The US Department of Transportation has said that Emirates has been fined $1.8 million for not following the country’s protocols of staying above a certain limit in altitude while flying over Iraq for flights to the US.
The fine applies to flights operated between December 2021 and August 2022 that flew over Iraq on their way to the United States. For safety reasons, the Federal Aviation Administration (FAA) doesn’t allow US airlines to fly over Iraq under 32,000 feet. No, Emirates is NOT a US airline, but can you guess why the rules were applied to the Dubai carrier?

Pilots have the right to refuse ATC instructions deemed unsafe. This is most commonly applied to "land and hold short" clearances, but the captain should've gotten on the radio and said "unable - due to safety reasons, request FL320 or higher or new route". The captain could've done this, but didn't. Hence the fine.

One word: "unable". They can tell ATC they are not able to do so and ATC can adapt.

In cases like this one the pilot could say unable and that they require FL320 or higher

So what if they were at maximum zero fuel weight and close to maximum takeoff weight? They would have to stay at 28,000 feet or 29,000 feet at first.

What I would like to know is why FL32? Ground to air missiles? FL33 OK? And why not fine ATC who instructed FL32 or below? Are they not the ones giving instructions to pilots? Or are pilots to go rogue because of this FL32 directive? The whole thing sounds like it came out of some bureaucratic desk.

Iraq has been at war since 2003. There are many surface to air missiles all over Iraq due to the chaos and defeat of the Iraqi army and the raiding of Iraqi arms depots by ISIS, other armed militias and others. What could go wrong?

Emirates scheduled 122 flight in the offending period and violated minimum 32,000 feet flight level 122 times Ie every single scheduled flight

The FAA oughta sort out their own house and processes before they comment on international carriers, even if it’s a codeshare agreement. I suppose, when it comes to the U.S. they’ll do everything they can to bleed money out of anything.

Armchair pilot here. IMO pilots should've refused to enter the airspace of the country in question without first being given clearance above FL320, citing the regulation. Caveat - Regulation may not be at the forefront of the pilots' minds when regulation-violating instructions were received. Either way, I blame the controllers for failing to give Emirates pilots the altitude clearance they needed to comply with regs
