The plaintiff says the defendants are her former landlords, who sold the house she was renting and almost left her homeless during the pandemic. She’s suing for her security deposit. The defendants say they agreed to return the deposit until the plaintiff stayed an extra two months past their agreement.

actually the tenant could have held out and not moved out until she was offered more than just her deposit plus 1000 . here in california if tenants have to move out because sale or demolition of property then the tenant can be entitled to 5000 to 9000 dollars . i once was paid 4000 dollars just to move out of a single bachelor apartment because it was sold and i did not want to move out for just 2000 so we negotiated for 4000 .

@@DavidKen878 the reason i kept repeating the comment is because alot of people dont know the laws regarding certain types of evictions. u can look into it and see im not making it up . if an eviction is happening because the sale or demolition of property , then the tenant is legally entitled to a certain amount of money for being forced to move , its the law in many states.

@@marleonetti7 Okay, but what difference does it make? Even if the property isnt being sold and the owner no longer wants to rent to the tenant, they're still forced to move. So can you explain it to me please?

I've been a landlord and I'm currently a tenant, so I'm unbiased. The plaintiff had a lot of nerve to bring this to court. She deserved nothing back.

actually the tenant could have held out and not moved out until she was offered more than just her deposit plus 1000 . here in california if tenants have to move out because sale or demolition of property then the tenant can be entitled to 5000 to 9000 dollars . i once was paid 4000 dollars just to move out of a single bachelor apartment because it was sold and i did not want to move out for just 2000 so we negotiated for 4000 .

whenever a landlord offers u 1000 plus your deposit to leave , its because they want u to leave before u find out how much the law actually entitles u to if they are evicting u because of selling the property . this plaintiff could have been legally entitled to close to 10 grand .

The tenant was absolutely wrong to leave any of her belongings behind and expecting the landlords to get rid of it for her REGARDLESS OF USING A PORTION OF HER SECURITY…. people need to be more RESPONSIBLE point blank period.

they gave her 2 months lead time during a pandemic, if she didn't find a place it would have wound up there anyway if she wound up homeless. 2 months is a ridiculous amt of time to give a tenant notice when they're selling the whole property.

This case right here just proves that people even when offered something great, will not appreciate it. They went far and wide for her yet she sues them. Then tries to sue for the money they promised after she failed to comply. SMH 🤦‍♀️

they let her know after they were approaching going under contract, that's a dirtbag thing to do. she should have been notified the second that property hit the MLS to be advertised as for sale, but they didn't do that, they waited until the last minute then cried that the sale didn't go through because their tenant couldn't find an apt fast enough., bunch of BS if I've ever seen it. In other states she'd have the right to sue them in upwards of 5 grand for a stunt like that

the good deed of not letting her know the property was listed in the MLS & waiting until they were approaching contract signing...yeah real upstanding people. in other states they have laws against garbage like that

@@Anglynn74 My mother always told me listening is key. She was given a 60 day notice and they have no obligation to inform her of their desire to sale their property. She is a tenant who has no financial interest in their home.

@@ebonyswope chances are they never sold the house & got another tenant in there & charged the new tenant a higher rent amount. that's a tactic many are pulling today. they're either claiming the place was sold, or that they'll be foreclosed on or ending leases to get the tenant out, they then get someone else in & charge triple the old price. it's going on all over right now in numerous states.

If the plaintiff didn't get any money it would have been fine. She left all her furniture in a house they were trying to sale. I feel like she shouldn't have gotten anything.

Right … she would have come out better if she took the deal! I stayed in a hotel for 6months after moving to a new state.. 3,000 would have put her in a better position!

And that plaintiff had a lot of gall suing for the extra $1000 she was supposed to get if she moved out by the end of October! What a large amount of gall. If the defendants would have crossed sued her for the loss of the contract, if it was just because she wouldn't move out, and they could prove that, she would have been paying them, not the other way around.

The defendants were actually really nice to her with the 60 days notice plus the $1000 incentive and end up not getting their apartment sold plus having to give back $1000 deposit even though she overstayed her time. I’d be so mad! Situations like these cause people to no longer be nice/lenient with people in the future

they never notified her the property was listed for sale, then waited until the last minute then complained she wasn't fast enough. nothing nice about that. Not to mention this is a tactic to get the tenant out of the house, they weren't selling, just getting her out to get someone new in there to raise the rental price.

I had to leave my house of 17 years & had no choice but to leave an enormous amount of things behind. Bureaus, tables, hutches, etc etc. Whatever I was not able to fit into storage I had to either leave or break it up & leave it outside for garbage. Myself, my husband & my 14 yr old were made to leave during the pandemic (an eviction was filed 2 weeks after lockdown began) , could not find an apt to rent therefore we stored some items inside a storage unit & the rest had to stay begrudgingly, a lot of it was part of 22 yrs of marriage worth of furniture & memories, some my mother's antiques . We wound up living out of hotels while seeking a place to rent, whatever we could fit inside the car went with us. That's why some might leave their "shit" behind, because some people don't care & just need to have people out at a time when people are dying from a virus. I also was not a renter, I bought that house in 2004. Go figure.

The landlord going month to month tells me they gave her notice long before that their intention was to sell they house. They were too nice to her. This proves you can’t feel bad for people.

That tenant should have to pay for December rent (or lose that 1k) as her furniture "Lived" there and the defendant lost a sale because of this. The judge screwed the defendants big time.

As someone who just purchased a house who had tenants who did not want to leave, i have no sympathy for this plaintiff. It’s truly a nightmare and it dragged my closing date by over a month and the former owner did the same thing- gave them incentive and free month rent and 3 month notice and they stilllll made it hard for me to get in there. If you don’t want to leave just buy the house!!! Those defendants did nothing wrong and gave her a lot of leeway. Smh

Dear Lady, It doesn’t matter that you were a tenant for 13 years. Your lease was month to month and you weren’t entitled to more than 30 days notice, which they gave you. You proceeded to take another two months to move out, which costed them the sale of their house. Then you left your belongings in their home for them to remove. And then you have the nerve to sue them 😳😑 seriously? They shouldn’t have been so passive in dealing with you when you weren’t out by October 15! You’re lucky you didn’t have a callous landlord who would’ve happily put an eviction on your record when you remained or charged you rent in December plus the cleanup fee! I know you thought that was your home because you’d been there so long but that was not your home. There was nothing amicable about what you did. While it would have been courteous for them to give a heads up that they were going to sell, they weren’t obligated to do so. It’s their home. The clue should’ve been moving to a month to month tenancy after having yearly contracts. Not necessarily that they were going to put the house on the market but that you needed to be ready for anything. M2M = uncertainty. Period.

the landlord inconvenienced her by not notifying their 13 yr tenant that the property was listed in the MLS, they waited until they were approaching contract signing - so they claim. Sounds more like the switch going on right now, landlord claims the property is being sold to get tenant out, tenant leaves & landlord never sells & instead lists the apt for a higher price & charges the new tenant double the previous rent. new game they're all playing right now. explains why they suddenly "lost the contract". no buyer is going to pull out just because the old tenant is still living there, new buyer has a leg up & can evict her quite easily if needed. Whole thing is a song & dance by the landlord. also why they were upset her furniture was still there, they wanted to rent it out clean.

Maybe she should have bought her own property within those13 years of living as a tenant in someone else's property. She shouldn't be salty because they want to sell their property and the new owner wants her to vacate🙄🤦🏾‍♂️

I don't get it- if this is a month-to-month lease, how was the tenant entitled to stay there beyond mid October?! She unlawfully, occupied the apartment for 2 additional months! Additionally, the landlords lost the contract with the new tenant-which translates into loss of money for the landlord! Finally, she dealt with the tenants belongings until the end of December and had to pay for the dumpster. This is clearly a wrong judgement. Although the landlord states that she would deduct money for moving expenses, which by the way, is a time consuming proposition, the extra expense for the dumpster and the additional two months that the tenant overstayed her time was not addressed at all!

Now Judge, this is the first time I have really disagreed with your ruling. To be honest I thought they were saying, we’d give you the rest of the security deposit minus the cost it took to remove the furniture which was what, $650? It wasn’t their fault it was the holidays and people were booked. Then she took 60 days. Wasn’t their fault either. But I guess the text was enough evidence. 🤷🏾‍♀️

the tenant was out of her mind, asking for the money she didn't deserve, and then full deposit when she knew very well she had to pay for her junk removal. She should be ashamed. Then, we have the judge returning only $1000 of her security deposit, why? Those money should have been in a bank account, 13 years as we know, then returned with the interest was accumulated for those 13 years.

Security deposit does not acrue interest. It is put into an account that the deposit is kept in. Best learn if you ever rent a house or apartment.

I think the defendants deserve to keep December rent, her stuff was left behind so the space was not available for rent on December 1st. She just didn't want to pay for a mover so she thought she'd make it someone else's problem.

Defendants didn't realize that a deal is a deal and they can't then retain the $1,000 they negotiated to return. (And I'm surprised they didn't try to ding the plaintiff the full $1,650 rent PLUS the $650 they were entitled to keep under their deal.)

The landlords not only gave her 60 days notice which is an extra months notice more than they are legally required to do they also offered her $1000 for the inconvenience and FULL security deposit. The plaintiff has absolutely no leg to stand on in court smh.

The plaintiff was not owed anything, and would have had to pay $600 to the defendants. Except the defendants blabbered and said they will return to her $1000 . The $1600 deposit would have gone to cover December’s rent, If someone is going to stay in a place that long, they should make arrangements to be in a place that they are paying for ownership.

The tenant was ridiculous and def entitled. I rented out my parents’ house at way below market rent, as the tenants were having rough financial times. Raised rent ONCE (a small amount) over eight years. Needed to sell house and paid them $3000.00 if they would move out in a month and a half. They did, but left behind a mess. Their dogs (which they were not supposed to have under conditions of their lease) not only destroyed the carpet, but damaged the sub flooring with urine. I will never be so tolerant and accommodating with a tenant again. Too bad that the few obnoxious people wreck it for the good ones.

When you live in someone's house and you don't have a lease. Then you're a month to month tenant. The plaintiff didn't even move out when she was suppose to. Destroyed their house. Now, she's coming to court wanting money ? Is she crazy ? She's lucky she got the 1000 bucks.

Anyone else notice how all judges say “in any event “ all the time. They all say it in every case and the litigants always say “it is what it is” at the end of the case, usually in the hallway with Doug.

I refuse to let people like this tenant stop me from helping people. Are you seriously going to let people like this go unchecked? Call them out! These landlords did not deserve this, and the tenant showed the world who she really is as a person - she really believed she was in the right, lol.

I constantly hear all the time tenants bitching they are being left homeless due to LL selling the house or they cannot afford to pay higher rent. It is not their home. If they want to make the rules they buy a place. Too bad so sad, the defendants were reasonable with her and she refused to be reasonable. The plaintiff should have received ZERO.

13 years of occupancy doesn't allow for unrealistic expectations. The landlord went above and beyond legal requirements. 60 days notice, only 30 required, $1K move out bonus. 🤔

Defendant didn't text she would send any specific amount. She said she would deduct it from security and send whatever is left. She had other deductions obviously. It's tough to get a place back up to par after someone like that moves out. I sympathize with the defendants.

13 years landlords should know that they need to return some if not all the security deposit, especially if the landlords ask you to leave b4 you decide to give them a 30 day notice.

I’m wondering if the plaintiff knew that the house was on the market before it was sold, and if so how long she knew…. Because maybe she had more than the 60 days to get her sh*t together. But with that said 60 days is more than enough time. I guess the plaintiff thought that since she got all new furniture for her new place she’d make her old furniture someone else’s problem. This is what leaving “amicably” means to the plaintiff. The gall is unreal, much?

@@adrianprince7266 im not saying that there arn't bad situations in the world but I do believe our view of the world is skewed by how much negative stuff we see on a regular basis versus what our memories remember. it's a similar concept as when someone says they don't make good music any more. you could argue that there is just as much bad music as there was before but we live in the present so the bad music is still in our minds. where as when we think back to the past we only think of the music we loved and the bad music gets forgotten. so if we were to compare catalogs based on memory the pasts best against the presents average. in other words the i don't think the world isn't any worse off now then it was before we can just access the bad stuff of the present that makes the past seem better..

They lost the sale of their home because of her! I would be fuming 🤬 Her living there for 13 years doesn't mean crap. No one cares!! She was given plenty of notice and I really don't understand why she feels the defendants owe her. 🤷🏼‍♀️ And if she didn't have somewhere to live then that's on her, no one else. The defendants shouldn't have to deal with those repercussions while she continued to live in their home. Then she leaves a bunch of crusty furniture in their home and makes it their problem?! The audacity of some people just blows my mind 🤣🙈 I'm surprised the Judge gave her anything at all.
