I've never heard of an offer not being presented. I thought by law realtors had to present all offers. They do in NC. Let the seller determine the best offer. WOW

Jerry NO ONE is giving the information I just received in your free starter kit. I am honestly blown away by what I just read. Utilizing the agent double representing you and the seller is a great strategy I’ve used more than once, often times it’ll save the seller money on commissions giving them a little more flexibility on the price.

I am a Realtor. Most agents will accept a slightly lower commission if they are getting commission from both sides versus getting only 2.5 to 3 percent one side.

Well right now you have to be careful when you have tenants that you want out. In some states the courthouse is not even open to even take them to court to get them evicted.

Not sure what the complication is. Agents are required to present all written offers to the seller. Also price is not the only factor to consider terms also are important such as cash and a quick close for example might be worth the seller coming down a bit on price.

Love you’re case vids!! This is what I would’ve done here - Once realizing that the listing agent would not budge and that there would be no real benefit to using that agent and after getting him to disclose the ballpark for a competitive offer, I would’ve said “Okay, thank you. Let me know if anything changes. Bye”. Then I would contact an agent I like working with and have him/her write up my offer under a Wholesale Trust, keeping my personal name anonymous by using a nominee trustee. Works like a charm! 😉

@@amp7816 a wholesale trust? I've not heard that term before. Is that the same as a Land Trust? If so, I never knew that one could make offers using a land trust that are listed on the MLS. Can you shed some more light on that; or is it really just as simple as doing it in a land trust with an off market deal?

Keith Mace The WT - similar to a LT but modified for an investor. It is a legal Trust document put together buy a team of RE attorneys that are also investors. I use to structure all my offers. Once I have a property under contract, I’ll initially look to wholesale it but will inform the investor that if they don’t buy it, I will be closing on it myself. I primarily prefer to flip houses I acquire either to myself or another buyer and this document gives me the liberty to keep or wholesale w ease and without the seller knowing what’s taking place behind the curtains. I’ve used it on REOs where lenders place a restriction of “primary owner only”. In which case I am the only investor competing against traditional home buyers.

Not sure what the laws are in cali, but here in NYC, we are legally obligated to present all offers no matter how crazy it is. At the end of the day we work for the seller and they decide. Not us

The agent is unmotivated, but in this case he is probably right. Probate doesn't automatically mean that the sellers are in a rush, and you both know someone will pay more for the property. You are basically asking him to take more commission to take a lower offer lol.

I'm an agent in the LA/OC market... As an agent, I agree with this method. But it is also my duty to act in the best interest of the party or parties I represent, whether dual agency or not. Being able to double-end a commission is not in my best interest if the end result doesn't present the best outcome for both the buyer and the seller. For me this a relationship business and that's how an agent ruins relationships. The agent on the phone didn't do that well at expressing that, but I'm pretty sure that why he was as standoff-ish as he was.

Just because an offer is low doesn't mean it's not in the best interest of the seller. If that means they can sell faster, have zero closing costs, and not have to have it sit in the market for months. Some agents just simply don't get how investing works or wholesaling so they don't want to present offers because they think their commission will be lower. How is that acting in the best interest of the seller?

Overpriced offer or low ball offer doesn't matter, my point was I'd rather do what's in the best interest of my client than trying to present a property just because it offers me more commission or a dual agency. As an agent, you have to present every offer. but I WILL NEVER try to position a property to my client just because of dual agency or a commission bump. I'll present it the same as I would every offer and let them make an informed decision

Unfortunately some agents won't do it. If they don't like the offer they won't present it. I've told them that at the end of the day whether they like the offer or not , they should still present it because you don't know what that seller would say. They might agree to it.

Jerry I love the content best in the game you flipping genius.!!! When you send in your offers with agents and sellers or even a wholesaler on a property do you put that in writing and which contract sheet do you use. Is it the same contract whether I want to fix and flip myself or wholesale or are there different contracts? Thanks a million

Jerry What would you do if your buying a property on market and the buyer wants to use his preferred title company that doesn’t do assignments? Can I double close in a different day? So the realtor doesn’t know?
