The plaintiff says he hired the defendant to power wash his front walkway, remove the weeds, and fill in the cracks with sand. He alleges the defendant didn’t complete the work after he was paid in full, so he and his wife are suing for a refund. The defendant says he told the plaintiffs the weeds would grow back because the pavers weren’t installed correctly.

Could you imagine a judge that comes from “a construction family” just told you that the 2 days of pressure washing and brick sealing you did wasn’t worth anything? Crazy on this one.

I’m floored! This is the second case I’ve seen recently where the person walked away, not making any money. Very disappointed in her verdict.

I was shocked when she ruled completely in favour of the plaintiffs, especially after she herself asks them @ 7:25 “Is there no value to what they did for you to be asking for the $1500 back?” Unbelievable. 😧

Judge ruled wrong on this one. If plaintiff wanted the sand he would have said something right away to the defendant when it was not applied. And the quote for the job with the sand was $2,200, but defendant charged $1,500 which would make sense if it was never agreed to apply the sand initially.

No kidding! It's so unfair that someone can put in work like that and be left with zero compensation. I don't understand it. Judge even commented on the fact that he's asking for all of it back and implying their work was worth nothing!

Judge totally blew it on this one. She seems to think that she knows all about construction because she "comes from a construction family. " If her father were a brain surgeon, would that mean she knows all about doing brain surgery???

they power washed but they did not fix the problem which was to seal it so no grass will grow. outcome is because they were making a contract without knowing how to do it. the Defendant him self said it they did not know how to do it but then why make a contract for it?

horrible verdict . nobody should have to do hard labor for free . hey judge , slavery is illega in the united states . the plaintiffs came with NO EVIDENCE that they told the workers to use a special type of sand before the work was done and no promises were ever made to them and nothing in writing about weeds never growing back for many years .

@@baboytablo5735 if there was no contract and they did not have alot of experience with it then the plaintiff should have not hired them , but once the plaintiff hired them and they did work then the plaintiff should be on the hook for paying for the work and should get no money back ! there should be consequences for letting people do work on your home , nobody works for free , experienced or not .

I looked up the cost of the sand per square foot and NO WAY did the power wash guy agree to do that part too. There had to be misunderstanding. I think the plaintiff knew EXACTLY what to do.

I think he took advantage too. He was explaining it to the judge like it was so easy to do-- if it was, why would he need anyone else to do it for him? I think he preyed on the defendant's ignorance and the fact they were trying to expand business.

The way the wife smirks, twiddling her fingers and rocking side to side to the entire time makes me feel they are lying🤨. The defendant is not a gardener so why would they expect him to take care of weeds!? Who even would ask a power washer to treat weeds in the first place! This whole case is ridiculous 🙄.

The judge got this one wrong. I believe he asked for it after the power wash and needed to save face in front of his wife. He texted he was being taught, wouldn't the home owner say, "what do you mean being taught?" They didn't mention anything like that.

I’ve done some lawn care work in the past and I will say there is no definite way to eliminate weeds without constant chemical spraying every 3-6 months (depending on the type of weed)

Probably should have returned half the money because the did half the job. Defendant and his brother have alot to learn because they now lost a HVAC customer as well!

neither of them have a contract, so it's pretty arbitrary and cringe to just take the plantiffs word for it, when you say "neither of you have a contract" you can't then pretend that the dude had evidence he asked initially.

I don't believe he asked at first one, because he didn't even know the brand or pricing to get, if he had initially requested that, you would think he would know that, but still he somehow still does not know, I believe he heard of it after the fact in passing and wanted to make a fuss out of it.

Awe, Juge Millian I'm quite disappointed with your judgment. The defendant should have been able to keep a portion of the money. Also, if they had friends do it for $700 before they should have had them do it again.

I'm sorry judge but for pavers to be laid properly and prevent weeds, the base has to have sand laid/compacted, then Iay pavers and use the adhesive sand (similar to grout)...

I love the moss that grows between my pavers on my back garden patio. It makes it look aged just like my 120 year old historic mansion. Plus if you don't want moss or weeds, spray an earth sterilization solvent. Easy enough.

How exactly did the plaintiff prevail when he has the burden of proof and he had zero evidence to prove that he indeed requested that sand, in the initial agreement….? Just because the couple had a longtime weed problem that it wanted gone doesn’t mean that they contracted for that special sand to be used - maybe he simply forgot to mention it when he and the defendant agreed on the work. Did she consider that?

actually they did have the evidence through the text messages with the defendants brother. She even said to the defendant that according to the text messages that the plaintiff did request for the polymeric sand. I worked in construction for over 25 years and seen a lot of pavers installed. They are very common as driveways where I live. I have never seen an underlayment for the pavers. The reason is that it would trap water and cause issues. Weeds are from seeds that fall through the cracks of the pavers. Not from underground as the defendant stated. To keep weeds from growing between the pavers is exactly what the plaintiff stated. You install that special type of sand and sealant. Look it up. The only time underlayment is used is for gravel driveways. The defendant did not really know what they were doing. Just power washing is one thing but sealing something is something different and you have to know exactly what materials to use or it will be work for nothing. I agree that the plaintiff should not have gotten the full amount back since the did clean and scrub the pavers.

Exactly, they had no contract and most jobs require one if said job was over $600 dollars, I’m betting even if defendant did the poly sand they would have come back for their money,WHY because no contract. Either they pay and get it back in court or they don’t pay when job is done and person doing job has no recourse,WHY ... no contract , and the plaintiffs knew this!

@@viper278 how do the texts prove the plaintiffs claims? How does a text, that came after the plaintiff was unsatisfied, saying the defendants are learning how to do the work show that the initial agreement required the work plaintiff’s claiming? If that specific sand was not part of the initial agreement and plaintiff began demanding it after the defendant began working, the defendant could’ve sent the same exact text. In other words, how do the messages show that the parties agreed to using that sand in their initial contract? They don’t seem to indicate any timing when I heard them.

@@RumbleRish The text wasn't from the defendant but from his brother. the judge was reading the text but the defendant was talking also so it was almost hard to hear it. Re-listen to the Judge's explanation of her verdict and she even says from what was in the texts between the Plaintiff and the the defendants brother it was apparent that the plaintiff requested the polysand at the start. The brother replied with "we are learning how to seal the pavers" or something to that effect. That is why I wrote 5the comment. If there was no mention of the poly sand then the Judge would have sided with the defendant because she asked the Plaintiff for proof that you requested the poly sand for the pavers. Plus, if you look up how the install pavers and how/what materials to use it says to seal the pavers with the poly sand to keep water and weeds from penetrating the gaps. The defendant and his brother were very new to this business and didn't have proper training or knowledge to do it professionally. The reason for the poly sand is that it dries hard so when you pressure wash your paver due to oil or stains the sand doesn't wash away.

The judge was wrong on this case. That couple Lied through their teeth. The wife was smiling and laughing through the whole thing. I disagree with the judge on this one and So does a lot of people on this site. It’s not her money they’re giving away it’s the courts money. Thank God the guy doesn’t have to pay the $1500 back for real. That couple is dreadful

@@SilverSergeant yes he did....through the various text messages....it may not have been a traditional contract, but they did have stuff in writing.....the entire dispute was that from the very beginning the plaintiff asked for that polymer sand, he didn't get it....you need to have pavers to understand that the verdict was just, because everything has to be redone....I'd know because I have a lot of pavers front and back just like plaintiff

Do they have a barrier or do they have this magic sand, because I’ve never heard of this type of sealant. Don’t know if it’s better then barrier but it seems to me it’s only a temporary fix just as the barrier doesn’t last for ever either.

I haven't even watched this case yet and no weeds won't stay gone without plastic or other form of weed resistant ground cover. The defendant stated the $1500. was for cleaning the cement not for the sand he wanted. He was quoted over $2000. for the job with the sand. I believe the defendant should have gotten some money for the work that was done because he now has clean cement. Next guy doesn't even have to work as hard.

I looked up that Polymeric Sand, it is only a deterrent to weeds and insects and the pavers need to be laid pretty much perfectly for it to work. The plaintiff should have been suing the guy(himself) who laid the pavers so cheaply or his gardener(himself) who obviously doesn't know what he is doing.

We have pavers. The sand is to keep the stones from becoming loose. It is not meant to prevent weeds. The weeds always grow back. Bad decision by the judge.

Judge got this completely wrong. Also there is no such thing as a sand that will completely stop weeds growing back. They will always grow back. It might delay it but you cannot stop the weeds.

WHAT? They power-washed the front, back and side and then had to refund everything, why? So the judge thinks their time and expertise is worth NOTHING. If they had said they were going to do the 'sand' then why in the texts would it say they need to learn how to do it, wouldn't the plaintiff then respond, but you should already know how and you should have already done it. I don't believe the plaintiffs and they had NO EVIDENCE to back their claim, so why did they win anything, let alone EVERYTHING? The judge is not consistent...

That is the best comment I’ve read and before judge cut off plaintiff he was saying $2200 dollars. $1500 from $2200 =$700 that is the portion of job not completed, defendant should have something for his labor as whoever comes back is going to have half the labor if they did all that was said ( moss and mold) was done.

I'll never understand that method of construction of you. Do you want to a house stands still for decades without major problems? Make a concrete base and put bricks. This is stupid and JM is wrong that their work had no value. Look at the smirk on the plaintiffs at the end. Liars getting away with their lies. She literally asked the plaintiffs if it had no value and just took their word. They don’t have any evidence at all. If the sand is so important and magic they could’ve mitigated the damage and did it themselves so the other work had value. Stupid. I wonder if she’s getting classist the longer she goes because she will often rule workers job had no value in cases that isn’t true for.

Here, in Brasil, we can prevent almost all works of maintenance of a house. You need to spend some money, but you never will be disturbed with termites, we don't have bed bugs, water leaking,, almost nothing. Perhaps a casual invasion of ants. And paint the walls in five to five years (if you have no children, of course).

Weeds are extremely difficult to get rid of when you own a home, so you really have to find the right person who knows what they're doing. Oftentimes it's trial and error to be honest. Sometimes the first time may not work so you have to keep at it by continuing the process till theres no new weed growth. But it all comes with owning a home.

Without a heavy liner underneath the pavers to prevent weeds from coming up, there will always be weeds. The original contractor is at fault (or the original customer, for not agreeing to the impermeable liner

It think there was a communication issue between the plaintiffs and defendant. So the guys labor is worth nothing? The plaintiff even said for someone to do what they did plus the sealer would be $2200 dollars but the judge cut him off. These people knew with no contract they could get all their money back because in most state any job over $600 requires a written contract by a licensed contractor, if not they don’t have to pay , so they came up with this sealer story. I’m betting they did the job just as they were asked and the sealer was agreed upon after the fact , like a change order. which would add a cost but these people knew there was no contract so they beat these guy’s over a barrel.

Saying that weeds will grow no matter what because 'no liner was used' is wrong. Anyone who gardens knows that. It may deter it for a bit, but nope. I don't agree that he should have had to pay back all of the $, but they need some training and education on how their (side?) business works.

I definitely don’t agree and the dumb look on the wife’s face is very telling! Whether the weeds grew back or not as a customer I wouldn’t ( at that point) even feel comfortable getting all my money back, it was wrong. Some money back ok but all ? No way! The plaintiff even said the last time he had it done it was $700 so why would he get back $1500?
