How do you find out if you have enough earnings credits to qualify for SSDI benefits?
Social Security’s SSDI program is one of the two main types of disability. You qualify for SSDI if you have paid in enough FICA taxes to earn a certain number of credits. If you have earned enough credits you will be “fully insured” for SSDI, but if you do not have enough credits you cannot pursue SSDI; instead you would be limited to the less desirable SSI program.
As I discuss in this video, the onset date for your disabling condition needs to be before your date last insured for SSDI. For example, if your date last insured is October 31, 2018, the onset date for your disability must be prior to October 31, 2018. In this example, if you become disabled on November 5, 2018, you are out of luck because you are not covered.
Assuming you are found disabled prior to your date last insured, your claim is grandfathered in - you could continue to collect SSDI for the next 20 year.
You earn SSDI credits based on your gross earnings in a calendar year. In 2020, you would earn one credit for every $1,410 in gross earnings.
In 2021, you need $1,470 of gross earnings for one credit. You can earn a maximum of four (4) credits in a year. So for 2020, you would earn four credits with $5,640 in gross earnings and in 2021, you would need $5,880 in gross earnings.
In 2022, you need $1,510 of gross earnings for one credit. You can earn a maximum of four (4) credits in a year. To earn four credits, you would need $6,040 in gross earnings.

To qualify for SSDI you need a certain number of credits earned in the recent past:
- if you are alleging disability prior to age 24, you need at least 6 credits earned in the 3 year period ending when your disability starts
- if you are alleging disability between age 24 and 31 you need credits equal to working half the time between age 21 and the time you become disabled
- if you are alleging disability after age 31, you need 20 credits in the 10 year period prior to becoming disabled.

Generally speaking if you have worked consistently up until two or three years ago, you will be insured for SSDI. If you last worked more that five years ago, you may not be insured.

I've been on SSI for 7yrs. I've since then been diagnosed with austioathritis and I have had 2 surgeries and need to go in now again for the 3rd on my spine. I also had a total hip replacement because of the austioathritis. My doctor and surgeon said I won't get better and to learn to try and live with it. I also have gotten worse on the reasons I was approved for SSI in the 1st place. My question is, can I get SSDI and do I qualify for it?

Great video Jonathan. Here's a question. "Can one's appearance negatively affect one's disability hearing? For instance, if your client has the outward appearance of being muscular and strong. Would the judge take his/her muscular appearance into account? Thanks! Keep up the good work!

Judges are not supposed to use a claimant's appearance in making a decision. Currently most hearings are held by phone so if you think you look to healthy, choose the phone option as opposed to video or in person.

Question: why social security ask me if i take non-prescription medication? Its on the SSA-454-BK

Presumably you take meds to treat a symptom of some medical condition. For example if you have chronic migraines but can't afford prescription meds, evidence that you take Excedrin Migraine would be relevant as opposed to taking no meds at all. Or you may have a condition for which you use non-prescription meds to control. It is all part of the big picture.

I have enough work yrs and credits for ssdi but will I be able to win my claim with severe sleep apnea(43 times/hr stop breathn or wake up) with degenerative disc disease and spondolitis along with diagnosed severe depression currently treatn with meds and counseling? Thanks you👍🤷🏻‍♂️

You don't say how old you are (better if age 55+) but you will likely have an uphill battle. For whatever reason, sleep apnea does not seem to move the meter at SSA. In my experience depression has to be extremely severe (i.e., in patient hospitalizations, suicide attempts, multiple failed medication trials are what I look for) and back pain needs to be associated with disc herniations or nerve issues.

Age does play a factor,but again,if your attorney doesn't do their part and bring the age part up to a judge as a credibility to your case,you can still get denied,I'm 56 with a severe desease and so far I've been denied twice.

What do you mean when you say you "signed up." If you applied 3+ years ago and have not heard anything, I am guessing that your claim was denied and you did not get the notice. You need to call SSA to find out what is going on.

I believe you can get Social Security retirement if you have enough credits.

What if: you worked 30 years, then were found disabled. You were on SSDI for 6 years, then found no longer disabled. You worked for 2 years then got much worse and applied for disability again. Now, you don't have enough credits, right? Because you were disabled 6 of the last 10 years.

Download your "MySocialSecurity" statement to see what it says. You may be in the "extended period of disability" and thus still qualify.
