I think what it means is right now sadji is in jail under ED's behest and this will now move under CBI's control. Ek taraf kua, dusri taraf khaai, sadji ke chamche de BJP ki duhai.

so right now he's in judicial custody (court's custody) in the ED's case- money laundering . CBI is moving for CBI custody (Police custody) for investigation in a separate cases- cheating and fraud. These cases are not in ED's jurisdiction.
