Excellent point. If you are waiting say for the kettle to boil. Is there some reason to stand over it? If you are preparing a meal. You now break it up in to tasks. Bring a chair next to they counter. Chop veggies sitting at the kitchen table. Spend 15 mins chopping veggies. Put them in a container in the fridge. Go lay down on the sofa and watch a show. Defrost something in the microwave and go to the kitchen table and scroll twitter. We don't think of it as accommodating as we don't ask permission or fill out reports. But whereas before we might spend an hour prepping a family meal. We break it up into tasks. I have had to carry groceries from the store. I live alone and there isn't much option. Yes there are apps where groceries are delivered. Except the courier gets the sale price. You the consumer pay full price plus ten percent. Plus the delivery fee and tip. Additionally let's say you asked for Diet coke. They were out so you get diet sprite. Never mind you would never drink it. The money has been spent. There are certain items if the store is out of I turn around and leave. So carrying groceries. I had to stop every other block. Thankfully the supermarket is just up the street. After putting everything away and taking a pill I had to lay down. Two days to recover from that adventure. Did I mention there's this thing called snow and winter? My choice is do the thing even though it causes pain and slows recovery or shuts down the ability to leave the house for a few days or starve. Details matter to daily living. Yes a healthy person could probably help a neighbour or family member move thier entire house across town. Are they going to play softball tomorrow? Plant trees? No!

The reality for myself is that I've become far more restricted since when I applied three years ago. I hope I can ask this so that I can give an updated picture to the judge.

I've been turned down twice even though their own doctors stated I was unable to work. They sent me 4 payments in June 2023 and then in Aug 2023 they cut me off and I got a rejection letter. I have severe social anxiety, deep depression and learning problems, I only completed the 6th grade. My girlfriend wrote this for me cause I can't write or spell very well. Well we went online and filed a reconsideration which after about 11 months I got my rejection letter about 3 weeks ago. We are getting ready to file an appeal after we get a few letters in. He can't even go outside, he has a trash bag taped over our bedroom window and will stay in there for days. He can't even go to his doctors appointments, he'll actually breaks down and will cry if he thinks he has to go outside. His 56 years old, we have no idea what to do.

Maybe you attorneys should speak with clients more on what to expect to hear amd how to answer those questions. Clients freeze up etc

I'm over 55 I get some not enough to live on so I should be entitled to more SSA like it says I know this page is full of lies I believe it when I see it come my way

You can be able to do some chores at home. They are looking to see if you would be able to do a job like washing dishes or mowing lawns. Now for a case of intellectual disability (learning disabilities) would being able to drive out to the store and buy food hurt a claim? I don't buy much. Maybe coffee, bread, peanut butter or instant soup. One instant soup I like occasionally is ramen noodles. When you have them in the foam cup just add hot water. I don't think it can get much easier than that! My intellectual disabilities can make it hard for me to remember some things or follow instructions. It is a reason why I keep the box some foods come in (until it is empty) so that I can hopefully not burn it again. I moved to a town house and it has a rather minimalistic yard. A lot of those have practically no yard really or one so small that a lot of people who live in them don't own a lawn mower.

Generally speaking, a decision make might ask about driving out to the store and buying food. We have represented many people with intellectual/learning disabilities and one quesiton that "might" come up is a claimants ability to pass the drivers exam. The Judge/decision make might ask questions about how were you able to pass the written exam and driver test. It should be noted that having a drivers license (with a learning disability) is not the death nail of a case. Many DMV's will give a person special accomodations for the written portion... we advise our clients to just be prepared to answer the question if it comes up.

What about if vertigo due to manners disease can limit some or all the daily activities? Like I can do chores instead and outside the house, I can go shopping for our family but the effects of vertigo are always present and if I make a quick turn, or bend down too fast or for too long I’ll get dizzy and lose balance.

Great question! There is a rule within SSA law that states that if someone is off task or not being able to perform their job duties on a consistent basis (ie., would need to lay down due to dizzy spells, recover from a fall, etc.) then that person would not be able to sustain employment because their employer would eventually fire them. The rule is that if someone misses 2 or more days of work per month they would not be able to sustain employment. OR, if someone is off task 10-20% of the work day (or more) that persons also would not be able to sustain employment because their employer would let them go.

That would depend on where one physically lives, no? A house, Condo, Palatial Estate, Standard 4/2 Residence, Apartment, Duplex, Multi-Unit Complex, Van, Truck, or, Camper, or, tent… each has their own requirements and all have varied times of completion of tasks. And the physical limitations of the resident(s)….

Yes, most Social Security Judges take into consideration what your living situation is when they do their examination. If one lives in an 3 story apartment with no elevator. The Judge will ask if you live on the 3rd floor of the apartment, how do you navigate the stairs (if you have a physical impairment). This applies to campers, trucks, vans, etc. the judges will ask questions about how people do chores, move around, etc., in each living situation. Even if you're homeless the inquiry may be about where do you get your food, how far do you have to walk to get there, etc.,
