Tanong lg po mgkano po ba interest sa sinanlang lupa ( CLOA) sinanla kc ng kapatid nmin ang lupa ng Parents nmin na hindi nmin alam lahat, ngayn po gusto kng tubusin kaso lg po ang laki ng singil ng interest ng pinagsanlaan. Sinanla ng kapatid ko 30k after 5 mos pinatubos ko kaya lg siningil kami ng 107k ng pinagsanlaan tama ba un Atty? Sana po masgot mo ako. Maraming salamat God bless u Atty.!

Kung sa BATAS Po EQUAL PARTITION among Heirs upon the death ,of 1Parent or both, named in Title so all ATTY should always do that computation of partition! ksi SUCCESSION or manahan or INHERITANCE n so automatically IMPLEMENTING the LAW as it is! Good day po atty, pa singit narin po kasi donation narin naman po ang topic, pa clarify narin po yung mortis causa, saka pano po kung EJS from Great GrandFather to Great grandchildren kailangan pa po ba bangitin sa EJS yung generations na namatay, i.e. great grandfather ->grandparents ->parents-> adjudicatees(great grandchildren) or since meron pong amnesty e pwede ng direct na po, from great grandfather(owner ng lupa) to the great grandchildren na taga pag mana. salamat po, sana po mapansin agad

Atty. may tanong po ako, yun title po ng lolo ko ay nawala sa Registry of Deeds, nag file kami reconstitution sa RTC, sa owners copy ay incumbrances yun title, na naisanla lolo KO noong 1940 sa halagang 180 pesos, pero natubos na ng lolo ko at hindi naalis sa title yun mortgage, ng mag file kami ng petition for reconstitution nakita ng Judge yun mortgage sa title, pwedi ba kami mag file ng cancelation of mortgage sa RTC, thanks po Atty.

Good day, Atty. Salamat po, marami po akong natutunan sa mga lecture nyo. Nagkaroon na po kami ng previous ejs na inayos po ng panganay namin. 2.2has. each po ang naging partihan, except po sa bunso namin na 1.6has. lang. After how many hrs, nalaman namin na meron pa palang property na hindi naisama sa partition dahil sinasaka at inaangkin ng panganay namin dahil binili daw nya ito, in fact, tinubos lang pala nya ito sa bangko using the Spa na ginamit nya sa Ejs. Pwede po ba namin habulin ito para sa partition at pwede po bang kunin dito ang .6has. share na kakulangan ng isa, magbabayad ba ng donors tax para .6has? Salamat po sa kasagutan.

Good morning Atty. thank you for your lecture very educational. I have this case, I bought a paraphernal property and executed deed of sell with the owner, however, I was not able to register or transfer the land in my name due to Covid19 until the owner died. We executed EJS with her Heirs but when I went to the BIR, I was told to pay the Estate tax for all the properties mentioned in the EJS and donation tax for the property I bought. I asked the heirs to pay the Estate tax but they have no means to pay it because they don't have regular income or simply they cannot afford as it is too much. What is the best thing to do? Can i use the Deed of Sell signed by the owner to transfer the lot in my name and pay the penalty for late registration? I bought the property in 2021 and the owner died in 2022. Thank you and looking forward for you advice.

Out of topic po ang question ko. Nakuha po namin ang unit noong 2022 sa developer. This year, sinisingil.po kami ng developer ng amilyar which dates from 2016. Hindi pa ho naka transfer ang title sa name namin. Liable po ba kami to pay the amilyar from 2016 to present? Or from 2022 to present lang?

Good am. Paano po ang computation ng bayarin sa Donors tax kapag both parents ay buhay pa. Na subdivide na po ang property sa 4 anak 50 sqm, 42 sqm, 56 sqm, 29 sqm ng geodetic engineer year 2021, may kanya kanyang bayarin na po sa real property sa munisipyo. Hindi pa po namin maprocess ang papeles baka po sobrang mahal. Pwede po ba na hindi sabay sabay ang pagbayad sa transfer like mauna na yong may budget. 5 po kaming magkapatid pero sa 4 lang hinati ang nasa Taguig kc po ang binigay sa isa ay yong sa ibang lugar Laguna 62 sqm at nailipat na po ito sa isa kong kapatid. hello sir, good day po.... tanong ko po... namatay na po and father ko, buhay pa po mother ko.... pwede po bang diretso na lang ibenta ni mother ko yung H&L na naka-pangalan sa father ko ("married to" ang naka-lagay sa titulo ang mother ko)? hindi na po gagawa ng EJS?? diretso na Deed of Absolute ang gagawin ng mother ko to the buyer..... wala naman pong objection kaming mga anak sa pag-benta..... tnx po sa inyo...
