What a fucking world we are in where it's not the prestigious news papers, not the prestigious news stations, not the prestigious legal assosciations, not the prestigious political parties, it is the parody websites who have the integrity to say "wait it would benefit me politically for them to suffer but that's not right". I only wish the connotation assosciated with those "prestigious" institutions would update with the average person as quickly.

You know Nick, as a cop, I am continually baffled how these departments have time/personnel/funds to pursue these cases. I'm in a department with less than 50% of the detectives we had 10 years ago (with no end in sight to the hollowing out), and I go home every week completely exhausted because I simply don't have the time/personnel/funds to help my actual victims of actual crimes (murder, robbery, elder abuse, etc). And places like this have the free time to make up new crap? WTF?

Maybe not arrested, but I think you're completely mindblocking the 1980s when christian conservative mothers completely fucked the entertainment industry in as many ways as possible. Does everyone completely forget what "christian mothers with kids" did to D&D, effectively calling it a game for satanics (which hilariously, as usual, christians don't even fucking know what a satanist even is). Or what about the advent of the Parental Advisory Explicit Lyrics fucking retarded sticker for music? Or the ESRB? All of this was ultimately fronted by "christian women with kids", all because it was offensive to them and they hated the fact it existed. Stop acting like Cuckservatives, and the right wing in general, are paragons of virtue.

The first brief was a bit ham-fisted, but still very funny. The second was by far the better one to submit to the court, as they did a great job supporting The Onion's brief and adding their own takes.

I don't see why they don't submit both? They both make good and subtly different points. The "pro government" brief is comparing and contrasting the reasons why the worst dictators in history have done this type of thing, and the pro freedom brief explains why they can't get away with it.

Around the 20min mark, you talk about the 1st Amendment and The Chilling Effect, this is pretty much how "family" court/DCF/CPS is run. Its a violation at it's roots. Guilty until proven innocent, oh well, so sad they missed work and church and life, but nothing happened at the end, right? :/ This was a really well done brief, both the real one and the hammy one. Thanks for going over this.

Did the people holding up cameras during the George Floyd incident “impair the functions of any police…operations?” Seems like that could have been really distracting. Does Minnesota have any law like this with which to charge them?

A person is criminally liable for a crime committed by another if the person intentionally aids, advises, hires, counsels, or conspires with or otherwise procures the other to commit the crime

EMS refused to send help for George Floyd because of the angry mob screaming and threatening the police, which could have saved Floyd from dying from his self-adminstered drug overdose. (Probably wouldn't have helped considering the amount of fentanyl Floyd took, but it's possible.)

The real issue isn't if a law exists to charge them, but if the District Atorney will press charges. It's why a lot of people who caused damages and were arrested during that summer of love were just released and never charged.

Its unlikely the people will be charged if their gathering in and of itself was the only impediment. They would need to take some action or refuse to move once notified for their gathering to declared illegal. Simply stopping to observe a police action isnt illegal, only when you become a hinderance of the action can they interfere with your presence. Given the george floyd incident the people were definitely causing an impediment, whether or not they knew they were causing more harm than good would be very suspect. Its unlikely any jury could come to that conclusion. So when it comes to pressing charges do you really want to waste thousands of hours and humdreds of thousands of dollars on those odds?

You may want to recall that parody was a staple of one of our most famous Founding Fathers. Bejamin Franklyn used it in his role as publisher of the "Poor Richard's Almanack". Using the pseudonym "Richard Saunders" he routinely mocked the and criticized the policies of the British Parliament and the Crown with parody.

i really hate how the Bill of Rights have been used against the people just as the framers said they would. They believed our rights were immeasurable and innumerable. since they were flipping the power structure on its head, the constitution was intended as a Bill of rights to the government. Hamilton argues this point in the federalist papers. The first amendment is not limited. The intention was NEVER do question “do the people have the right” and to measure it against an amendment. the question they wanted us to ask is “does the government, given its limited scope of power expressed in the constitution have the power to act.” it’s why the Bill of rights weren’t in thr Constitution originally and were only added to kill the anti-federalist platform. what the framers worried would happen has happened.

This entire ordeal is both outlandishly hilarious, and deeply troubling. Because on the one side, all of this is presented in a satirical, highly entertaining fashion. But on the other, we have the potential of a governing body controlling the very voice of the people it was created to protect. _"The future is only ever as bright or dim as those who traversed the past would paint it."_ We are responsible for the future. In England I can criminally prosecute the cops, personally in my private capacity. The cops are required to apply the laws that the public think they should know. S26 Criminal Justice and Courts Act 2015. and can get £500k/14 years if they don't. I may only have speech at the whim of Parliament, but I can hold the cops accountable. It is a simple law and worth a read. I feel it should be enacted at a state level as a counter to qualified immunity.

20:05 Whoever was falsely accused or harrassed through the legal system by a malicious actor, knows that the process alone is already the punishment. The malicious party may of course want the win, but the process alone does the intended damage. A benign example: Just think of a scummy landlord who wants to get rid of you for questionable, malicious or even delusional reasons. That can take years, and you just giving in to just not have to deal with that anymore, is how s/he gets his way. Sometimes you can't let that happen.

I'm glad they didn't file the counter argument one. I can't say for sure if this court would get the joke. Then again that would also be the same foe the other arguments too. I would like to think that SCOTUS would continue siding with 1st ammendment absolutism but you just don't know.

I'm not a lawyer, is there any good reason to have "qualified immunity" for police and public officials? It seems to only exist to be abused, and allow police and public officials to knowingly and intentionally commit crimes and never be charged (which we have seen used across America for that purpose for years now).

Eliminating qualified immunity would allow basically anyone arrested by the police to sue the individual officer who arrested them, and drag them through the process of having to personally prove that the arrest was justified. It definitely has a chilling effect on police their jobs. You don't hear about the cases that aren't brought because it exists, and you don't hear about the obviously BS cases that get dismissed quickly because of QI, because the first class don't exist and the second class aren't scandals. But you have to think about the counter-factual of what would happen if every cop had to defend, out of pocket, all of his arresting decisions in the court system. Just imagine what would happen if every cop who shot a suspect was charged with murder. Would that primarily have an impact on bad shoots by the police, or on the willingness of police to try to arrest potentially dangerous suspects in general?

@@jonathanccast Police should be required to defend their actions in court, under oath, especially when a police officer kills someone. And if a police officer doesn't want to do his job without qualified immunity, he shouldn't have been hired in the first place, in my opinion. It's a matter of weighing the inconvenience of the (hopefully rare) cases where a police officer has to commit a crime to protect someone and is required to defend his actions in court, with the cost to society of having an entire class of people holding extraordinary legal powers being allowed to act with complete immunity, including when committing theft and murder. And it still doesn't explain the extension of qualified immunity to non-police officials. Public officials like Judge Louise Goldston, and Mayor Ted Wheeler of Portland, who routinely claim qualified immunity, while they commit crimes that are completely unrelated to their official duties. In short, I understand the theory, but I disagree that it justifies having qualified immunity in practice. It still sounds like an excuse for certain people to commit crimes and get away with them.

Hey Nick. You should do a stream about the longest prison sentences in US history and dive into some of the cases. I think I'd be horrifying but interesting.
