, I stupidly said it looks like it yes but it's not me that signed it. That's all they needed, me saying it looks like my signature. It wasn't actually my signature or my cheque but I still got done on that single question.

Why oh why it baffles me why people don't respond back when they say "We don't know don't know what if anything you're gonna do etc". When the response should be "Well officer, we don't go off what we don't know, but what we do at this present time". Anything else is just conjecture and paranoia/suspicion of that particular cop.

Hi Reggie, as far as I know you can only be accused of the offence of refusing your details when you have been properly charged with an actual offence other that refusing your details!, even then you can demand to be put before a magistrate who is the only one with the power to insist!. This one telling you that you are arrested on suspicion of an imaginary offence, if what he claims had any foundation he would have access to the information he needs, he does not have that access because no offence is committed!. He just got carried away!, this is an unlawful arrest and I hope you get full compensation, I might suggest that as and when they make you an offer that you decline it at first, don't settle for less than five times what they first offer. There are no exceptions to the official PACE rules. Cheers, Richard.

Are there unofficial PACE rules? 🙄😂 PACE is an Act of parliament, a statute. The Code Of Conduct for pace is guidance, with clout, for the police to follow in their line of duty. I haven't watched the full video yet but I'm guessing they didn't follow any policies, laws or guidance to do with law enforcement. The one with the pointy finger in the thumbnail looks like he was around pre PACE, like I was, "The Judges Rules" were the guidance pre 1986. (yes I know PACE is 1984 but it didn't come into force until 1986)

To start with I would say that given the degrees of ignorance so demonstrated in these auditing videos there must be some sort of unwritten interpretation of the rules which serving officers discuss among themselves and more or less accept, I am sure this will include the assertion of powers to which they are not entitled, after all the point of joining in the first place for many of them is to be given authority that the rest of us do not have!. Very few people really understand the significant differences between 'power over' and 'power to'. There will also be the underlying issue of the type and style of training given, to do this work properly officers need to be shown how to do it the right way out there in the real world, not in a classroom or a briefing session!. All people find it very difficult to process new concepts properly when they are in a hurry to go and do something useful!. Cheers, Richard.

The rule on minimum distances to people is different when flying small drones and model aircraft that are below 250g, or in C0 or C1 class. If you’re flying a drone or model aircraft that’s lighter than 250g or is C0 class, you can fly closer to people than 50m and you can fly over them. When you’re thinking about how close you can fly, remember, you must never put people in danger. Even small drones and model aircraft could injure people if you don’t fly them safely. If you’re flying a drone or model aircraft that’s between 250g and 500g, or is C1 class, you can fly closer to people than 50m, but you must not intentionally fly over them. Reggie was unlawfully detained and arrested, he had committed no crimes whatsoever, whether that was a civil aviation offence (flying drone below 50m, which a pilot operating a 249g or below model aircraft/drone is permitted to do under CAA laws/Rules and Regulations), failing to personally ID (give his name and address) and failing to provide his Flight ID. Because Reggie had not committed a CAA offence, arresting police constable #390 had no reasonable grounds to base an investigation on, so the arrest was unreasonable, unjustified and unlawful. Reggie cannot be given summary only offence charges of failing to ID (CAA Flight ID and Personal) because he had not committed any offences to begin with, so these 2 alleged offences automatically become null and void. Arresting PC #390 failed in his duty (Dereliction of Duty) to do a prompt and thorough investigation to ascertain and confirm Reggie's Operators ID with CAA, to see if he was valid and lawfully allowed to operate and fly his drone, he assumed Reggie could not fly his drone under 50m but never properly checked CAA laws, rules and regulations first before arresting him.

Arrest without any offence = kidnapping. @23.19 cop admitted he doesn’t know the regulations but he arrested you anyway, I’d say you have a very good case against this criminal. @Brian Mooney Solicitors are after making money for themselves and their client. If it is a no win no fee agreement they will take the easy option. For example, If the police offer £3500 and no more but the client wants more then it means going to court. If the client takes the lower offer the solicitor will claim his costs and all is well. If they go to court and the judge awards more then all is well and the solicitor gets his costs paid. If the judge awards less he will be aware of the previous higher offer and costs will not be awarded. The solicitor loses out and has nowhere to go for his money. This is my understanding as to how it works but I stand to be corrected. That is why solicitors have to be really sure that the damages awarded will be higher and why they insist that you take out an insurance policy to cover that eventuality.

@Brian Mooney You are probably correct but going to court is a risk that the solicitor will not be willing to take. As you say, an easy wedge of money for Reggie. I have always maintained that point "How do I get my time back when the case gets chucked out" Yes there is compensation, but you want that time back as well. It wouldn't go amiss for an assurance by the police, that any bystanders etc have not formed a bad opinion of you. If it doesn't specifically say in their job description that they can unlawfully arrest anyone, they are operating outside their job description. Isn't that called malfeasance, max jail time 14 years - only saying

18:00 You only have to give details once arrested. And if after arrest you still don't give details then you can be charged with it. But you can't be arrested for not giving details. You can only be arrested for a crime. And at arrest, the constable should explain what law you've broken (doesn't have to be down to the section, but usually is) give their collar number and caution you.

"quote the law" For example, when driving a car Section 165 of RTA 1988 gives the police the authority to ask for your details, and it is an offence not to give them. So where is the equivalent part of the law for a drone licence? Answer. There isn't one. That's a complaint for a false arrest and the officer being ignorant of the law. And a compensation claim.

Great video Reggie and I'm looking forward to seeing more videos from this story. Hard to believe in 2022 that details held on a database aren't easily accessible especially from the pair who approached you, surely a radio call to their comms would allow someone elsewhere to make those simple enquiries, or a telephone call to someone stationed inside the police station who could help to facilitate those enquiries. Hard to believe those aren't the simplest options, it certainly seems that the overriding intention was to massively inconvenience you just because you refused your name. The word tyrant certainly seems to fit from what we see so far.. Are you sure that you aren't in an episode of life on Mars and that it is really the early 70s, the clothes fit, the poor enquiries fit, mind you it's only the drone and the video that reminds us it is NOW 2022. Details is like crack to a copper... In many cases they dont know why they want them, but they need them and they are not above telling lies, inventing laws and crimes to get them. This behavior will continue to happen until the become personally accountable for their actions and personally responsible for the settlements from their savings, salary, assets or pension fund.

Reggie As the caa rules state that the operator id needs to be on the main body of your drone that lots of flyers are putting it UNDERNEATH the detachable battery but still on the actual drone body purely to obscure it from the cops but at the sametime totally comply with the caa rules... Smart move i think..
