That was the exact moment when arrest became an inevitability for that cop. He was (rightfully) pushed into a corner and decided to do whatever was required to make sure the kid was arrested. That pride/spite is gonna cost him (or rather his town’s taxpayers) severely.

It didn't matter if he said it or not. The cop was taking him in for DUI. The cop made up his mind before he pulled him over. The cop got him out of the car and flat out lied and said he smelled alcohol on his breath. The cop knows not a thing will happen to him for arresting sober drivers for DUI so what is the incentive to not do it? The incentive to do it is they get promoted based on the number of DUI arrests they make along with other factors. It doesn't matter if those arrests later get dismissed.

@@flatcube3706it's true though. We need to hold the bad ones accountable, but I have a good friend named John Preston who works for Owensboro ky police department. He would die to protect anybody, and give you anything you needed. He would never drudge up a lie to try to frame you he has a beautiful soul great guy I promise. That's not to downplay the bad ones we all know they're out there in abundance but there are a few gems I promise.

For anybody who is wondering what is going on with the lawsuits…. On 2/14/2024 federal judge ruled that the kids lawsuit may proceed forward as to the judge it was clearly and obvious from the start that he was not intoxicated. For the officers counter suit.. judge ruled that the kids comments about the cop being “on the slow side of the spectrum” and the cop being “unfit physically and mentally” were not defamatory and were thrown out. However, judge said the cops could proceed with the lawsuit due to the kid saying the cop was “convicted” of domestic abuse. In reality, the cop was served a restraining order from his ex under the grounds of alleged abuse. You’re welcome.

I live near the town this happened in. The police officers filed a lawsuit against the kid recently for defamation. These police officers are abusive and disrespect young adults all the time. It's pretty sad.

Officer came up to the window and was instantly trying to escalate the situation. When that didn't work, they arrested the kid with absolutely no evidence of wrongdoing. They should be fired. If this is acceptable under our system, then our system is broken.

Important context, cop Nathan Winters is currently employed by NPD he currently has an active protective order against him for domestic abuse, has had that order for ~1 year and his victim recently filed for an extension of the order. He remains a cop. I have asked the city for 10:38 PM Oct 3, 2022

Disgusting! I just had the same situation in Orange County, CA and I told them I wants drinking, anyway they did all the roadside test along with a breathalyzer and said I had blew 0.081 twice in a row without letting me see the results. Then they put me in jail for almost 24 hours and when I got out I had no charges because I never had a thing to drink. Now I am suing the PD for arresting me and breaking the 4th amendment. I cant wait to put these disgusting tax paid servants on trial and hopefully taking their jobs so they cant harm anymore tax paying citizens.

He was surely coherent as there is no way you could say it wasn't easily possible to follow his meaning, and the occasional push backs about the officer looking stupid were both true, and easily understood and didn't make the whole any less understandable. Not that you should have to be polite when falsely being accused of crimes, that seems an untenable position, if someone needs only rile you up enough to get you being even slightly impolite to hold that against you.

I was a cop for two years, and I am sitting here honestly wondering how anyone could be expected to respect the police. One night one of my co workers tased a guy going into diabetic shock because he wasn't "immediately compliant". There is a sad disconnect here, and I don't blame the public at all for their lack of trust in law enforcement. This is embarrassing.

When did we allow officers to be come judge jury and executioner , when qualified immunity was created giving the scales of justice so much bias it’s still not recovered . Body cams and dash cams have helped but the controls of them still allow evidence for or against to be lost

Happened to me. Completely derailed my life. 25 years later thinking about the damage it did is sickening. the thing is, once you've been labeled as a criminal the standard becomes multitudes lower. Any police officer that doesn't think to him or herself, "before I arrest this person were they truly doing anything morally wrong in anyway whatsoever?". Here is my biggest concern with those field 'sobriety tests'. Some people out there CAN'T pass those field tests, due to poor equilibrium, bad balance, clumsiness, and many other factors. On the two occasions that I been through sobriety check points, I always tell the officers, "I can't pass sobriety field tests, because I have bad balance. I'm willing to wait for the breathalyzer, but I respectfully decline to take part in the tests". On both occasions, the officers thanked me and sent me on my way. Of course, that was 20+ years ago. In today's environment, I would probably be arrested.

That heel to toe test is a Balance test and is pretty much impossible for people of a larger size (obese) to complete as required. It is safer to skip the field tests and take the breathelyzer, especially if you know you are sober.

First, and I am sure you know this, but you don't need a degree in law to be a cop. Second, and I have been through the academy, more time is spent learning compliance techniques than actual law. At the end of the day, the law matters very little. It's all an ego thing. You'll notice when radioing he makes numerous exaggerations. To say this is common is an understatement. There is this constant aura of intimidation. This goes for within departments as well. I got in a physical altercation with one of my supervisors on a training day, that ended up being why I left law enforcement. Mind you, I wasn't fired. It's almost impossible to fire a cop. I left. I can go into this story if you're interested. In conclusion, you're right. School yard bullies who are used to getting their way. That's what it boils down to. The bully on the playground didn't have to admit he was wrong. Why would he? In your words "Sad as hell", and in my opinion, I couldn't have said it better.

Any time a cop uses "smell" as a criteria for probable cause and it's proven that there was no such substance, that cop should be considered a known liar by the courts. There's an auditor in my city who focuses mainly on the right to drink in public. "Drink," not "be drunk." One of the things he does is walk around with a root beer bottle in a paper bag. Cops have claimed to smell alcohol from his breath or the bottle several times, only to be proven to be liars after doing a search and finding that it was root beer. He never consents to these searches, meaning they're done without probable cause since the smell is a lie.

@@YenellyT That’s the best way to do it! I was going 83 in a 45 and that’s reckless driving so I should’ve gone with him to the station but I cried. To be fair it was 3 in the morning and I was going to work! 😂 nobody was on the road! So he took pity and I just got a ticket 💁🏻‍♀️

He didn't even do that. He was respectful and courteous initially and only when the officer wanted to do a DUI test and the kid asked if he could record it, did he change his demeanor a little bit even then he was pretty much being a non-confrontational stand up guy throughout the entire thing.

Yeah the kid gave attitude pretty early on. Before the blow comment. I'm not saying it's right, but just don't have any attitude and only speak to the question don't ad lib. Or hell, just refuse to talk. You might go to jail, but you'll be free in the morning. Any decent lawyer will love you for not saying a damn thing.

Same, and then I was aggressively harassed because I wasn’t submissive enough to the cop. Never been pulled over before or since, and shouldn’t have been that day either. He reached in, unlocked my door, grabbed my arm and pulled me out of my car. No ticket, no charges, because I did nothing wrong, but that opened my eyes. It was 30 years ago and I still shake when I retell the story.

Eh, I don't think he initially didn't act as bad as some people here say, plus the driver did screw up at least the walking test. However, after the 0.0 it was quite clear the kid didn't do anything bad. There was no indication that he did any stronger drug.

Never submit to testing, and don't answer questions, especially when you're sober. My eyes are red quite often because I have allergies and wear gas permeable lenses. I also have a physical impairment that would prevent me from passing the field sobriety test. It's bullshit. How do they determine when a person took medication that was prescribed? Let's say that someone took medication at 8am and drove 16 hours later? This man was NOT impaired. It becomes more clear that there is some sort of financial gain for street cops to arrest. I think we need to look into this.

Counter-suing is not something that the officer does. Most likely it's purely financial decision, an attempt to reduce legal expense and liability. If you think about it, using every opportunity to reduce taxpayers' expenses is the duty of public officials, regardless of the ethical considerations.

I don’t trust the police anymore, though I shouldn’t have long before I’ve seen all this police misconduct, because I too had been in a similar situation as this kid being falsely accused. I know we want to say not all cops are bad, but when the issue is this rampant the issue extends far beyond individual cops. We need to start by getting rid of qualified immunity.

He claims to have smelled alcohol, but when that didn't pan out of him, he pivoted to weed even though pot is INFINITELY more smelly than alcohol yet he never mentioned it until AFTER the PBT showed 0.00. That's 100% proof he was fabricating a charge. 😠

they're written that way on purpose. The purpose is to give officers leeway to apply them and then people have to fight them in court. You have to prove your innocence. It's literally your word against the officer's.

OK, you're good to go. I'm not sure how they test drugs here, presumably by blood test but never those weird street tests...

I believe that is by design. They railroad you into the system, and you have to buy your way out, even if you're 100% innocent, and even if it's painfully obvious that you're innocent. It becomes a "give me money or else" game. If you don't have the money to fight it, too bad for you, they don't care. This kids entire future could have been DESTROYED because of an arrogant thug tyrant that couldn't admit he was wrong. Absolutely disgusting how this "system" works. And they system loves DUIs because of the revenue generation it creates, so they won't let you out of their grasp even if they KNOW he was innocent.

"wrongful arrest" is LITERALLY kidnapping. I know how we're supposed to "fight it in the courtroom" and all that but one single night in jail can RUIN YOUR LIFE. Lost job, inaccessibility to medicine you take, your children possibly needing you, an emergency can happen and you can't be there to take care of it... The list goes on and on and on. To top it off, after paying thousands to file a lawsuit, your compensation comes from taxpayers (AKA YOU)

A few years ago I was constantly being pulled over for DUI. On one I was asked to take a field sobriety test. I called my lawyer and declined. The second time I took the test and passed. I always offered the breathalyzer. I am not the worlds greatest driver… but it was ridiculous. When I was asked y I didn’t want to take the FST, I explained I am a horribly nervous person. I had no confidence in my ability to pass🤷‍♀️.
