Hi @Felisha It is not clear if you have court on the old charge that was diverted or the new charge. If a diversion agreement is entered and none of the items listed on it occur then at the end of the time period the original charge is dismissed or entered as a lesser charge. If a diversion agreement is entered into and there is a violation (usually a conviction os a violation but would depend on your state and the wording of the document) then the original charge is reinstated and the fine or other penalty is then resurrected and implemented. Please talk with your attorney before the hearing to get clear on this.

HI Aaron- your diversion agreement should say what needs to be paid. If you had 2 matters and only 1 was diverted or you got something after the diversion then that could be a separate matter.

HI @Lil These types of agreements are in writing- before you enter into that agreement you should read it as all the terms will be stated there. You may be confusing diversion with house arrest which is something different and can impact your movements.

Hi @Conner The best place to get information on your situation is an attorney in your area. It matters where these things happened. It could not be a factor at all - it could be that you are not able to divert this new charge - it could be that the prior offense is used in the sentencing phase for the new charge - there are various things that could happen.

HI @Manny if you agree to terms of a diversion and can do everything except the financial part- go back to the DA and see if you can get it changed to get more time etc. It's always best to try to 'fix' it before you are across the line where you are not complying. Best of luck.

HI @Jason good question - The warrant should specify what is being allowed to be searched so if it is only a few rooms then it is limited to that. if it says the whole house is included then they can search the whole house. Whether they would or not could depend on various factors. If there's nothing to find in your room then it shouldn't matter.

Hi @Uh Nothing should come back once the diversion is completed because then the charges are dismissed. Occasionally there are types of offenses that a prior incident can be used to determine sentencing for a new charge. Incidents involving minors are generally sealed so as not to be public anyway- but the best way is to ask the attorney on your case and read the terms of your actual diversion agreement.

The terms of the probation will set out what happens if you do not comply with the requirements- go look at the paperwork and it will tell you. Contact your attorney in case there is something they can help with. Some juvenile diversions for a driving offense can delay the time that you can get a driver's license - others have different consequences. Good luck.

Hi @e2raw713H The diversion agreement would be in writing. If one is offered to you then you should get a copy and read it with an attorney while you decide if that is the best decision for you under the circumstances. If you are already on a diversion program then there should again be something in writing detailing the conditions.

Hi @Hammy good question. The diversion agreement will be something between you and the prosecutor's office. The first court date is for the plea (normally) so you would just enter a not guilty plea and then get another court date and then work on diversion. Not every offense or situation is eligible for a diversion so you need to know that first. Your attorney can determine that quickly for you - they will be able to let you know if that is a normal thing for your violation and the circumstances which may impact that.

Hammy I really can't say - each jurisdiction has its own rules. Call the clerk's number on the citation and ask them if they know or get the phone number from them or a transfer to the prosecutor's office.

Really the only thing that was different for me is you have a curfew and if you get into trouble while on diversion you could have that ticket put back onto your record and pay fines or get license took on top of whatever you did while on diversion to get you into trouble

Thanks Wesley! I would add for 2R3 that if the diversion is completed (no further charges during the time period and payment of fines, attendance at traffic school etc per the agreement) then the charges are dismissed. They can then usually be expunged so that the record is totally cleaned.

Hi @2guys If you are asking what happens when you go to court to have the judge approve the diversion agreement- they ask you if this is your voluntary agreement and you sign the paper and it sets out the conditions. Then after that - depending on what the charge was that is being diverted- you do the other things- traffic school, drug testing etc later. Your attorney will know the specifics for your charge and the local court system.

Each state and county have different procedures. Start by asking your attorney what usually happens and then ask the court personnel for general information on what to expect throughout the process and they may tell you.

I was charged for an alcohol-related offense and haven't smoked pot in over 4 months but I REALLLLLLLLLYYYYY miss smoking pot and the last few months since this happened I have been extremely edgy, depressed, and barely even leave the house anymore. I miss smoking pot because it cured my anxiety and not being able to smoke it due to fear has been extremely difficult. I just can't function normally without weed and have had no motivation and have gained weight due to being afraid of dealing with others. I am 35 years-old and have smoked pot from the age of 16 through 4 months ago and I lost my job 3 months ago due to having an anxiety attack and walking out after working there for over 14 years. Weed truly was my medicine and kept me level-headed and not having it has made me borderline suicidal and pills just don't agree with me at all and make me feel even worse. I don't care about alcohol that much and the one time I did drink I got into an argument with another person at the local bar where I pushed them one time when they got in my face (which got me arrested despite me not starting anything) but not having weed is ROUGH.

Hi @jahdazhi the best thing you could do is talk with a defense attorney. This is a very small amount and sometimes if the amount is paid the complaining party will help have the charges dismissed.
