The plaintiff sold a puppy to the defendant, her friend’s sister. She says the defendant never paid for the dog, so she took the dog back. The defendant put up fliers around the neighborhood claiming the plaintiff stole her dog. She’s suing for the cost of the dog and defamation of character. The defendant argues the plaintiff stole her dog and keeps moving the pet around so she can’t find it. The defendant is countersuing for the cost of the dog.

She didn't steal the puppy she repossessed the puppy. That was her lawful right.

You're trying to sound intelligent by reciting Judge Milian (as she constantly reminds litigants that animals are property) but you've missed the mark. Animals are defined as property in civil matters, but that doesn't imply they aren't sentient creatures. If they were exclusively defined as property then we wouldn't need animal cruelty laws to deter animal abuse. You seem to be a little confused with that concept.

Even if she used incorrect English, it would still be considered English. Were you meaning to ask "what language is that?" Perhaps you should execute better grammar when correcting others. And always remember to begin your sentence with a CAPITAL letter. You also typed one of the ugliest run-on sentences I've ever witnessed from an adult. The comma you randomly placed in the middle of your sentence should press assault charges on you, because you definitely forced it into a place it didn't want to go.

It's actually common, on the civil court they will discuss matters related to financial damages while the law enforcement investigates if a crime happened. But it is kinda hard to investigate if you aren't able to meet the accused person, that's why the warrant. Now since the dog is back when the police send the case file the DA will drop it.

Don't forget to add that by law plaintiff have the right to repossessed property that's not paid for. Defendant filed to police as if plaintiff stole but really the property was still by law the plaintiff because Defendant didn't pay fully. By law the cop was wrong with flyer because it's a civil case! JM was wrong cause the case technically at the time was still open, by law that case should have been dismissed until the whole (theft, repossession) warrant was taken care of. JM helped the cop with her unlawful judgment to award the plaintiff the 150, and the defendant the dog. Here's why, now that she ruled the dog is the defendants now it put the cop in a position that the dog is property of the defendant and that warrant, and flyer is justified as a legal act instead of a illegal act, that was suppose to be handled as a civil case from the beginning. JM was wrong she did that to help the cop JM knew what the cop did was unlawful. If the plaintiff get a good lawyer, or know the law JM judgment can be thrown out, and she can file case on the cop. In my 1st amendment right opinion.

@@brownmarshall5873 On not actually, the repossession happens only in certain types of contracts and this is not one of those. Its not possible to demand a repossession here because besides the ownership being questioned there is no written contract.

It's absolutely despicable to take someone's dog when they've had it for two years. I have loved every one of my dogs dearly and would be devastated if someone did that to me. I'm so glad the judge followed up on the poster and told her there was a warrant out for her arrest!!

I was brutally attacked by a new neighbour on drugs who entered my home, uninvited, and attacked me. She broke in my door, TONS of proof. Not only was she NOT arrested (she broke the law MULTIPLE times), but he arrested ME because I (a disabled 48 year old with no criminal record) had the GALL to finally use a pocket knife to defend my life, literally (she was kicking around my kidneys)! I was the 911 caller, but he did zero investigating. He didn't even ask me what happened. ALL the evidence backed me except the psycho's lies. It took 1½ - 2 YEARS to have the charges dropped only after I REFUSED EVERY DEAL! I was kicked out of my home and forced to live with sureties (or I would have spent that time in jail). The stress DESTROYED my kidneys that I was trying to protect, and now I'm on dialysis. I started dialysis when the charges were dropped. This is in Canada. The cop, Ian Clarke (Port Elgin, Ontario) had an issue with a half brother of mine (same last name). My brother's first question, when his 47 year old sister, who's NEVER been arrested gets arrested asks, "Was it Clarke?" What are the chances?

If someone applies to be a cop and they’re deemed too smart they don’t get hired. The ideal police officer is dumb and loyal so that they’ll fall in line with the gang mentality of the police force. They don’t need someone smart enough to question the morality of their actions. Of course they’ll hire people that don’t know how to spell.

I was actually a little surprised. Normally the courts do not get involved to help out someone who has their hands dirty. While it was horrible for the plaintiff to take the dog back, the fact is that the defendant knew she still owed 150 bucks and had refused to pay. I would have only stepped in after the defendant paid the money.

I find it on that the judge would even give the plaintiff $150 They always talk about coming to court with clean hands and this person literally stole the dog so much so that the police issued a warrant for their arrest. That should void any agreement

@@jncuttie My dad's a retired doctor. I remember him keeping his nails cut to the quick my whole life. I remember as a kid him telling me about scrubbing the heck out of his hands and especially his nails before surgery. He said bacteria loves to hide on and under your nails. So maybe you're the unicorn when it comes to working but I can't imagine any hospital would be okay with those nails especially when the lawyers are looking for any reason to sue?
