Change Could Bump You From 70% to 100% - #va #disability #compensation #benefits #veterans #claim
The proposed rules for mental health conditions would increase the minimum disability rating from 0% to 10%. The rule would get rid of a dated part of VASRD that prevents a Veteran from getting a 100% rating for a mental health condition if they are able to work.
VA will ensure Veterans get the compensation they need and deserve, especially when it comes to mental disorders. Under the proposed changes, VA plans to use new evaluation criteria to more accurately capture the different domains of impairment caused by mental disabilities and provide more adequate compensation for financial losses experienced by Veterans with service-connected mental disorders.
Rather than assigning an evaluation based on the number and type of symptoms present, these changes would evaluate mental disorders based on how impactful the disability is across five domains of impairment: Cognition, interpersonal interactions and relationships, task completion, life activities and navigating environments, and self-care.

@donniehill3952 I'm NOT scamming the system. I just claimed everything I had issues with....and most of it had been documented through scheduling appointments and not going to sick call. I asked when I got my rating if I could still work and they said yes. I didn't just go get a job....I'm sorry your not getting that rating, maybe see if there are some things you didn't claim, that you can. I had a couple big ones and that helped. Also I know a ton of others in my same boat. NONE of us are scamming the system and we all hurt doingbour jobs, but need to be doing so we fight through. Get over yourself.

The VA needs to get rid of VA math!!! Can we get 70% + 30% = 100%? That shouldn't be hard!!! This garbage of 70% + 30% = potato is just garbage!!!

I agree with you. I have had a problem with their stupid and unfair math. It seems like the VA is not there to help the Vets at all.

@Big-bob560 yes. That's VA math that I'm talking about. It needs ro go away. If someone gets say, 70% for PTSD, then 30% for another issue, that should be their 100%.

They divide the body into sections and rate the disability according to normal conditions. I feel the same way. I have 10% for hypertension but no compensation for it, but I take 3 different meds to control it.

I was in the Field Artillery for five years. My hearing has gotten worse over the years. I put in with the VA for hearing loss. This was the outcome: Tinnitus-Svc connected. Hearing loss L ear-Svc connected. Hearing loss R ear- NOT svc connected. 10% Tinnitus. 0% Hearing loss. I s**t you not. 🙄

My uncle was 100 percent disabled after lossing both legs below the knee to mortar fire in Korea. He received 100 percent disability all his life AND worked full time managing a hardware store in Texas. Just because a veteran wants to work doesn't mean he didn't earn his 100 percent disability pay. He was paying taxes and everything.

It's also a generational thing. I worked at a VA ran National Cemetery and had a couple younger co-workers that got their 100% for multiple issues. One of them turned lazy after he got his 100% and he was pulling in WG8 step 5 pay in Arizona (just over $30 an hour). He then got in the VocRehab education program but quit that after a few months when he found out that they require you to actually attend a school or training program full time if you want the housing benefits.

​@@benk6995Sad I finished a year of school for voc rehab, I still struggle badly with mental breakdowns and panic attacks. Last year a panic attack put me in the hospital. I still want to work, but my head isn't right but I am trying hard to get better. I'm in therapy now and the VA wants me to try another depression med before they will let me do TMS therapy. I just want to feel normal again and not hate what I have become. I want to be there for my Wife more so than not, and my family. I hope and pray I can get better, been out for 10yrs and I only move so far forward and many steps back over and over again

Legitimate concern, but if you've been seeing a psychologist or psychiatrist, taking meds etc. for ptsd, could work well in your favor if new guidelines are ever adopted.

My dad (Vietnam Vet) passed away a week ago. The VA sometimes get a bad rap but they really helped my dad..especially in the last few years of his life.

My condolences. I was a Marine from 1964 to 68 so I am a Vietnam era veteran, but I never actually went to Vietnam. I have the highest respect for those who served in Vietnam. Every time I see a Vietnam veteran at the VA hospital where I get my healthcare I say, "Welcome home." Many Vietnam vets to this day never heard anyone welcome them home. May your father rest in peace.

Just because I can work with my 70% doesn’t mean everyone at work is happy about me being there. I had to take a pay cut just to not get fired for hostile work environment. Now my boss sends me to stuff alone. But it seems now like I’m getting dumber and dumber. As an electrician, we’re supposed to get smarter and smarter. My helper from 10 years ago has a better job than I do now. My whole family is scared of me And I absolutely HATE public. I haven’t celebrated my birthday in over a decade Despise holidays now because I have to do stuff. Pretty much just stay in my room unless I have to go to work, which I play hooky at least 2 days a month. CPAP sucks at staying on my face all night, often have terrible headaches from it. I’m just venting Apologies

After 5 years waiting on the judge at the BVA, yesterday I was granted 100% P&T. And it was for mental health, went from 30% to 50% bringing me to a total 100%! That's a huge stress relief!!

@@Joe.B007 I recommend you look at the VA rating schedule and if you meet the narrative for 100% in mental health, I think you should talk to a VSO to move forward. Do you have anything outside anxiety & depression? I needed that 50% to push me over, but I have multiple 20s and 10s, like 15+ services connected disabilities.

Yup... and all this oh you're grandfathered in.... sure until they decide to just erase your rating for sleep apnea because "well it won't lower your overall rating" it just knocks you down from 94 to like 90% then when you file for any increase or claim they open everything and hammer you with erasing tinnitus.

I thought about that. Also, the more mental disability, they will possibly lose their ability to own or operate firearms. That is a major concern to our current administration and his handlers. Trying to keep them from rising up if needed against government overreach.

It’s been my experience that the VA never gives you what you deserve the first time, it seems you only win by appealing the initial decision. Also do not fall for those ads that offer help for part of your claim. There are agencies that will represent you for free. The VFW and DAV are two of them and I cannot say how happy and impressed I am at their work. God bless them. Do not give up.

I been stuck at 70% for 5 years a lot of people say I should be at 100% from being in the blast area of Fukushima when the reactor blew while we were helping out the Japanese in 2011, I really hope something give cause even though I’m working full time it doesn’t feel like I’m keep up, prayers brothers and sister in arms.

Since I got out in 2012 from the US Army at JBLM, I have been fighting this battle with the VA. As of , 2024, I was finally awarded 100% P&TD. My Mental Health went up from 30% to 50%, my shins went from 30% to 50% and got tinnitus added for another 10%. It has been a long road! What I did was assed every single picture of items i bought to show I was trying my best effort to get better. Shoes, insoles, OTC meds, ointments, getting massages/ chiro. Leg massagers I bought etc. I uploaded every bit of evidence and wrote a letter as well describing everything.

Not surprising at all. How many of them were actually competent for the job when they applied? And how many of them used their rating level to by-pass other requirements get on the cert? That's the bigger issue with disability ratings and federal hiring.

For sure. I got so tired of the system. Beat me down. It's been 15 years. I went from 10 to 40 by myself. And then they kept on dragging it out, dragging it out. So I finally gave it to a lawyer a lawyer got me from 70 to 80. Non't stuck at 80. And I want to be a compensation doctor in downtown Miami. And possibly, I might be doing better. I have an erophy for my right knee. All the way down on my foot. Cause it has served results on the inside and outside of my ankle. Or I broke it into and dislocated it. I have step disk. My knees and eggs give outhe VA pulled the bottom part of my lip from the top as I have basil cancer. Now I can't breathe out the right side of my nose. A no. They told me that was irrelevant that I can't breathe. How do you say that to a person? So now I'm just waiting on the system. Trying to get to a 100%. God bless all veterans and people that have gathered life for this country. But a veterans shouldn't have to struggle like this. We're the ones that are out there.Fighting or freedom and which stands for the American Flag of the United States of America.God bless😮😮😮😮😮😮😮😮😮😮

Hey brother. I honesty appreciate what you do for us Veterans - providing updated info, changes in VA regulations, and all around support. Im at a combined 80% service connection. I filed in March for TDIU with a 70% bipolar disorder rating (personal and lay statements included). I have high hopes and I'm prepping for the C&P. I know it's an extensive waiting game, but I thank you for all the vital information you've provided. Keep up the good work.

When I retired in 2014 at age 60 from the military I took a copy of my health records to DAV to negotiate for me. Best decision I ever made! They were able to come back with a 90% rating. The conditions were back daymted to when they occured whike on AD. I am going to go back to DAV and open a case for other conditions that were denied but are now a problem. I have not been able to work since I was 61 years old and I am now 69 years old. Have to wait and see the outcome!

My brother, you have gotten so much better with your content and delivery. Please keep us updated on the mental health rating. I currently have a claim in for depression, anxiety, insomnia, and stress as secondaries to tinnitus (serviceconnected). Diagnosed, being treated for, nexus letter, and my C&B examiner agreed I'm suffering because of tinnitus. Semper Fi.

First- thank you brother man for always keeping us informed when God knows how they like to not tell anyone anything. Second, I have been at a 70% rating since leaving the military in 2012 and I have applied for increases about every two to two and a half years with no changes coming back. My rating comes from Severe Complex PTSD after several deployments but was always told since I can wipe my own fourth point of contact still that I would never see a 100% rating which is wrong. I shouldn't have to become so debilitated I cannot accomplish daily tasks to receive a hundred percent when I know for a fact as I am sure with many other vets my life isn't the greatest because I am dysfunctional in other aspects of mental health that are not recognized so here's hoping that changes now thanks again, battle buddy...Jack

Thank you! Im a spouse of a disabled veteran. He was rated at 70% when he should have gotten 100%. We have been fighting for the other 30%, with two out side psychology doctors. It has been sitting on a desk somewhere for the past 4 years waiting for his case to be looked at. This has been stressful for him as he feels he can't provide for me as a dependent. It's shame how our veterans are treated. I have seen the vast decline in the health care. Trying not to be political but under Trump administration, we received a letter stating they made a mistake and awarded my husband compensation. Under this administration, the psychiatrist has cancelled many of my husband's appointments which we are terrified of losing compensation due to their lack of. Im pissed to be honest.

Please have a Service Officer fill out the form that basically tells the VA to find your file and get it moving again. We have sat for a year after a higher level review waiting for a C & P. Within 3 weeks the VA contacted us and a C & P was immediately set up for the final item.

A letter to your representative to Congress and/ or your Senator ( assuming that they actually care about Veterans ) with a copy of the letter added to your husband's VA medical records will serve notice to the VA that they can't drag their feet on your claim without having to explain to your representative or senator why they are delaying your claim process. Putting a spotlight on their incompetence usually gets them to act, if for no other reason than to hide their inactivity and incompetence. Keep fighting. And good luck to you and your husband.

The service officer is the best answer, you can find these people at the VFW, and American Legions also along with the VA, but for the VA find a small office, also if you are close to a military base they will have an office near or on the base you can go to for help, they help the SMs getting out to get theirs put together and moving.

I’m waiting in my HLR to process. I got a duty to assist error on my PTSD, migraine, ED, and sinusitis. I had a CAB to tie into service, but the Jackson VA denied my original and supplemental claims. I put in an HLR immediate after. My c&P exams were good; but the VA didn’t want to tie it to my service. I was national guard by the way. I was one of the soldiers who graduated Basic, AIT in September, and deployed in December of 2008 for OIF..

I got the 70% after a long battle and was told that since I was holding down a job I was stuck. Even tho my therapist told them that I was struggling to work with other people in a cube. Hard. Very hard. FINALLY I landed a 100% remote job with the VA (funny). Now I hide in my office and do my work. But soooo many online meetings. I have told the VA that IF I got 100% disability I would be retiring for good. So just because we are in a job, doesn't mean we are not 100% disabled.

I work nights as security, because I cannot deal with humans in most situations. Civilians are idiots, and even former military coworkers piss me off enough to make me livid. I've lost several jobs due to my reactions to those who won't do their jobs, or do them correctly. After going through chemo and radiation for the past several months, my body and mind are not as adept at dealing with stress and conflict. I don't know how I will be when I return to work now. It was bad enough BEFORE the surgeries and treatment. Lord help us all!

I know tons of 100% disibabled vets that work full time - they're everywhere. At the end of my Air Force career - l was being forced out at 19 years due to medical problems - i was offered a seperation and 10% disability and i was hurt doing my job on active duty. I fought my case with help of my congressmen and dozens of personal statements from co- workers. They offered me to stay in until my current DOS which put me at 21 years. I agreed as i would get my retirement. I also received 30% disability. I fought with VA for the next 10 years as a retired Air Force veteran and my rating changed numerous times from 30 to 50 to 80 back down to 60, back to 80. then 90%. Once there i quit fighting as i just got tired of it, but now i want to get back in and shoot for 100% as I have been out for 16 years now and everyone says i should have been 100% from the beginning. I only worry as i had 30% for right wrist carpal tunnel and had surgery a couple years ago and think they may try to take that if i try for an increase. I still have issues with that hand even after the surgery. Thank you for the great videos !

I went for PTSD because of several things that occurred in 1976 that never went away. I was denied, and my main argument was that I had had a shity childhood and that the Coast guard basically exacerbated that. They denied that and I just recently found that, long story short, during a 3-week stent in the public health service hospital in Baltimore prior to boot camp, the Coast guard determined that I was psychologically unfit for duty, but sent me to boot camp anyway. The Coast guard says they don't give a damn about that. My back was also permanently injured on board ship during a hurricane off the coast of Nova scotia, and that's where I get my VA disability.

Veterans should be considered innocent, until the VA proofs to a Federal tribunal enbanc panel that they were guilty of claim fraud. Otherwise Veterans should not have to battle with the VA's raters and how the system's platform was built, just to apply for compensation.

Currently at 90% and I’ve been fighting to get to 100%. The VA combined rating schedule needs to be revamped, along with the wait times for decisions. Filed new claims and increases for existing claims last October, and I’m still waiting for a decision. 🙄

I'm 70% for PTSD, 5 others all rated at 10% each. All service connected. Overall rated at 80%. Thinking about filing for TDIU to get 100%. I have not worked since 2018, and it's documented in my records that my PTSD keeps me from working, and when I last worked. Been 12 years, started at 50% overall in 2011.

Try going through the DAV. I did in 2018 and was approved in less than 6 months. I'm sitting at 70% for PTSD but I get IU and my records say p&t. Makes no sense they keep.you on IU and say p&t but won't go ahead and change rating.

How have your mental issues affected your physical health? You might be able to file a secondary claim for back, knee, feet, bilaterally. why? Mental health impairs self care, leading to break down in body, etc etc.

I'm currently rated 80% , 50 for ptsd, 50 migraines, 20 for my right shoulder, with migraines, at 50% you have to show an economic impact, like missing work, unable to work, using PTO, sick leave, the key word is prostrating migraines, the VA recently did me dirty when I asked for a increase on my ptsd, they temporarily rated me 100% for a month, then in the same letter denied or kicked me back down to 50%. Such a uphill battle fighting the VA.

Filing a new claims can be a can of worms, it’s just bate to open up whatever rating you have and decrease ratings, no the VA’s fuzzy math is not in your favor, all those bonuses that were granted should be paid back by VA employees, if there is any money that was saved should have gone back into the VA. Is the rating retro active to day of injury or when a claim was filed, the system is ask and it may be given, mental health prevents and prevented veterans from filing

I've had 18 jobs since getting out in 12' . My mental disorder is "adjustment disorder with anxiety and depression. I've struggled with civilian life because I was all in for military service, but back injury and surgery killed that. I just can't seem to find a job that brings me overall good feelings of doing. I hate it. I have a job now but It brings me no self gratification. I'm at 30% mental health rating but submitted for an increase in October. Still waiting to hear from someone about a c&p exam or anything. Luckily my VA appointed therapist filled a dbq and I submitted a buddy letter from my wife and shipmates. Hopefully I hear something soon. I could use the increase. I'm not asking for 100 but a 70 would be life changing. Thanks for the info brother 🙏

I was in the same boat, submitted a claim in October still hadn’t heard anything in by December because they didn’t have any openings in my area or within 50 geographical miles. I called the VA and told them I’ve been waiting to get a C&P exam, they told me they only had one doctor available and this doctor was full for like the next few months. the VA help me out looked into it and before you know it, I had a call from optimum or whatever Heck provider they use and set up my appointment within a week so if you’re not hearing back call VA.

If you get 70% you can apply for individual unemployability and get paid 100% unless they changed it.

I have 10% service connected tinnitus from my time in service 40+ years ago. Followed that up 10% secondary insomnia and 30% headaches. I have hearing loss service connected at 0% and sleep apnea confirmed, but not deemed service connected. I feel lost.

No. You’ll be fine in most cases. Millions are on depression and anxiety pills. it’s when you get committed because you’re seeing things, get committed due to suicide attempts or involuntary commitments when you act unhinged and aren’t making any sense to the police on the highway. When you can’t handle paying your bills or driving or feeding yourself daily even though you can walk just fine, etc.

I lost a kidney and adrenal gland to cancer back in 1993. As a result, I gained 75 lbs. within in the first year, which makes me obese. Is this something I could get compensation for? I have been denied benefits twice without ever having any exams and am on my 3rd time with this case, have had exams but still haven't heard anything. I am 77 years old and didn't even know until about 4 years ago that I was exposed to 4 pages of toxins including agent orange at Ft McClellan in 1964 and 1965. That explains all my health issues that none of my 6 siblings have and neither did my parents. I was a healthy 98 lb. 18 year old raised on an organic farm and don't ever remember being to the doctor.

My Wife helped her Dad get a claim started. He was exposed to agent Orange in Vietnam in the Coast guard. He gets $5,000 a month now plus Social Security.

Apply under the PACT ACT. Sounds like you qualify. They expedited those claims last year, not sure why you were not notified.

Write your Congressman and Senator that TDIU should become permanent after 10 years. Stopping people from working is counter-productive to the whole economy. You are not paying into Social Security and not paying into a 401(k). You could be funding America by paying taxes. That is what disturbs me about TDIU.

Don’t be a knucklehead. TDIU is for vets with SCD’s that PREVENT them from earning substantial income. Pretty safe to say that a vet already paid with disabilities here she has to live with for the rest of their lives. Taxes? Good grief. Get some education and understanding before you speak on something you have no clue about.

Yes. It can be done. But 100% ptsd is soo much harder. Takes a record of chronic ptsd and getting worse( might take years of records). A doctors second opinion, convince your C&P examiner… so many steps most won’t do. If you don’t have a CAR.. you’re not even considered. But if you’re crazy enough like me… 4183$ a month waits for you

The Va just gave me 10% for tinnitus and zero for service-related prostate cancer and they said my sleep apnea was not service connected.
