Are you at risk for termination by Social Security of your #disability benefits after a continuing disability review? Over the past few years, Social Security has put more effort into reviewing certain types of claims for termination of benefits.
Termination cases are very problematic for disability claimants because the appeal process in these cases is identical to the appeal process in new disability claims with one big difference - it can be difficult or impossible to find a lawyer to help you prove that you are still disabled.
When you receive a notice of termination you have the option of having your monthly benefit checks continue while you appeal the proposed termination. If you choose to have benefits continue, there will be no past due benefits. Unless your lawyer is willing to work for free, you will not be able to find a lawyer to accept your case under a contingency fee contract. You will therefore have to file your appeal paperwork and appear at a termination hearing on your own, or you will need to find a way to save up several thousand dollars to pay your attorney directly.
If you choose not to have benefits continue, you will have past due benefits available and you may be able to find a lawyer to work on your case under a contingency fee contract. But you will have no money coming in each month for the next one to two years.

Social Security should not be allowed to review someone that has a permanent disability. I am reviewed almost every year even though I have a congenital brain condition. I understand that the qualifications change as you’re an adult but in this case, me being an adult doesn’t change anything. My condition doesn’t get better, it’s congenital and none of my disabilities have lessened. Every time they review me they try to say that my eyes are fine even though I have optic nerve damage. They try to tell me that I don’t have cerebral palsy when it’s obvious that I do. They don’t review people because of improvement, they review people because they have nothing better to do. You can try to prove me wrong but my case is solid evidence that that is true. Nothing about my disability can get better and SSi literally tried to say that there is nothing wrong with me. Honestly, If the people in charge of evaluations for SSI can’t grasp the fact that congenital disabilities are permanent then they shouldn’t have a job anymore.

Once again thank you for this information, and all the other valuable information that you constantly provide. At the age of 58 I was approved with the, “Medical Improvement Not Expected.” My letter said to expect a CDR in 5-7 years. I still currently see my pain management physician and I get regular injections every few months. Although it’s somewhat comforting to hear that someone in my age group may not have a CDR, I still remain in fear that for some unknown reason they might choose me to put through the wringer once again. Thank you again for the information!

Keith, I think it is extremely unlikely that someone close to 60 with a 5/7 year review notation would be reviewed.

By the time they pull your file for Review you would be retirement age. I hope that they just leave you be and it converts to retirement. I have a loved one this age and I worry about him too! Best of luck.

I have been on SSI since November 2013. I was scheduled for a review. Medical Improvement possible, every 3 years. To date, I have only had 1 short form and that's it.

if you send the form by mail would it help to send it by USPS registered mail? that way someone would have to sign for it when they get it.

I was recently approved in April 2019. I called social security based on this video's review date and they gave me my date of 4/2022. I'm now 47 years old and will be in my early fifty's when my hearing occurs.

@@stbam1965 unless you have a good enough doctor and a serious enough condition or they can't hear you but age has nothing to do with it when I mostly has to do with this if there's a lot of people on this social security disability. Can still work but they don't want to I know people that fire disabled for hiking mention of bulging disc and bulging disc is not preclude you from doing work you can work from home on your computer there's another person that I know that was on and still is on disability for a broken leg I'm sorry you're broken leg does not for crude flu does not stop you from working Social Security Disability should only be for serious illnesses or injuries

This would be a good video to do an update on. COVID seems to have shut down many of Social Security processes. My uncle (age: 64) is on SSDI and earned 4,000 in 2020. He's extremely worried SS will terminate his benefits but I just don't see that happening at his age. (He's tried to go back to work for many years, often earning a few hundred or one to two thousand in a fiscal year until his disabilities force him to give up -- he DEFINITELY isn't trying to milk the system in any way. He emailed me photos from his working in 2020 and his body was covered in black and blue marks.). I asked him if the SS office was open where he lives and he said it has NOT been open for more than a year now.

Hi there Mr. Ginsberg...Thanks so much for informative lectures. My question for you is as follows: I'm 59 now and was awarded a fully favorable decision 3 years ago...100% thanks to my outstanding attorny and his staff. What actually happens when I turn 65 which is the earliest I normally would have been able to collect Social security. Do they convert me from disability to regular social security? Jason, I believe you can elect to continue receiving SSDI until age 70, then you have no choice. I would discuss with an elder law attorney or retirement Social Security specialist (premiersocialsecurityconsulting.com/our-services-maximum-social-security-benefits/)

Hello, I was approved for disability meeting 2 listings. The primary listing being for anxiety and the secondary being for hearing loss. My question is if I get a disability review and social security determines my anxiety has improved will I still be found disabled meeting the secondary listing of hearing loss?

Great videos. You helped me get my case seen faster and I was approved. You give good tips. However, when I was approved in 2018 my letter stated that they will review in July 2020 so I called my attorney and he said not to worry about it that they most likely wont do it. I still see the same doctors and therapist as well. The only difference is I see my therapist 2 a month verses 4 a month so a little improvement there. What are your thoughts on a review really happening?

Your video was stellar as usual. I watch & save all of your videos. I have a couple of questions when I went in and initially for disability, in November 2013, I could barely move. I was 49 years old. I don't even recall getting a denial letter. One day I got a letter in the mail and they sent me to a doctor, so I went. Approximately a month later I had a $5,000 check in the bank.I thought something was wrong with my bank statement. 1. I got approved. 2. I believe it was in August 2017, I was 53 years old, when I got a letter asking about my medical conditions. I went to an office where they help you fill these forms out. He sent it in (because my vision is getting very bad), I have lower back problems,my lymphedema never seems to go away and my ulcerative colitis kicks up I said my condition was worse. The man sent the form in. Approximately 5 months later they sent me back a letter saying, there was no reason can proceed with anything right now .They will contact me if they need to talk to my Dr and that was the end of it. 2. Maybe it's just me but I've had people follow me around stores. I'm really paranoid I really really watch for those things I actually keep my shades down except when I'm airing out the house. The other day I was in the store and the guy with his tag turned around comes up to me and said " you really shop here a lot." I asked him who he was he said, "let's just say I'm a guy who saves people a lot of money". And he continued to watch me shop. 3. Am I worrying too much?

Bill, my experience has been that SSA is putting more emphasis on reviewing claims for people younger than age 50. Also, given your conditions I don't think you would be someone that they would review. Now, SSA does encourage the public to report cases of fraud and if there are people in your life who don't like you, they could be creating problems.

Johnathan, hello, I am on SSDI since 2006 with degenerative disc disease. I'm 65 years old as of july 30th 2020, I received my last CDR in 2012, I went before a hearing officer who ruled in my favor based on my age at that time and years in the system and my physical limitations. I am by my understanding eligible to retire next year on Sept 30 at age 66 and 2 months. I am concerned SSA will try to remove me from SSDI before I can transition to retirement status. Please share your thoughts. Thank you.

I was approved for ssdi in Cincinnati, Ohio 20 months ago and I received paperwork for a re-evaluation that stated the paperwork must be in by March 20. Am I right in assuming that I should retain an attorney immediately? I think it is likely that they will take my benefits even though my circumstances are the same as the time of approval or a little worse. I turn 49 March 1st. Do you have referrals for Cincinnati?

yes i have gotten one of those letter,s and i send them medical paper,s on what was going on with me and they send me a letter back letting me know that my case wont be review at this time being that i gave them proof of my medical condtion

Jacqueline you raise a very important point - when SSA send you paperwork asking about work or medical treatment updates you have to reply and send it in. I suspect that many reviews turn into terminations because approved claimants simply don't respond. It is also important that you keep SSA updated as to your address if you move.

@@justintahair9119 I am not a lawyer, but in my opinion you should go to your doctor from time to time to make sure you keep somewhat current with medical diagnosis and opinion. Don't worry, but get and keep a doctor ASAP. Like the wonderful lawyer who runs this channel says, just be sure to keep everything SSA sends you, and respond to their requests for information. If you do these things, your chances for keeping your SSI are very good.

I write date recieved and initial ALL incoming correspondence. Also, when there is no sent date I include the postal date stamping information from the envelope.

Thank you for this video. Social security said that they are starting a review on me six months ago. I filled out my current paperwork they asked me for. Six months later I still have not heard back from them. Is it because they are backlogged in their continuing disability reviews?

That is possible as normally they tell you if they completed a review and found that you are still disabled.

I've been on disability for several years for a very serious spinal disease that causes me severe pain. Along with several other medical issues.. I just received a letter stating that they are canceling my disability and taking me off it because they believe I am able to work.. so now I have to go through all this process of paperwork and doing an appeal.. but I think I would just do it on my own without a lawyer because I cannot afford one..

I was curious under my SSA how accurate is the percentage that it shows completed. Under the five steps the first two are checked green. The 3 rd step DDS is not checked but I’m at 85 percent completed. Would that be accurate.

Question: Can getting a commercial driver license be a good reason to stop or trigger a review of your social security disability benefits, considering that, passing a medical evaluation is required in order to become a commercial??.... Thanks.

If you can qualify for a CDL Liscence medical card, you will be found NOT disabled. I used to have a class A CDL and I could not pass the medical for keeping my CDL, My atty told me that having a CDL will negatively affect your claim. I dropped mine because I had not used it in more than 10 years and knew I would no longer pass the medical. Back in the early 2000's you were not required to get the health card renewed every 2 years like you are now. Fact of the matter I hadn't been required to pass one because I wasn't driving commercially for a long time. I just kept it because they are hard to get if you ever need to drive OTR.

Dave, I always encourage folks who have lawyers to stick with who they have. If you fire Attorney #1 and hire #2, both will have to file fee petitions and you may end up paying more. Also it can be difficult to find a 2nd attorney because SSA typically sits on fee petitions for 2 or 3 years. I would ask Premier if they plan to have a local lawyer try your hearing or are they going to send someone to cover it. There is nothing inherently wrong with using a large, out-of-state law firm, but you do need to ask that they keep you updated.

Ricky Harvey SSDI provides a higher monthly benefit and makes you eligible for Medicare at an earlier age after receiving benefits for 24 months.

I don't know. SSA does not make public its internal policies regarding reviews. My experience has been that reviews of any type are triggered by earnings being reported. Also if you are younger than 50 there seems to be a higher number of reviews as well.

Again, another excellent video..I'm a big fan. I'm in my 40s and my last CDR stated I would go on getting SSDI. Another review would follow in 3 years. Aside from the multiple spine surgeries, morphine pump, and spinal cord stimulator, I was diagnosed with RA requiring Methotrexate. Grid rule doesn't apply of course. Do I stand a chance getting approved the next time with the stricter rules? Thanks..

If your condition is getting worse and you are in your mid-40's then you should not have an issue with a CDR.

I have been getting SSI for schizoaffective disorder since 2000. I got a Review letter recently. Problem is I have been working three times since getting SSI. I get fired immediately after training because of my schizoaffective disorder and on all these jobs I last less than 2 months and have been fired on all of them. I am always the first one out of training to get fired..I sincerely tried to hold down a job to see if I am capable but sadly I get fired weeks just out of training.. I have said innapropriate things because of my schizoaffective disorder. The last time I wrote a supervisor a very bad work because I was so disoriented.. I actually wrote "---sshole" to him in an email because I was disoriented and forgot where I was.. I wrote this to a superior... they gave me one more chance and I said a bad word to a coach and customer on the phone.. I called them a "bitch" because I was not feeling well mentally and they heard me. .I could not deal with the stress of the nagging customer on the phone and my coach would not help me..I don't know what got into me when I said that..I was not feeling well when I said that. I was the worst performing member on the team and my trainer hated me because she had to repeat things to me multiple times. In another job, I thought a group of co-workers were against me and I called them 'terrorists" because one of them was middle eastern. I did not just say that to them, I yelled that to them that the supervisors on the floor heard me yell that and got concerned there were terrorists working for them and they had to talk to me..Well, the very first day out of training they fired me on the first day on the very first phone call because they said I "abused a customer." The truth is, my yelling on the floor things like "terrorist" and my behavior made them uncomfortable and they wanted me to leave the company. Generally speaking, unsuccessful work attempts will help you because they show that you are motivated to try to work but that you are unable to do so. I would get your employment records so that you can submit proof to SSA.

Seizure cases can be difficult but if you have brain scan evidence and support from a treating neurologist you can definitely win.

Does a CDR mean that the person has improved to the point to return to work, or, that a determination is currently underway. Little confused.

It means that an investigation is underway. The result of a CDR can be either to dismiss the review because the person remains disabled or to move to terminate based on medical improvement.

heres a different question ...i was receieving ssi and had a review . which came back unfavorable and lost my benefits and requested reconsideration and to continue payments which were granted . i was hospitalized when my hearing date came and was told to send hospital records to hearing office within ten days . which i did . the hearing office sent a letter saying i missed the 10 days mailing date . they counted wrong but i was terminated .i sent the info to the ALC judge and he agreed with me sending my case back to the hearing office and saying i should be put back on benefits and should be paid for the almost year and a half i didnt get benefits cause of judges date mix up. while my second hearing would be scheduled again .which they did reschedule for march 2020 .which the hearing judge phone hearing told me he was appoving my case ....heres the thing .at first they said i owed the money back from when i did get paid while waiting for first hearing . over 12.000 dollars plus some 3.000 dollars they couldnt explain and so took it off . on my online account it still says i owe 7.000 dollars out of the twelve . but isnt the 12.000 thousand dollars owed back to me ..being i was granted my 2nd hearing from their mistake and eventually won that also . dont they owe me for the year and a half i wasnt being paid since i should have been paid that if not for their mistake ..since i won both with no lawyer either . no one would take it ....thank you for any info .its been a hard last couple years ...also i should they they had also cut my amount by one third during that time . but goes back to the original amount june 20 . should they owe me thar difference too ?

i should also say they say i owe the 12.000 thousand / 7.000 thousand from when i was being paid . which i dont because i won and would have been paid ..but what about the year and a half i didnt get paid because of the 1st hearings mailing mistake when i would have been paid if not for their mistake and i do not owe 7.000 $ because i won the replacment second hearing ...right ?

I have a mental disability and was sent a second letter review saying they want more information. I can't even keep a job past 2 month i also don't often get a jobs to et one I typically whatmonths between jobs. I have hade this issue since a child when a was first awarded my SSD. Now as an adult and unable to keep a job I'm a little worried

I have a question if you're able to answer. If you have been on disability benefits for 10+ years and you get a cessation of benefits letter, can you reapply for disability? If you didn't work while you were on disability is that counted against you if you try to reapply? I have read that you have to have a minimum of 5 years of work in order to even have a disability application considered, and it is a bit confusing for those who have been on disability but lose benefits, then try to reapply. Do they still look at your work history from the past prior to when you first approved for benefits?

I have read on SSA’s website that if you work, even a little bit, even way under SGA, during the first two years after you have been awarded SSDI or SSI, you definitely will have a CDR if for no other reason than to just Carefully examine your income and assets...,and this could lead to a medical CDR. Is this indeed true as I understand it? And, why the two year period...does it have something to do with that waiting period for MEDICARE?

This was a great video... I have a friend that is on a 3 year review period and her paperwork says that her next review date is May 2018.. She has not received any paperwork from SSA say that they are getting ready to review her case... Seeing as though this is August, should she assume that they are not going to review her case as May has already passed? Should she assume that her next review will be in 3 years in May 2021? thanks

Robert, I would not assume no review until May, 2021 - it could come sooner. Your friend needs to keep her address updated with SSA and if SSA sends her paperwork to fill out, she needs to respond.

Mr. Ginsberg, how likely are they do drop disabled people in their 50's with balance, vestibular vertigo/migraines , blood sugar and nerve issues? It took me 4 years to be approved, after I got sick in 2004. I went through hell with failed trials of meds which did not work for me. And due to driving issues, I no longer drive distance, or around town very much. I'm apartment -bound most days thanks for your info, very good job on your videos, Bobbi.

I’m 59 I was approved for SSDI a year ago for anxiety/depression. According to my approval SSA gave me three years of benefits. I’m still experiencing all my symptoms. I will be 62 when my benefits end will my case reviewed?

Possibly - sometimes they review right at 3 years, sometimes after that and sometimes not at all. It is less likely you will be reviewed given your age.

My CDR sat in the disability determination state for 2.5 years and then i filed an appeal with odar then its been there 2 years 2 hearings 3rd one in feb. They resent me for ce few months back and i had same test w my new doctor they're unreliable or whatever so i cited a case law with 2.00 listings then they sent my shit to a ME whos tryin to undermine my original basis for disability but i hit them with an obsolete childhood listing in effect during that time frame and also that medical improvement was relatively minor changes so this ME is trying to undermine the whole shabang and they recalling a diff VE but theres a supreme court case about step 5 or 8 in CDR with VEs not citing they sources picking numbers outta the air so maybe that'll keep me in the loop

Where does it say on your letter when to expect a review. I have seen other comments and other places that usuallyits on the approval letter when you might expect a review. I’ve read my papers several times and haven’t found anything about that says anything about a review. Did I miss something.

It does not appear on every written decision. We don't always know what review schedule applies to a particular case.

i recently had a review and those damn things are annyoing, i am stscared of the future why is the inmates treated beter the seniors and dsiabled, i have not work since 2010 and 2 shifts 4 hour for two days., its a 2 week job,. and they stress me out will they throw you on the street why they support inmates i am 37 years old and those forms stress me out where i dont sleep for quite some time and it was my first review since beeing diagnoised disabled due to them, i was aproved in 2010 and the next review says 3 years.

I was approved SSDI with a 5-7 year CDR range. This is now year 7 so I guess I will receive one this year. I am now age 62. If I am denied can I get regular social security at the reduced rate? I am also raising my adopted 7 year old grandson.

At age 62 I think it is unlikely you will face a review. But if you do and SSA moves to terminate (which you can fight), you can transition to early retirement Social Security.

I became disabled at age 27 in 2005, I suffer from a rare disease called Stickler Syndrome which causes horrible pain/popping in my joints and connective tissue deterioration. I'm 41 now and I've had 52 surgeries in last 14 yrs and counting. I take strong medication and go to the doc regularly. I had my first CDR last yr 2019 at age 40 and they quickly determine that my disability is continuing and they will check in from time to time. Do you think it will take another 13 yrs for my next CDR? Thanks in advance!

one question to ask i have had surgery on my spine i had a tumor removed from my spine that was rap around my spine it took 2 surgery and after that i was in rehab for 3 months and after that i had a lot of damage that was done to my spine i have no tail bone so what was left was fused to gather then i started to have seizures 20 to 30 in one day i was told there was so much damage that there was nothing they could do the dr left town any way this was done in 96 i am in a motorized wheel chair have trouble walking and had a partial stroke on the left side of my body again 3 more month,s in rehab to learn how to walk and talk and dress my self and fed my self even though all of this has happen to me i still get a letter from social security do i still need more proof of all of this or i dont know what to think next thank you

I'm 51, I was approved by an ALJ this year. A combination of my medical, age, work history ( truck driver 30yrs), transferable skills ect... Obviously the grid rules came into play in my approval. Even the vocational expert opined "No jobs available". I have received the award letter and it also states due to the possibility of improvement you will be reviewed in 2021 (3yrs). My question: Since the grid rules where applied in my case and nothing is going to change, I might get worse , I'll be even older still (54) I can never pass a DOT physical again, why have a review? Wouldn't the same grid rules be applied?

If you are asking about how an approved claimant can afford a lawyer for a continuing disability review (CDR), you have to either pay several thousand dollars up front or allow benefits to stop while you want the 2 years for a hearing. It appears to me that the CDR system is designed to put unrepresented claimants in front of judges at SSD hearings.

The SSI ruling was that i have tears in both my wrists and that is why they gave me my benefits. They didn't count my bad vision my bad knees and ankles and my schizophrenia to help me get my benefits. Then they reviewed my case and told me that my i had to have different reason or reasons to keep my benefits coming in. Right before all that i was fortunate and unfortunately having terrifying schizophrenic episodes in which i was hospitalized twice and began seeing a psychiatrist regularly and got right back on my antipsychotics. They allowed me to keep my benefits for the remainder or the year. Fast forward to this week and now they sent me a CD-R and 4 pages to complete stating what meds im on and Drs i see also including my work history. I think they are going to try to stop my benefits and i find this very disappointing and stressful being that I and my wife currently have to budget our finances and generally live paycheck to paycheck. If we struggle to save money now getting my benefits how much more difficult would it be if the SSI stop me from receiving my much needed and only source of income. Another thing is i recieved a disc in the mail yesterday and today i put the cd disc in the laptop and the disc was empty and was basically a blank disc.

5:44 regarding hiring a lawyer for your case......... for instance, if you decide to seek legal assistance from a new lawyer, that same % goes to BORH lawyers that handled your case. Meaning, don't even expect 50% of the claim you're entitled to. My suggestion is to background check, get info from the state bar regarding the attorney you're seeking, look for negative reviews from them. Then, hire the 1 that you approve. Otherwise, might as well grab your backpack and sleeping bag because more than 1/2 the amit due to you, after winning a case is not even enough to pay for your prescriptions.

i only received a letter from ssdi saying my disability was reapproved. they are in contact with the veteran affairs hospital (my medical records and social worker) i never filed anything. i filled out the application. i dont believe i put my limitations on the application. i think all i wrote was my diagnosis, my doctor and va disability rating. i barely gave the ssdi anything. i just let the ssdi get my medical records from the veteran affairs. i went to an exam and it was very brief. i never embellished or made my condition out to be more than what it was. i think thats where people go wrong. they overexaggerate. they believe they have to overexagerate. thats why investigators follow them. thats why they constantly look over their shoulders for people watching them. if you are worried about money more than treatment then your heart is in the wrong place.

Hi trying to help my neighbor so bare with me. He is in mid 50's been on SSDI for about 8yrs had 2 reviews 1 long 1 short and continues to receive benefits his approved disabilities are migraine and ddd. He follows up with spine doc who writes script for nerve pain, and neuro for migraine med but cant afford the spine injections anymore and says they never did anything to help. He had a prior cervical fusion but area below has now begun to cause severe nerve pain as well as a nerve impingement in lumbar region The migraine med is just too expensive so it uses up most of his avail income. He was due for a review this spring but since covid hit assumes there is a back log. His spine doc retired a few month ago and he is concerned a new spine doc will want to put him through all the same med trials, injections etc that he can not afford or decide not to take him on since he's not willing to do anymore than meds. Any advice for him. Do you think a full review if that were to happen will put him in jeapardy. He sees both a neuro and spine doc about 2x year ea

First, my experience has been that once a claimant reaches his mid-50's reviews are less common. But if he has one he will need evidence of ongoing medical care. If I was in his shoes I would do everything possible to establish care with a new orthopedist so that there will be objective and opinion evidence available if he is reviewed again.

What do you do when you are denied , receive your letter for denial and see that the judge left out important facts and said things that never happened in the courtroom? My judge used quotations around words that I supposedly said that aren’t part of my vocabulary and said things about my medical history that aren’t even there .

You can appeal to the Appeals Council or you can file a new application. In an AC appeal the question is whether the judge's omissions are significant enough to support a remand.

Don't even try to work. Better to become homeless. No winning they will continue then deny you and say you owe them, and want you to pay back. One letter says your work was not substantial or sustainable your eligible to receive your benifits. Then the next time it's was substantial an sustainable and you owe us for that month.

Dear Mr Ginsburg, Hoping you can give me a little insight.. I'm going to be 63 in May, I've been collecting SSDI since 2013 due to a couple of quadruple heart bi-passes. The last one was very bad, got an infection and I wouldn't heal, after three years of being sick and also the removal of my right side of my sternum.. long story short.. they left a spung in me, but would not own up to it and said it was a piece of fat... Anywho last year I was reviewed. I think because, I tried to work ... I couldn't do it way to much for me.. I would like to try again to work but very concerned that they will try and take my benefits.... Any insight would be welcome... thanks so much.. John.. Also would like to know when is my next review... I'm seriously thinking about living abroad, sure would be nice if I could work a few months before I go...

John, SSA does not make public the factors it uses to review approved claimants. Sometimes evidence of income seems to trigger reviews but not always. It seems to me that given your age and your medical condition you would win at hearing if SSA tried to terminate your benefits but do you want to deal with the hassle. If you have not used up your 9 trial work months you could certainly to that. Beyond that if you stay below the $880 trial work period trigger - www.ssa.gov/oact/cola/twp.html - you should be ok.

Mr. Ginsberg, I have a question? If someone is in their Forties and they have been disabled for a long time, say 19 years will they bother them a lot? I know that they review people who are under 50 more but if this individual already had several reviews and was continued. The Nature of the Disability is Severe Mental Illness. My guess is that if you have a very long term diagnosis and treatment record and there has not been any significant improvement then it is unlikely that SSA will select your case for a review.

I got an ex social security attorney to handle my disability case, and he didn't charge me anything up front--when he won my case for my benefit, he was paid 25% of what I got in back pay--that lawyer is full of bull malarky as for as I'm concerned.
