Nearly fifty years after Roe v. Wade was decided, the right to an abortion has been stripped away by the Supreme Court, marking the first time the Court has rescinded a right. Donald Trump’s appointees to the Court are under fire for tainting the legacy of the Court, as many believe they reversed the decision because they personally oppose abortion. MSNBC’s Chief Legal Correspondent Ari Melber is joined by The Nation’s Joan Walsh and Linda Greenhouse, who covered the Supreme Court for The New York Times, to discuss the legitimacy of the Court. Greenhouse writing in a New York Times piece responding to the ruling that Alito’s statement asserting that the Justices who previously backed “Roe” were wrong is “breathtakingly arrogant.”

They're also saying "we don't want to see women and doctors go to prison" even as they write laws that would criminalize a woman who had a miscarriage. They now want her to prove that the miscarriage was spontaneous and not an abortion. If she is unable to prove that, she will be considered guilty. They haven't laid out the penalty for god killing your baby in a miscarriage yet, mostly because they're still trying to win an election.

If there is a limit of time that a President can sit in office; why can't they put a time limit on a Judge on the Supreme Court? WHY do they sit for LIFE? That should be amended.

I understand that the constitution DOES NOT state that they should on SCOTUS for life. All it says is that they have to be a Federal Judge for life. The constitution supports some sort of rotation. I am a lay person and do not understand the full depth of meaning or the nuances of this but, it's there.

The US constitution might as well not contain the word impeachment for all the applicability it has. The way that process is designed it's pointless up to the point that the forces arrayed against the accused are so overwhelming that they just as well could set the constitution aside; it's just a document after all - if the vast majority of those in power think it's wrong, it suddenly is.

@@Cline3911 McConnell was instrumental in blocking Obama's right to appoint a new Supreme Court Judge during his presidency. McConnell was saying it was an election year so the next president should be given the opportunity to choose rather than the current sitting president which was Obama. McConnell was saying at that time, "Give the people a voice" by not allowing the sitting president to nominate. His concerns about all this evaporated when the old rump was potus and he allowed the rump to appoint 3 judges and here we are.

The basis for Roe was reaffirmed multiple times, and nothing had changed other than the Court's religious/political makeup. There was no reason to even hear the recent case Other Than to issue an arbitrary ruling.

A simple and “breathtakingly logical” rule would have prevented what is a mindbogglingly self-destructive decision by the court. It should take a majority ruling EQUAL TO or EXCEEDING the original decision, in order to overturn it. Both decisions involved 18 justices in all, with 10 voting in favour of Roe v Wade and 8 against it. It would seem that it is Alito who is “egregiously wrong”.

If, say hypothetically, a 9-0 ruling that has stood for 100 years, and survived countless changes in the court, can suddenly be overturned just 5-4, by an egregiously contrived and politically tainted court, then something is rotten in the state of Denmark. In just one presidential term, this arm of government has transformed from its most respected to its most reviled. Time for reform.

I've read Alito's opinion, and I'm left with confirmation of my original opinion about his opinion. It comes from a position of hatred, not law. Alito is a theocratic fascist at his heart. Of course, he is in good company with the likes of Thomas and Gorsuch. I believe this to be also true about Comey Barrett as well. The founding fathers made it clear in the first amendment that "Congress shall make no law respecting an establishment of religion...," so instead, we are allowing our SCOTUS to impose their religious will on the people at grave detriment to those people. In essence, they have turned the 1A on its head, not by the establishment of religion, but by establishing the forced recognition of their religious views on the rest of society. What we have here are arguably the most corrupt anti-constitutionalists this country has ever mustered for appointment to the SCOTUS. McConnell always used to complain that he was afraid the Democrats would seek to "legislate from the bench," with their appointments, yet there seems to be no urgency for correction when that exact sentiment is borne out in practice by fascist right, corruptly appointed justices. I find it so galling, that it is nearly unfathomable that 5 individuals on the SCOTUS would have the power to declare women indentured servants and reproductive slaves of the state, and no one can do anything about it. This is the first true step into authoritarianism for America - allowing the vomitous rantings of a handful of religious zealots to rescind individual reproductive freedom from 173 Million women.

I'm so appalled by this. I'd like to know what, if any, medical procedure is illegal??? And if the goal of this is to save the lives of children - then why are pharmaceutical companies allowed to discontinue making the most effective medicine, for lack of profit, for thousands of children suffering from childhood leukemia???? The idea that the authority of the state can rightly extend beneath the skin of individuals to presume jurisdiction or ownership over the functions of an organ, especially a uniquely female one, is a violent intrusion into the autonomy of the individual. Clearly the USA is no longer free to women whose rights are now reduced to that of a fertilized egg, likely because it might be a man. The culture of keeping women barefoot and pregnant is returning. Interestingly, concealed ownership of firearms despite it often killing or injuring due to subsequently regretted actions is nonetheless affirmed by this so called "right to life" and "freedom loving" court. Wow.

The radical rightwing bench treaded on the super precedent of two SC rulings which had settled the constitutionality of Roe, and in addition disregarded an overwhelming majority of Americans (+70%) in favor of abortion remaining a healthcare option. Then allowed religious nonsense in school, that no doubt causes psychiatric problems in significant numbers of developing minds. Plus, made the bustling city of NY increasingly more volatile to gun violence. Yep, sacrificing the will of the majority for a minority faction is something Thomas Jefferson warned would happen if the Constitution wasn't revised on a generational basis. And the nightmare isn't over, yet. In fact it's just begun.

For a court that apparently believes only the explicitly stated rather than the obviously inferred interpretations of the constitution must be upheld, it's perhaps worth pointing out that the constitution does not explicitly grant the supreme court the right to decide what is constitutional. It's a reasonable inference perhaps from their responsibility to adjudicate "all Cases, in Law and Equity, arising under this Constitution", but hey, they probably don't think that's enough, really. Let them decide only those cases that _explicitly_ arise under the Constitution, and not decide what the Constitution _is._ To put in another way, let's reject the naked _unconstitutional_ power grab that was Marbury v. Madison.

Because if he had admitted that he wanted to overturn Roe v Wade… he may have not been confirmed. It’s the same with Gorsuch, Kavennah and Barrett. They all either avoided directly answering the questions about RVW or they claimed that they would not touch legal precedent…. so they would get confirmed and then eventually get to do whatever they wanted (anyway.)

Why are so few people talking about the floodgate of rights that this decision will effect? My marriage to my wife could be illegal with a court that thinks this way! My children could be shamed and segregated! The reasoning of this court leaves open overturning every advancement in civil rights for the last hundred years! Why aren't we talking about the wider ramifications? I, personally opose abortion, but not the right of the parent to decide for themselves. When you make the focus all about abortion you lose people who don't understand how this can effect them, since they would never need an abortion. You have too explain how this touches each and every one of us!

I'm reminded of what the historian Deborah Lipstadt said about Holocaust deniers, and to everyone who wants to figure out who is speaking the truth on a particular matter: for them to be right, who has to be wrong? She referred to that if the Holocaust deniers are to be right, the survivors, the liberating soldiers, and most importantly the Nazi's themselves must be wrong, because they wrote it all down and also defended their actions when faced with the death penalty. All of those people must have been wrong for the contemporary Holocaust deniers to be right, and it simply doesn't sound very likely at all. I don't like that the Supreme Court feigns political neutrality in that this ruling had nothing to do with the subject matter of abortion. If that is the case, and it's all about constitutionality and whether states should be able to decide this issue for themselves, why did the majority say that this ruling only applies to abortion? As much as it pains me to say it, I actually agree with Justice Thomas the most (of the majority). If Roe v. Wade is unconstitutional because it was based on privacy which isn't explicitly stated as a constitutional right, why shouldn't everything else that is based on privacy also be ruled as unconstitutional? Justice Alito dropped the ball here if he wanted to pretend to be politically neutral on the issue of abortion. I have long been an advocate for rational argumentation, meaning that you have to have a basis of your position on a topic. For example, if you're for banning sugary drinks in schools because kids' health is more important than free choice, you can't the next day be against banning sugary candy because free choice is more important than kids' health. That's inconsistent and shows you have no consistent ethical framework on which you base your opinions. If you were to believe protecting kids' health is very important, you would have to offer an even more important value to override the "protecting kids's health" value. You can't just say "well, sugary candy is tasty and drinks are not". Well you can, but then people would assume that your highest moral value is what you personally like, and that kids' health has nothing to do with it. People in general are very bad at argue rationally, to think about ethical frameworks. I feel that most are just jumping from issue to issue, picking and choosing their favourites as if from a smorgasbord. If they say that abortion isn't a constitutionally protected right because the basis of privacy has no support in the Constitution, then they would have to offer up some other reason why contraception which also is based on privacy as I have understood it, is still valid.

For a court that facetiously believes only the explicitly stated rather than the obviously inferred interpretations of the constitution must be upheld, it's perhaps worth pointing out that the constitution does not explicitly grant the supreme court the right to decide what is constitutional. It's a reasonable inference perhaps from their responsibility to adjudicate "all Cases, in Law and Equity, arising under this Constitution", but hey, they probably don't think that's enough, really. Let them decide only those cases that explicitly arise _under_ the Constitution, and not decide _what_ the Constitution says. To put in another way, let's reject the naked unconstitutional power grab that was Marbury v. Madison. Seriously though: we should. The way the constitution was drafted is almost incoherent. The amount of interpretation needed makes the courts a pseudo-legislature, and that's not good. Time to draft a decent (and actually amendable) document, and leave this first draft in the dustbin of history, where it should have been for centuries.

Their arrogance is astounding, especially Alito's. He has been on that Court for quite a while, but only when he had like minded Jurists appointed did he voice his opinion that the decision has been egregiously wrong since it was rendered. If he believes that, he could have so stated in a dissent over the years the Court considered Roe. In my opinion, to suddenly decide that he overlooked voicing his opinion until he had power was, since his inception in ruling on Roe has been egregiously wrong, hypocritical, and cowardly at best.

A few months ago, Alito gave a speech where he stated that it was outrageous that he and some of his colleagues were being regarded as political hacks. Sadly, he is a political hack, probably not quite as much of one at Thomas, but close enough. He has singlehandedly undermined what credibility the court had. The case now for expanding the court to dilute the extremist majority is unanswerable.

The supreme court was wrong to say abortion has not enjoyed much cultural history in America. 1) It has been in common use since the 1700's. 2) Benjamin Franklin the founding father literally wrote a book which included how to do home abortions. 3) They made religious arguments for it! Believing in "demon spawn" children could be born. 4) The senate since the start believed unanimously the separation of Church, religious and moral rulings, and the state. Over turning Roe Vs wade was clearly a moral one for the conservative judges.

I'm glad that you bring up that the argument against abortion is a religious belief, and as such, should not be 'the law of the land'. People who have that religious belief can practice their religion, but they should not be allowed to force that religious belief on everyone and penalize those who go against their belief. This is not like a religious prohibition to not eat meat on Friday, eat something else. No one is REQUIRED to follow that or be penalized.

But if this has to be discussed and decided then it should be by the ones it effects. I agree with you, nobody should be able to force you to give birth. But as a country this is apparently what we have to address yet again and to me this is the best way to do that if you absolutely must. Put it like this: Imagine you and others are stranded on an island and form a group to survive and it’s agreed that you will vote to make decisions on how to get back home. Even if you don’t like what the group voted for in terms of how to get back home you will most likely still go with whatever the group voted for because this effects everyone there equally. Because if it succeeds you all go home but if it fails you all could die… But if people watching you on tv get to vote and they vote for a route you don’t like then you’re really not going to be happy and probably not going to do it because why are people who have nothing to lose making decisions on your behalf? That’s my point. I’m not your enemy here.

The key here is the 9th Amendment, not the 4th. - Amendment IX - The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people. Means, everyone has additional rights, even if they're not listed in the Constitution. And, that those unlisted rights are equally as inalienable and inviolate as those which are listed in the Constitution. The end.

Nicely stated. Far too many people forget the 9th even exists, though it is largely responsible for the viability of all our rights outside those few originally enumerated. Even the interpretations of some of those fews are the result of the 9th (e.g. an individual right to gun ownership; the 2nd only supported a collective right as a part of a well-regulated militia. Its current interpretation only dates from Heller in 2009, so it's even less 'historically associated' as Alito would say than Roe was). A right to vote though not explicitly stated in the Constitution is explicitly referred to in 4 separate amendments (more than any other in fact) but the concept of a right to vote was a result of judicial review and accepted due to the 9th. Personally, I've always considered it to be the most powerful of the first 10, due to its "All of the above" style of language.
