Trial Day 51
Robert Durst stands trial for the 2000 murder of friend Susan Berman. The trial began just before the pandemic in early 2020 and was halted two weeks in. The restart happened on May 17, 2021, with the same jury panel.
The defendant’s wife Kathleen McCormack Durst went missing in 1982. Evidence and testimony would show that Robert Durst killed her, the prosecutor said. The defendant allegedly told Berman it was an accident and asked her for help. She served as his alibi.
Berman, 55, was shot execution-style at her Beverly Hills home in 2000, and the prosecution suggested that it was because of what she knew about Kathleen’s death and disappearance. As defense lawyer Dick DeGuerin would have it, however, Durst is innocent. His client only came across the body, panicked, and fled, he maintained.

If you think Durst's ability to recall detail is astonishing, consider Samuel Little. 93 confessions. 60 0f them confirmed. He painted portraits of his victims and recalled the smallest details of the killings going back as far as 35 years prior during his interrogations. This almost total recall is common among serial killers. They love to talk detail. I wouldn't be surprised if John Lewin consulted with FBI profilers for input regarding the most effective approach for tickling Bob's urge to be in control of the narrative, to excite detail and play the game necessary to win justice for the victims.

@raga raga defense will say that Durst is old and sick and confuses things now and also the murder is a long time ago.I hope the DA focuses again on the actual evidence of the susan murder in his closing

Isn't that badgering the witness? He answers the same question over and over until the prosecutor can make him say something that doesn't match. How is that allowed. You can't even do that with police interrogation. I would throw out the case just because the prosecutor is the worst I've ever seen. Defence is like a church mouse, should be saying objection a thousand times over whenever they ask the question again. Judge just sitting there doing nothing like its a TV show

The judge has actually had to explain this to the defense numerous times. On cross examination, a witness can be asked the same questions for several reasons. 1) to see if the answers remain consistent. 2) to ensure they *actually* answer the question (Durst usually doesn’t). 3) to show inconsistencies in the testimony. Lewin is doing this partially to show that Durst’s testimony is NOT consistent. His answers vary sometimes wildly. He’s also not letting Durst get away with refusing to answer questions without essentially saying he won’t answer the questions. The judge has *some* discretion in this, and the “352” objection is usually applied. The part of 352 that applies is that it is a waste of the court’s time. The judge has sometimes sustained that, but has also sometimes overturned it. So essentially, yes, you can ask the same questions repeatedly to try and illicit a different response. It’s well within the law. The judge is right to allow most of it. The Defense had that right under cross examination as well, and used it repeatedly with Nick Chavin especially. The difference is that the defense is not as knowledgeable of CA law. DeGuerin often doesn’t make objections when he should, and very frequently makes objections that aren’t part of CA law. The difference is that Lewin is an *expert* in case law and uses it to his advantage. Whether you like his style or not, Lewin is actually an amazing prosecutor. He focuses almost exclusively on cold cases. He pursues them with such dogged determination that he essentially becomes an expert on them. He remembers details that the other players don’t. He has a 100% cold case conviction rate because he makes sure he has every single piece of evidence he can possibly collect before he brings someone to trial. And because he has such an incredible grasp of case law, his convictions don’t get overturned. He is actually careful about not allowing the judge to include things he shouldn’t. Because Lewin doesn’t want to give any reason to lose an appeal. It’s why there are so many stipulations in this case, and why he offers them so freely. It’s protection.

Hyperthymesia is also known as highly superior autobiographical memory (HSAM). According to a 2017 study , people with hyperthymesia can accurately and readily recall numerous details about events that have occurred in their life. There’s only 20 ppl in the world with this ability. Bobby could be the 21st.

It’s only so amazing because he’s making it all up!! It seems like he has a superior memory because he - like other good liars - relies on the added detail to make it seem more truthful. Reminds me of Casey Anthony and Jodi arias.

Yesterday (in Australia) the judge was saying that prosecution had to finish up by the end of today however, there was no mention at the end of this video as to what is happening and how long prosecution will now continue. Also I thought that Jareki was going to testify ??

SUCH A GREAT PLACE TO STOP... 3 days to grapple with the impossibility of Durst's two accounts! Pretty sure the judge will instruct the jury that if they believe any part of a testimony is false, they can consider that the entire testimony is false, also.

Some , all or none of the testimony, with ANY witness, this is the law the jury is supposed to follow. Judge CANNOT TELL jury which testimony to believe or not.

You know, I’ve had a loaded gun pointed at me. I remember it pretty well. But not in extreme detail because I was very (reasonably) stressed at the time. I’ve also had physical altercations. They’re also very stressful and chaotic and a bit hard to remember in great detail. Durst thinks more details make him more believable, but if Durst had said from the beginning “I can’t really remember exactly. It happened so fast. Things were chaotic” that would have been so much more believable than the extreme detail he gives. And by giving so much detail, he has too many lies to keep track of. He can’t do it.

I mean… don’t watch trials in their entirety then. There are frequently a lot of them. If you watch shows or listen to podcasts about the trials, they’re usually condensed.

Why not confess your mistakes and ask the universe for forgiveness? He is so old. It is truly weird to me - but I guess he gets the attention he wants and maybe needed when he was a child. I feel sorry for him. That he knew so little of love that all he could do was act this way and kill all of the people who truly loved him.

It’s the best way to conduct a cross examination. It’s repetitive because Durst has so much to answer for. It’s to avoid confusion when people answer solely yes or no. Frequently if you ask something like “do you mind if I have this?” And the person answers “no,” some people interpret that as “no, you can’t have this,” rather than “no, I don’t mind.” It may be boring, but it’s just the way trials often are.

@@lmp19791 it’s not because of the charge of special circumstances. The Kathie related evidence is allowed because it proves Susan was a witness, hence the charge of witness killing. The Morris related evidence is allowed because it is a prior similar bad act, in that Morris was ALSO a witness, specifically to Durst’s identity and location, and that is why Durst killed him. The reason this case took 5 years to get to trial (from arrest) was litigating points like this. AND the decision to allow it was already appealed - the defense lost.
