My health situation fluctuates slightly, if it gets worse ill see doc. I was approved for SSDI at 58, the award letter said the review will be in 5-7 years. I’m guessing I’m in a safe spot? I heard you say” unless you work.” Are you saying that even if you stay under the monthly income (1,350 in 2022) that could trigger a review at my age range?

Thank you for the informative video. Your videos helped me get approved for SSDI on my initial claim - mostly for mental health no less. That being said, the approval letter has already advised me that I'll be subject to a CDR in three years (when I'll be 34 years old). I'd like to try and go to college part-time (6 credit-hours per semester) while receiving benefits but am concerned about how these activities may affect my CDR or even trigger one to occur sooner. I don't intend to earn a degree. I just want to try taking a part-time class schedule at the local community college to have some responsibility and social interaction. Are my concerns warranted? Thank you!

I’m 59 and I am having to do a review, my first one. I have a rare disease called psoriatic arthritis mutalins. It effects 2% of the population. My rheumatologist and my dermatologist both have not ever seen a patient with a case as severe as mine. If you look up mutalins being 1 of the 5 types of psoriatic arthritis it states that it is a very severe destructive arthritis. And it is 100% disabling. It has destroyed my spine. I had to get an implant called a spinal cord stimulater implant. Of course my joints. Severe fatigue & pain is something I live with 24/7. And now the psoriasis has spread massively all over my body. It’s more than 70 % of my body. My skin Constantly bleeding and itching . Very uncomfortable. Prevents me from sleeping, I’ve been up all night. All of this is in my medical records. I see my doctors routinely My rheumatologist, pain management, dermatologist, general practitioner on or around every month. So why after my husband filled out the review paperwork and records were given from my doctors as well as my medications list would I be in review? Clearly my diagnosis is in my records. I feel it’s a waist of time. Of corse I have time . But I’m in pain , I’m tired, and it’s very stressful! Anxiety goes along with what has happened to me. Getting this rare inherited disease and having to give up my career in my 40’s has been devastating. My youngest daughter only age 11 when I got so sick I had to retire at 47, she really needed my help with college. But I can not work to help her financially. Now she is about to have her doctorate in pharmacy. Praise God , he made a way. My other daughter is a nurse. We all choose careers in healthcare. It was just so hard to tell my daughter I didn’t have the money to help her. Doing all I can but that brought on anxiety as much as the day to day task I no longer can do. I just feel I’m being harassed. Or the ones reviewing my case are not actually reading the information to know how serious my case is. If you have a severe disabling disease it just doesn’t go away. As time goes on it becomes worse. Each month is harder for me. I think this review process should be handled differently. Because currently it is wasting Government money & resources. My review should have stopped with a review of my records. With my diagnosis. Because mutalins is not something a person recovers from. Unfortunately. So now I have to add another doctor visit to the list of doctor visits my husband takes me to. A mental evaluation scheduled by the insurance company hired by the government. I guess no one in this review process looked at my medical records. It’s just sad. Those who work and pay taxes pay for reviews on people who absolutely qualify. And if you work for decades paying in and get sick you have to use every ounce of strength to fight for disability. My fight was 5 years. Shouldn’t have been but it was. Now I’m having to go through it again at 59 and very sick. It’s just wrong.

Barbara. I will be 59 in a month. And my diagnosis is psoriatic arthritis mutalins. It’s an aggressive debilitating severe and rare form of arthritis. Rheumatologist say it’s the most severe and painful and destructive of all arthritis. It effects 2 % of the population. Unfortunately it runs in my family. I believe in miracles of God but I must also deal with the reality I have been handed. Each day is extremely challenging for me. It’s very hard on me physically & emotionally to go to these review appointments. It’s very upsetting for me. Anxiety goes along with severe debilitating diseases.

Good Afternoon Ladies, May I please ask a very important question? I am on SSDI. I have a heart toward Fostering child as I have done for several year prior to having to apply for SSDi. I am trying accurate information about weather or not the children fund i.e. their monthly stipend will be considered a personal income for me which could be further from the truth. However, it does make me uneasy about resuming care is that I am being asked to fill out a W9 form which the Foster agency stressed is only for the purpose of receiving the funds on behalf of the children to care for their daily needs. I live in New York City, to be specific Brooklyn. I'd really appreciate any information that you can share so that I can being to accept those children that really need a place to live and the blessing of a family.

+Nirvana_Love: To address your 3 (three) questions: 1) [...You're and you have been on for many years and had prior reviews then what happens?] [Answer: Need more info-but still cannot provide any "definite" answer. This depends: How long ago was your last review? Short form or long form? Any job earnings; medical improvement? Seeking medical treatment? For what medical problems? What source(s)-medical-incl. general practitioner/ specialty physician(s), etc.? For what condition(s) are you receiving benefits? Any new impairment(s) since your last review? These may be taken into consideration.]. Note: You can be reviewed at any time; but for more people, it is "generally: no sooner than 3 (three) years." Sometimes, it may be 3 to 5 years. Sometimes, a "works earning" review may determine if you had been earning over a certain amount (numerical only) that may be regarded as significant (and without special accommodations/help.)...(cont''d)...

(cont'd)... Will they wait longer to Review them? Depends on many factors. They may or may not. Depending on backlogs; &/or administrative changes involved more frequent reviews-or short form vs. long form review diaries; types of treatment-if any; & many other factors; the nature of your condition(s), credibility; reports/findings from 1 or more "Consultative Exam (CE)" to which you may be referred, sample audits of certain conditions to review more frequently, findings from your medical records & any other records provided; possible consultation w/ those source(s)-if relevant-& /or contact w/ you-(e.g. to resolve any discrepancies.)... If you do work or attempt to work while receiving benefits, notify the SSA immediately (even before, if possible) in writing; the nature of the work, and always send copies of paystubs. Notify the SSA each time you stop and start working for pay-no matter how short-lived or subsidized, as well!

I’m confused and want to call SSA but am reluctant to do so. I was awarded disability and even though my conditions are chronic the judge said that I was gonna impove only I actually worsened considerably since then. I’ve developed several new physical conditions and so I was reapproved after an 18 month review. However they gave me no indication at all as to when I would be reviewed again. They just said they would “periodically” review my case. Since then I’ve actually developed even more disabilities. In fact my pulmonologist thinks I have fibromyalgia that is causing me to be unable to breathe and explains why I keep having more and more physical disabilities-idk. But I have no idea what periodically means. Meanwhile I’m about to be 50 in a few months. What should I make of this?

Yes; they may-if your case went before an ALJ (Administrate Law Judge) for a condition that resulted in "Partially Favorable", then there will be a review for sure. Some "Fully Favorable" decisions may be reviewed by the Appeals Council without your knowledge. None of these 2 (two) situations constitutes a CDR (continuing disability review.).
@ticks4ticks4
@ticks4ticks4 3 жыл бұрын
As far as "Continuing Disability Reviews" (CDR's) go; they may review your case at any time for any reason (or no particular reason). At this moment (August 2021), there are 3 (three) "Diary dates" for "CDR's): 1) "Medical Improvement Expected" (MIE) -review generally no sooner than 6 to 18 months (i.e., theoretically, no sooner that every 12 months); 2) "Medical Improvement Possible" (MIP) -review generally no sooner than every 3 (three) years; 3) "Medical Improvement Not Expected" (MINE) - review generally no sooner that every 5 to 7 years. They have been known to be "behind schedule; e.g. 3 to 5 years for "MIP" ; 2 to 3 years for "MIE" ; however, don't count on it!

If you did not appeal the decision within the 10 days; an 'extension to appeal for good cause" should be filed. And/or: The case needs to be reopened within one year of the "termination of benefits." However, an SSDI-affiliated attorney or legal aid office that has an Soc Sec Disability legal aid division should be consulted, since this needs to be handled on a "case-by-case basis."

I have bipolar disorder and I had serious issues with mental illness since I was in my pre teen years and my father died when I was 15 and I received social security survivor benefits which turned into ssdi benefits as soon as I turned 18. I've only been reviewed once and that was 11 years ago in 2009 when I was 27 and I'm 38 now. I've received the short disability update report form twice already in 2014 and 2017 and they deferred a full medical review and they recently sent me another short form and I'm waiting to here from them. My condition doesn't really change at all. I don't work at all and I'm usually home by myself and seldom go out but I always take my meds and see my psychiatrist and my psychotherapist so hopefully yet again this time they will defer a full medical review just like in 2014 and in 2017. I've never worked and I have no formal education beyond my GED and have no skills or training at 38 years of age and have been on ssdi my whole adult life for the past 20 years so if I lost my benefits I would be unable to survive. I have no family and really no close friends either

I am also 38 but have never had SSI- instead have gotten denied 3 times. I have treatment resistant depression, C-ptsd, CTE, Borderline personality, Agoraphobia, and narcolepsy with cataplexy. I have only had medicaid on and off, but I have NEVER been able to keep a job longer than a month and a half. I am finally applying again, and my psych doc is helping me. I already contacted a SSI lawyer and he told me to EXPECT to get denied again- purely because of my age! Uhhh, how about they come hang out for a day with my unstable ass, instead of only rejecting me because of my age ugh 🙄 My prescriptions are close to 1k/mo, and now im sick with some rare calcium disorder and I don't have any money or insurance to get legitimate help. I am filing my 4th SSI application in the morning and will fight it with the lawyer I spoke with. My son and I have eaten only ramen noodles and bologna for a week (just re-filed for food stamps and Medicaid after Obamacare just dropped me) but this is no quality of life. I am grateful for your information, it is exactly what I have been looking for (a female, around my age, with mental health issues similar to mine that prevent her from working- that successfully got SSI)👏🙌👏 Thank you for sharing! It took me 5 months to hear back from social security after they sent me my short form disability update report last October and in March as always I was told they won’t be reviewing my case. Usually though I hear back within a month but corona held it up this time. I’m very sorry about your struggles. It seems like them denying you because of your age maybe because they reckon you’re too young in their reckoning. Idk. It seems like it’s easier for ppl like me who are declared disabled as teenagers and who have a deceased parent who paid into the system and it’s also easier for ppl over 50 as well. I wish you lots of luck with getting your well deserved benefits. I also live In Massachusetts though I’m originally from WV. and in MA. and more liberal states like it it’s easier to get benefits. My late mother moved me up here when I was 17 because she knew I would get better benefits up here. Idk what state you live in but that could be a factor also

I got my benefits at age 58 mostly for major depressive disorder and generalized anxiety disorder. I also suffer from extreme panic attacks. I had asked Avvo Law Group about a CDR at age 62 last year and they told me the same thing that you said. One thing I want to mention is that some people might be able to work with mental disorders. Others can't. It's a common stigma. People criticize it and don't take it seriously. Now it might be easier for an employer to hire an applicant with a physical disability to accomodate them following ADA law. But they might be a little hesitant hiring someone with a mental one. They might find it hard to deal with them not being able to follow simple instructions, have trouble concentrating, thinking and making decisions, mood swings that distrupt the work enviornment, sad and irritable most of the time, no energy, have high anxiety with almost anything, constantly forgetting, etc. I take antidepressants. They may stabilize me, but they won't cure me. A review at my age for all that really would be pointless.

I'm not sure this is accurate. I was 31 when I was approved to get benefits, and the letter I received said I'm in the "not likely to improve" category, which, according to the brochure, means I'll be reviewed in 5-7 years from then, and I've read online that that usually means 7 years. Anyway, a guy can hope.

I am 60 yrs old and suffer from Bi Polar and PTSD. I was awarded benefits the first time around. I have a review this summer and I worry about everything. I stopped taking a lot of meds I had been taking because off my liver Issues. I have been taking different antidepressants for over 20 years and the side effects are awful. I also had a horrible car accident due to klopin not knowing the side effects it could cause when you came off it. I had a seizure and went airborne and hit a tree 6 feet in the air. I broke my sternum, back and crushed my ankle. I don’t want to take all of these drugs. Due to the PTSD I only leave my house 2 to 3 times a month because I have such bad anxiety and severe panic attacks. I guess what I want to know can they stop my disability check if I don’t go back to my shrink. I see my Orthopedic surgeons for my back, foot and neck issues and my family physician of 30 years regularly for my Bi Polar issues.

I have a relative that I care for on Disability. He's 55 now and his last CDR was 7 years ago (2013) when he was 49. Are you saying that despite the rule that a CDR has to be performed once every 7 years, it's likely he won't need to go through one this year or anymore at all now that he's 55? I hope you can answer this please.

Great question! Please note that, until a disability recipient reaches retirement age, by law, they MUST be periodically reviewed! Although all review time periods are approximate, let's say if someone was assigned a 7 year MINE(Medical Improvement Not Expected!) review time period diary, when first approved for benefits, then, they're reviews will happen at 7 year intervals until they reach legal retirement age!
@stormwulf117
@stormwulf117 4 жыл бұрын
@@ricgillis1280 If that's the case, what is she talking about at the 2:53 mark? Retirement is at 67, not 62 or 55.
@ricgillis1280
@ricgillis1280 4 жыл бұрын
@@stormwulf117 I think she was talking about the probabilities of a person being reviewed, as they get VERY close to retirement age! For instance, let's say if a person is to be reviewed every 7 years, and they're reviewed at age 55!, then, another 7 years at age 62, there's an extreme probability, that they won't be reviewed again, because another 7 years, they will be aged 69, therefore have reached full retirement age! So, to conclude, although it may not happen, a 55 year old, with a 7 year review window, that's just been reviewed, can EXPECT 1 more review, at age 62, before they're done with reviews! I'm sorry for the long explanations!LOL!

Often, it's a situation that, as a disability recipient gets closer to retirement age, they may receive the short form to update their medical records, instead of the extensive, intensive, expensive, and time consuming full review! At best, it's best to continue proper, and timely medical treatments, keep great records, and stay ready!, as the responsibility of continually proving one's disability, stays with the recipient, regardless of the frequency, and type of reviews!

Can you talk about the upcoming changes to the reviews and change of rules that the Trump administration is pushing through for 2021? Also I am 55 and received a short form CDR in the mail a week ago. I think my retirement age is 67? Then disability is supposed to roll over to social security. With the upcoming changes people like me will be reviewed every 2 years.

Thankfully Biden took Trump's BS changes and drop kicked into them into the garbage pit they belonged in, going as far as braking with tradition and _firing_ Andrew Saul

Hi Ruth, as they said in the video, it is highly unlikely that you would be reviewed after retirement age. However, for a more detailed answer, I would recommend that you contact SS directly. Thank you!

If you are 71 you are receiving social security. You won't get reviews at all any more.
