@@taurussho86 Yes it absolutely is. If you owe more on a car than its worth, thats what gap insurance is it for. So you don’t wind up still owing the bank on a car that gets totaled like the plaintiff did.

Good to know! I’ve never even heard of gap insurance. Not that I’d ever buy a new car cuz I’ve always heard it loses so much value the second it leaves the lot.

Yeah, except this is exactly what insurance is for. We pay insurance so that if we hit someone or cause an accident, we can't be sued, PERSONALLY. Once she cashed those checks from insurance, she SETTLED. If you settle a case you can't come back and try to get more money later. That's the definition of a settlement. We agree to these terms and are done with it.

Not any longer. Top quality new cars like a Toyota or a Lexus do not depreciate much at all.

As someone who just bought a new car, I can tell you that the price difference between a Toyota that is one or two years old, with 40,000 miles or more, and a brand new Toyota is just about nothing (factoring in taxes, commissions, etc). Since the factory shutdowns because of Covid, it is MUCH harder to find an affordable good quality used car. High demand plus low supply = higher prices. I didn't WANT to buy a new car, but financially, it made the most sense. It made more sense to me to spend only 500 more for a new car than a used one with tens of thousands of miles. @@Stressless2023

She would never get more than the blue book value. And would only receive the max of $5,000. in small claims. She just said she was out more than 51. No one puts gap ins. on a used car, which is what she had. It was the finance charges they didn't cover.

​@@0LadyV0that's some BS. Gap insurance should be put on any car that is being paid off. My friend put gap insurance on his used Subaru. It saved it him when it got totalled. They covered the remaining 3k at the time. He was made whole and didn't owe any loan after. The guy is a jerk but definitely should always put gap insurance. Especially in used cars, they drop valve extremely quick.

@@taurussho86gap insurance is to made to pay the difference on what is left on the loan, after the insurance totals it out the vehicle. what you owe may not be the value of the car, making a gap. this is exactly what it is for.

You shouldn't need gap insurance. And a car's value shouldn't drop like that just for driving it off the lot. It's ridiculous. And one of the reasons I won't buy a new car. 😛

No not really bc she cashed the insurance check in. Once you cash it you accept it. You can't just sue for additional money after you settle for the amount the check was. You can't just sue bc you thought about it after the fact.

Agreed, because he mocked her and showed no remorse while she literally had a child in the car and was only trying to make herself whole. And he’s lying saying he didn’t talk to either driver when 1) impossible, and 2) just before he says that he said he told the BMW driver “nice car” 🙄 Sometimes it sucks that the law is made where claims have to be made in a specific way in order to stick. Judge couldn’t award for more than the depreciated value, but could have awarded distress if the plaintiff asked first. It’s stuff like that which is why some criminal cases will throw the book at a criminal for something like tax evasion because they know there’s not enough evidence for a bigger crime, but at least some payment will be made.

In one case the judge’s hands were mostly tied, and it seemed like they’d get nothing even though the defendant was at fault and an ass, but she kept asking questions until the plaintiff mentioned something small (I can’t remember if it was a doctors visit or something) and JM leaped on that, asked if they had proof and was able to award the plaintiff like $200. It was way less than they came for, but it was just enough to legally count and rub into the defendants ego. It was a nice moment when her sympathy and lawyer instincts kicked in and was able to give them something they wouldn’t have thought of on their own, but still tied into the case at hand.
