And you are watching the bottom line. Today's topic, disability claims 55 and older. So Michael, explain what this topic means to us today.
Michael Liner:
Sure. So the reason why I want to focus this video on people who are applying for disability, who are age 55 and over is that social security has special rules that are called grid rules. Sometimes they're called medical vocational rules. And what they say is that when somebody has attained the age of 55, you don't have to prove that there's no work at all that you can do in order to receive disability benefits. What you have to prove is that you can't do your past work or any work that you've acquired skills that you would transfer to lighter work, but you have to prove that you can't do that and that you can't do any more than what's considered light work. Okay. Light work under social securities regulations is lifting 20 pounds, occasionally and 10 pounds frequently. Okay. And generally standing and walking for six out of eight hours in a day.
Michael Liner:
Okay. So here's the key thing. Okay. If you are 55 or older, when you're going to the doctor, I want you to really, even if it doesn't feel like you have very significant physical health issues, first of all, every single time you go, I don't care what age you are. You should still be doing this. Always be reminding your doctors about your physical health ailments. Even if it's an achy back, if you have diabetes and it's, you know, you're feeling a little bit in your fingertips, whatever's going on, always be describing it. Okay. But here's the significant thing. I want to look at this in the inverse, because one level up from what's called light work is medium work. And here's what medium work is. Medium work is lifting 50 pounds occasionally up to a third of the Workday, two and a half hours a day and 25 pounds frequently, two and a half five and a half hours a day.
Michael Liner:
So if I can prove that somebody who is 55 or over can't lift 50 pounds for up to two and a half hours a day, or, and here's the one that, I mean, mentally think about this, can't lift 25 pounds for up to five and a half hours a day. Okay. Imagine lifting one of those huge 24 packs of water bottles for five and a half hours a day, then they're disabled under social securities regulations if it's because of a physical health challenge that they can't do that. So always be complaining about your health, your physical health ailments to your doctors. Cause it's not that big of a barrier to get across to be able to help somebody get disability benefits. But if you're not talking to your doctors about it, I'm not gonna have the documentation that I need to make that link.

Mine is a phisical right leg amputated my left leg is giving me problems knee is bone on bone and screws backing out I'm 57 under CDR i do have xray of both screws and knee cant stand that long about 2 Hours knee goes out thanks for sharing

What about if you are already getting SSDI and turn 50? Does it become easier to keep the benefits? I am thinking maybe fewer reviews or just fewer jobs they might try to stick you in. I also have not worked in 20 years or more too. I have specific learning disabilities and autism and possibly other mental disabilities. I was even in a special school for people with similar problems. It was only after the last year there (they went to 8th grade) I was in a regular school but in the special education program there. The first school where I was until 8th grade does not take anyone who has no learning disabilities or other mental problems. I even had a friend there who is legally blind. He could see but not well enough to drive (there is a scary thought) and he needed special equipment to help read books. Back in those days this stuff was so advanced you would be blown away by it. These days it is easy to take those things for granted. I don't remember ever having been in regular classes for anything except wood shop.

I asked my my doctor a physical medicine specialist about me filling for disability he replyed he doesn’t know anything about ssdi.. Stonewalled me .. Kaiser

ill be 58 this sept,spinal arthritis, stenosis, radiculopathy, diabetic neuropathy, sciatica, nerve root impingement of the spine.type 2 diabetes, on 5 meds for it,ptsd with server depression on 3 meds for it,havent worked since june 18 2021 ,so lawyer is going back to the day i stopped work my initial claim

exactly. I am 52,on my initial ssdi/ssi application, at medical review stage at DDS. Just diagnosed with Diabetes,Left sided anterior ischemia and other heart issues, which was discovered in a stress testa week ago. I see the specialist in 2 weeks. I also have a pain management doctor for knee problems. Long work history going back 35 years. My case in June will mark the 1 year mark. The DDS examiner just called me this morning to ask for more medical records. Hopefully this is good. Am I in the grid? Just mailed back the daily activities report or adult function stuff. What are my odds of winning due to this being my initial app, and my age? I am in Texas , so do I need an attorney yet or should I wait til I am denied? The examiner so far has reached out by phone several times when she needed more info. Been helpful. I also had my congressman reach out to them to do an inquiry. Is that bad? My heart diagnosis so far is anterior ischemia LV. The global percentage is 17%, meaning 17% of my heart isn't functioning right nor getting enough oxygen. Which explains the brain fog, fatigue and sleeping all day. I haven't worked in a year. I am bedridden and ready to give up. I am broken physically and mentally. This entire thing has been stressful. I would love to have an attorney reach out to me to guide me.

Im 64 with HIV, Diabetic neuropathy, and Covid Long haul. With on going list of side effects from meds. VE said I don’t have any transferable skills and one job from past work experience under 4000 in the national economy. ALJ asked my attorney for a copy of my last pay stub which was from March 2020. ALJ just wants to verify my AOD. Is this a sign that I will be approved?

Great question. No, don’t be dissuading from filing because you are under 55. But being over 55 is a positive case factor.

@@LinerLegalLLCCleveland I am 52 come May 26th 2024. I have heart issues like LV ischemia and Diabetic. Worked for the last 35 years and living below the poverty line. Are my odds decent of getting at least a partially favorable decision at the DDS level? My case is at DDS in Austin in medical review. Been communicating direct with the examiner over the phone. The lady seems nice and helpful when she asks for medical records. I am hoping they consider all of my conditions as they should equal out. Like I said above, I'm on my initial app. Its been a year, and I haven't worked in a year. Bedridden and suffering. I had a dizzy spell 2 weeks ago trying to bathe and had to go get a stress test, which I then failed. I had no idea my heart was a mess. Love the channel btw. I find it helpful, and I can understand it.

Hello, 69 years old here. Was a truck driver and had a trip and fall on 16 N0v 22. Rotator tear repair and bicep tenodisis surgery in early Jan 23. Both these repairs failed and I had a total reverse shoulder replacement surgery (they also re fixed the bicep tendon) 20 Nov 23. I have been off work since late Nov/ early Dec 22, at doctors orders, been determined to be permanently disabled (even prior to the shoulder replacement surgery) and have zero chance of being able to return to work. I have been receiving full retirement benefits from Social Security for several years but am curious to know if I could switch to SSDI and if that would benefit me in any way? Thanks!

SSDI ONLY FOR PEOPLE UNDER F.R.A. then it automatically becomes regular SS

What if you are almost 60 and have an Associates degree? I have worked as a customer service rep a couple of years and prior to that as a medical transcriptionist for 35 years. I also tried to work at Walmart but could not walk the floors and they did not have a sit down job so I had to quit. I have a history of cancer and I am having mobility issues. I did try to put in for disability but I was denied.

what if you are 61 years old and have not worketin 15 years was deied two time in 2009 i cant read well or rite wel 3rd grade was tasted and the wasd in front of . and he told me to have girl frand support so she did for 15 yaers and i careed for she was sick with a lote of thing and just diad now what do i do i am going to be home less .in 30 day .i can not work and i have not work butthe lawer stop calling aftora they was not geting big money from is my cleam from back then still open
