Section 43 gives them the power to search IF THEY BELIEVE THEY WILL FIND EVIDENCE, it does not give them the right just to have a look to see if they can find something. Being surrounded by people in fancy dress with firearms is enough to have caused you “harassment, alarm or distress”. Therefore the only people breaking the law is the three officers.

NPCC directive , that all police officers are supposed to have read , clearly states the conditions under which Section 43 powers of search , detain , and arrest can be initiated. Abuse of this act has resulted in hundreds of thousands of pounds being paid out in in settlements.

The clown at the end was more insidious than the clueless original man-bun cop, trying to make out the cameraman is being unreasonable and 'asking' - or intimidating, as others would see it. How about being reasonable by respecting people's rights and not trying to invoke terrorism legislation after admitting they knew he was not a terrorist. He was also trying to make out taking pictures is a bit odd but I think a bloke in his late 40s with a man-bun is odder but we don't see anyone demanding he goes home and gives himself a haircut (and probably a decent wash, the scruffy herbert).

The other thing is private security's tendency to lie or exaggerate when reporting matters to the police. People need to badger local police commanders (usually, a Superintendent or Chief Superintendent) to listen to them about the conduct of private security as it is taxpayers' money which is being wasted when the private security goons make false or exaggerated 999 calls to them. It is your hard-earned money they are wasting (part of your Council Tax Bill called the Police Precept) and it is your right to hold them and funding local authorities to account.

Obviously he searched you to get an ID. . Looks like an easy claim. Speak to HNK solicitors for a decent payout. Section 43 reads: "A constable may stop and search a person whom he reasonably suspects to be a terrorist to discover whether he has in his possession anything which may constitute evidence that he is a terrorist." No mention of reading SD cards or such. Constable needs to have reasonable suspicion. None of that in your video. Don't bother with making a complaint - that will go nowhere. . I have no experience or connection with HNK, but both Auditing Britain and Marti have used them to get very reasonable payouts. Let us know how you get on with this, thank you.

Please, please in future ask them what the 'reasonable' part of the 'reasonable suspicion' is. That's the important part to me. Almost all of our laws are based on reasonable suspicion, not just suspicion. They have to articulate it. Just being in possession of a camera/drone is NOT a reasonable suspicion, especially if it's backed up with an explanaton. Suspicion is an opinion without any facts.

I think a good questions to have been asked here was ‘what if a group from a photography club - say 15 - 20 people - were walking through the industrial park together, with tripods and cameras,(and maybe drones) taking photos as part of a club project’. Would he suspect them all of terrorism and search them all? What did he say ? “You cannot predict the actions of a terrorist”. So if he’s set a precedent of searching a single photographer he would have to search them all. Who knows what clandestine intentions such a group may have? And what better way to disguise themselves, than in plain sight, as a harmless group of photographers? Maybe the Government should make it law that all terrorists carrying out hostile surveillance should wear a hi vis jacket stating TERRORIST, to differentiate them from the legal photographers.

By the time you got to the third cop, you should have said “am I being detained, if so, what crime have I committed?” If they said no, you should have walked away from these copsplaining 🛎️🔚s. With them telling you not to do it again, I would then have gone straight back and done it again. The days of cops telling you to “move along” are long gone.
