Thanks for all the info you are providing. Just got 100% P&T TDIU after HLR informal conference. No lawyers, no vocational experts, just good medical evidence from private doctors and a good C&P exam. My VSO submitted the proper forms and that was about it.

I called the va and got my va code info emailed to me which was nice. Not all operator callers will do it. I would just call again and ask.

My RFE was done 15 years after the initial award, so needless to say, it took me by surprise. Either way, it worked in my favor as I was awarded an increase and it went static at that point.

For me when I am speaking especially to our younger veterans I Harp on them to 1) get in the VA health care system 2) get in a primary care provider group 3) make at minimum annual check ups 4) at these annual check ups talk about your Service Connected illnesses and injuries. Be frank and open have they improved have they gotten worse what medications seem to work and those that no longer work. I had a VA scheduled reevaluation and since I was not using the systems I was down graded. Once I showed my civil doctors records I was promptly given it back with back pay. The VA did a records review only I never seen a Provider. This was 2003 I believe.

Just so you all know… best way to ensure you get an actual copy of this info is with the FOIA request. 99% of VSOs will NOT print from VBMS. Also, going to a regional office will most likely lead to them having you fill out an FOIA anyways.

I filled out a FOIA from my regional office and got my updated sheet the same day. I hear they don't do this anymore.

C-File takes forever but if the veteran just wants their RCS or completed DBQ or whatever else…the RO is the fastest way. - Clay

I just spoke with a veteran that went to the Baltimore Regional Office to get their Code Sheet and they were told to "Please fill out an FOIA request and we will process it and it should arrive in a few months. We do not provide that information at this office." Also, can you point to a resource that lists the Regional Office phone numbers (as you said to call in this video) because EVERY place that can be searched just lists the 1-800 general number. Thanks!

My decision letter does not mention static or not. It also does not mention further exams any where. I can make an appointment 3 months out at the Hampton regional office or simply file FOIA.. Or try y luck at a walk in, which I may do once just to see… You mentioned your decision sheet tells you but order a rating sheet if you like - I just don’t see it.

I called the VA Regional Office in my state and asked whether the conditions were static or not, and she told me over the phone. Not sure if all offices will do that or not but this one did

I believe that the VA benefits web page should provide all Vets the ability to download our C-file directly to our computer. Why should a VSO or attorney have access to our data but we do not. It is another delay tactic (~6 months) making it more difficult to file additional claims, in spite of a ITF. If we all submit this with your position to your legislators we could influence their support to direct the VBA to make this happen.

I requested my c file in September and they closed my foiaa request a month ago but I never received a letter or my disk. i called 800 to ask what status was. now va opened a new foiaa request! hopefully not a long wait....

My letter I received with my initial ratings showed the rating code for each of my rated disabilities. Is this not normal? Or is the c- file just different in showing the static non static ratings?

I just checked my original award letter from 7-8-2011 and the only thing it states is "An examination will be scheduled at a future date to evaluate the severity of your service connected xxxxxxx" I've been seeing my VA provider regularly since then and have never had a re-eval. If I'm understanding correctly, I won't because it's been nearly 14 years?

The dates on the code sheet is good to know also before submitting a ratings increase. So you known when your 5 years is up.

What about letters you can get from myVAhealth ? I was at 100 7 years ago and the letter would state 100%. After a new evaluation 3 years ago the same letter now states 100% Total and permanent.

I’m in Indiana and my VSO did print my code sheet for me but he did ask me why I wanted it which I thought was more weird. 🤷‍♂️

None of my static ratings have anything on the letters. I don't think he's correct on that statement. You have to call or FOIA to find out the status.

Let me ask you this. I went up to 90% for PTSD and headaches about a year ago and I'm 57 years old. Am I going to need another examination in 5 years or since I'm over the age of 55, or am I safe from having another examination? Thank you for all you do for the veterans.

The VA's 55-year-old rule protects veterans' disability ratings from being reduced after they turn 55. This means that veterans are no longer required to attend periodic Compensation and Pension (C&P) examinations to prove their condition hasn't changed, unless there's reason to suspect fraud.

Hello Clay. I have printed all my service treatment records put them in dividers inside a 3 ring binder. It has everything I was getting seen for, diagnosis and physical therapy. So what if i do not have a diagnosis for some things but have complaint for it is that valid for evidence, for examples i was having sinus issues went to the clinic they gave me medications and put Allergic Rhinitis but was not listed as a diagnosis. Also how soon can you file a claim for PT if your conditions are static.

Your documented symptoms from service are SOLID evidence and will suffice as the in-service event. You will need a current dx and other than that…VERY strong claim. - Clay

So the static conditions just have to be 95% to get to 100 P&T? I thought the static had to get to 100% or over the 100% mark. Thank you for all you do.

Damn i just realized im not 100% p&t. Im 80% rated , and I recently submitted a claim for sleep apnea which i was diagnosed with in October. Hopefully that takes me to 100% pt

I just checked my letters. Not a single one of them says whether the condition is static or not. Calling and asking or FOIA is the only way to find out.

KEY ISSUE: QUIT DEPENDING ON THE VA FOR A CHECK! BUILD YOUR IWN HUSTLE WITH THAT VA MONEY. I got denied a 100% based off my income which I found was illegal.
