Anne Taylor, chief of the Kootenai County Public Defender’s Office, is still representing Idaho killing suspect Bryan Kohberger. This week, when prosecutors asked Taylor to share any evidence that might prove Kohberger's innocence, she said, "there are no books, papers, documents, photographs, or copies, or portions thereof in the possession of the defendant at this time, which will be submitted at the time of trial." Yes, it’s not up to the defense to prove BK’s innocence. Banfield is only out for ratings. I don’t care for her as a reporter.

while that is true, unless he is found innocent, his life is pretty much over. No sane person will befriend him, date him, marry him or hire him. If he wants his life back, he is going to have to prove his innocence. That being said, I believe that the prosecution has enough to convince a jury that KB is guilty beyond a reasonable doubt.

It should be on the state but law and juries have changed recently and go on public sentiments and circumstantial which is a very slippery slope for anyone living here. The defense will have to invalidate the electronic footprint and whatever type of DNA they recovered. Nobody says BK has never been in that house before that fateful night, the tenants would allow people in and out even while they werent present. Its not as slam dunk as some may think, esp when most evidence is ping which isnt pinpoint Gps and the 2 universities are 8 miles apart. State has their work cut out for them as well. I hope and pray they got this right for the sake of the families!

The burden of proof is the responsibility of the prosecution in all court cases. Defense doesn't have to prove anything.

At the beginning of trial the prosecutor will show evidence that shows the defendants guilt.The defense of the defendant will normally give reasons as to why he did not commit the crime,the bottom line is B K's defense has nothing to show his innocence now and the same when the trial starts. B K is guilty and will either receive the death penalty or life in prison.

Yes you are right! Burden of proof lies on the prosecution. Pressumed innocent til found guilty. The defendant doesnt have to present any evidence. 1. Bk dna on the sheath 2. Personal physical witness describing the suspect 2. Several cell phone pings in proximity to the area during the murder. 3. Cell phone turnoff during critical window hours at time of murder. 4. Cell phone pings in a week leading to murder. 5* dna of the victims found in my eleantra 6* electronic traces of stalking the victims 7* dna of the victims found in my personal things 8* asking my father to drive with me on a 2500 miles for fun 9* changing my car plate just after the murder 10* disposing my personal garbage at the neighbor's bin at the wee hours of the morning Yeah, burden of proof isnt mine. Lol.

In all honesty, it's not even about what anyone can prove. It's really about what the jury will believe. OJ and Casey Anthony were both "proven guilty", yet they both walked free.

By law, he is presumed INNOCENT until proven guilty. The burden is on the Prosecutor not Defendant.

Theory: could the informant be the father? Maybe that’s the reason for the unnecessary flying to go drive with his son. And then to get pulled over twice on the way. But it’s very unlikely

Why should she drop him as a client? What needs to be addressed is why friends were called over to the crime scene before LE and why 9-11 wasn't called for 8 hours? The potential crime scene integrity contaminated by the guests invited to the scene is a bigger conflict of interest than a client dropped for not appearing at court against the advice of her publicly sponsored legal counsel

That’s assuming the victims were dead at 4 am. Kohberger was near the apartment around 9 AM, how do you know he didn’t kill the 4 people at 9 AM since DM only saw a live person in all black at 4, she didn’t see dead bodies at 4AM?

That’s why we have juries - because people see things from their own point of view, as informed by evidence. It sounds like you’re advocating for him to be sent down without a trial because the idea of reasonable doubt is inherently “stupid”. That’s not how the system works.

@Bamboo Princess I know you think Brian is guilty, but the defense's job is to plant the idea that the killings had nothing to do with Bryan, such as some sort of drug deal gone bad, a jealous ex or a LE frame job. Any of these could provide reasonable doubt.

@Bamboo Princess I’m not assuming anything. In a criminal trial, the burden of proof lies with the prosecution. The prosecution must convince the jury beyond a reasonable doubt that the defendant is guilty of the charges brought against them.

All that Discovery report said (the parts shown on this segment) was that they don't have anything "AT THIS TIME." That doesn't actually definitively mean anything other than exactly what it says. It just means they don't have anything to turn over yet, because they haven't confirmed anything yet, they're probably still doing research and investigations, doesn't mean they won't have some sort of supposed "evidence" of innocence that theyll turn over later when they come up with it. And the reference to an informant is probably just one of the housemates or other people they talked to along the way who gave information or details that ultimately helped to lead them in the direction of BK...

I agree. I think the media is actually the reason why they want to hold off as long as possible. It's way too easy for speculation to influence the actual trial even though it should be the other way around. I'm pleased to see this restraint, it's long over due. If one is an amateur crime specialist gunning for top marks on KZfaq, Instagram etc.; giving people the latest updates faster than anyone else and of course their oh so valued OPINIONS, this may be a bummer as well as a perfect time to deduct based upon what was released vs what wasn't. In all, I support the slow public revelation if it affords society clean and unprejudiced trial results as the constitution intended.

The reverse is also true, as, so far, no evidence was found in Kohberger's car or his apartment linking him to the crime scene. The tiny DNA trace "found" in the murder house, supposedly matching Koberger's, is not proof enough that he was responsible, given the large margin of error with such tiny traces.

One does not simply kick back and relax. A grand jury can indict him at any time before the preliminary hearing in June then he'll have to plea. Defense team might want to gather some reports together.

This reporter shouldn't have become reporter at all. She's always trying to stir up drama and make everything look bigger than it is. Why would the lawyer need to prove bk is innocent to her. And why would she reveal any evidence/details she might have to this reporter. She's not the judge, everything doesn't revolve her show and her ratings.

banfield honestly should be either reprimanded, suspended, or fired. she has sensationalized this case so much for her OWN benefit, making her star rise by asking intrusive and innapropriote questions, conducting unprofessional interviews, and just obsessing to the point that youd think SHE was personally affected by the case itself. i believe she has gone outside the bounds of her paygrade and caused irreparable harm to this case. banfield disgusts me.

If there is even a hint of conflict, the attorney will be removed either by the prosection or sua sponte by the Judge. They don't want any potential procedural errors to be brought up on appeal. My best guess is that when the State shows it's full hand during discovery, the defendant will take a plea deal... Life without parole rather than go through a trial.

If you listen to public defense attorneys on YT they say there is no conflict of interest and are not happy with Banfield for hyping this erroneous conclusion for drama's sake. Also they need a local defense attorney who is death penalty qualified.

The defence attorney seems to close to the victims parents and the town to be motivated to defend B.K. properly. If she got him off she would probably get run out of town. Politically too her career would be over. The mayor of the town will have chickens if B.K is set free and student enrolments drop. Idaho should get B.K a proper sleezebag criminal lawyer.... Anything else could open door to mistrial.

Burden of proof: The prosecution in a criminal case bears the burden of proving to the jury beyond a reasonable doubt all of the elements necessary to establish the guilt of the defendant. In other words innocence doesn't have to be proven, but guilt does have to be proven by the prosecution.

She does not have to show he's innocent, she just has to show that the prosecution has not proven its case. You cannot prove a negative, she cannot prove that he did not do something, it's the prosecutions job to prove he did it. The framing of this video that she has no evidence to prove his innocence is a little ridiculous.

@@craftycriminalistwithms.z3053 No, it’s not a conflict just because of the representation of the one of the victim’s parents unless she has information from one client that would harm the legal due process rights of the other. Public defenders don’t pick their clients. They are assigned the cases. There would a bigger issue on appeal if a non-death penalty private attorney was assigned because there are none other who can first chair a death case in northern Idaho. That’s the bigger issue to worry about on appeal.

She has to stay on BC it’s a DP case. Otherwise, she’d have given BK to someone else & stayed w/original clients.

I don't understand why there are still people holding on to his words " I can't wait to be exonerated" I'm pretty sure it wouldn't have never gotten as far as him needing to wave extradition if they didn't have him dead to rights... on Like day 3 of him still being in custody in Idaho people should have realized that dude ain't going anywhere..... it really is getting tiresome though of everyone and their mother broadcasting their thoughts and theories... no information is coming from anyone that is credible because there is a gag order on everyone people seriously need to dial it back there can be some serious issues from some of these KZfaqrs that are just speculating.... not saying there's anything wrong with speculation but some of these guys are doing it from the top of a mountain with a bullhorn (lol so to speak) and a big quality of what they're saying is nowhere near true

The only way to defeat extradition is to prove you aren’t the person listed in the complaint. It has absolutely nothing to do with guilt or innocence. It’s basically a mistaken identity check/balance.

Don't get me wrong, I enjoy some of the community, but TBI said they were getting a lot of nonsense because of KZfaq and even asked people to stop. So it isn't really funny at all because in this case you have 4 people that were murdered brutally and the different case in TN the little girl still has not been located.

It has reached a point of way beyond speculation & sharing personal theories. Openly accusing people of murder just because they live/work in the murder town but didn't even directly interact with the victim/s (the University professor), and not back down even when it turns out said prof. was out of town that weekend, and make up wild stories instead.... this affects the person's entire family & these online vultures need to face legal consequences, because if they see that they get away with it, things will escalate eventually & people get hurt or worse.

It's super telling BK's lawyer & family are totally Silent AND that they pushed his right to a speedy trial! Kinda the opposite if you're innocent & trying to get your life back... Think abt Casey Anthony, OJ & all the infamous trials where lawyers made the rounds professing their client's innocence. In BK's case, the evidence is already overwhelming & they've got nothing yet, which is why they pushed the the trial way out.

They must think their viewers are dumb. Ms. Taylor's job is to establish reasonable doubt, not provide proof of innocence. She has to give a credible alternate scenario which exonerates her client, not necessarily prove he didn't do it.

There’s almost 1000 pages of written evidence to go over and almost 1900’phtotos to inspect. As well as a video that was sent to the defense in the discovery. That takes time to inspect. I think the guys fucked too but there’s no way an attorney could go through that kind of evidence in a couple weeks

This isn't about the defense having to prove he's in innocent. That happens in the trial, which hasn't even been determined yet. This is the discovery process. Both sides are obligated to share certain information such as an alibi with the other side if they have it. Of course she doesn't need proof of anything, but if she has something like that, she has to share it. This can also work to their advantage in trying to get the case dismissed using exculpatory evidence. Again, this is not the trial.

Having an informant would help explain how LE was able to crack this case so quickly. But an informant isn't necessarily an accomplice. Could just be someone with knowledge of the crime and identity of the perpetrators.

First of all, discovery requests don't ask for docs proving innocence. The point of discovery is to see what opposing counsel has so they can study it and develop arguments to invalidate it and/or simply to know what they have ahead of time. Discovery requests are cut and paste docs. The document read is generic and was cut from a template and pasted under the State vs Kohberger caption by an admin. It's customary to word the responses exactly as the requests were written. Secondly, law "enforcement" doesn't know the laws, rather they enforce specific laws as instructed by their superiors. Many lawyers have explained why there is no conflict of interest and it's interesting neither of these women know that. As to the informant - Again - This is a cut and paste document and the question is asked of every defendant in BK's category. They're called, "Standard Requests", in civil court there are seven. They cut and paste and add requests thereto if they like.
