Brandenburg v. Ohio | 395 U.S. 444 (1969)
The First Amendment right to freedom of speech encompasses one of America’s most divisive and hotly debated subjects: the advocacy of violence for political purposes. Does the First Amendment protect politically motived incitement to violence? Does it matter if the speaker’s politics are motivated by hate? The United States Supreme Court considered these questions in Brandenburg versus Ohio.

This is a really good video and well done. Thank you for taking time to make something educational even if its not going to get a million views.

I'm actually pretty sure that you are wrong when it comes to the clear and present danger test. That test was actually made very similar to the brandenburg test but was no longer used for a long time because new laws found the clear and present danger test null and void. The Brandenburg test actually reinstated the test but this time just called the brandenburg test

Most countries have to sort out how to regulate transmission of speech sent to the united states for storage or public or private dissemination from the united states 😂

At least we have a Court to specify just what a freedom means. Or "had" one anyways..

2021 2nd impeachment hearing of the 45th President of the United States brought me here after the attempted coup of the US Capitol incited by that very same president.

Can we stop calling it a coup? At most it was ill conceived insurrection by a bunch of yahoo’s incited by a desperate sore loser. It can’t ever be a serious coup unless the military was directly involved in the whole situation. If those rioters were being serious in wanting to overthrow and take over the government there was nothing stopping the army from running them over with tanks.

@@kennedysutton1584 I might be sick but at least I use capitalization and punctuation. I did this to get a rise from someone easily triggered. Only took 2 years.
