The plaintiff hired the defendant as a D.J. and an M.C. for her daughter’s birthday. The photo booth he brought was defective, so the plaintiff is suing for a refund. The defendant argues two of the plaintiff’s guests damaged the photo booth, and it worked just fine at the beginning of the party.

Judge Milan seems to not understand that taking a day off of work to testify as a witness is a huge deal for a lot of people. Missing a day of work can be the difference in you being able to pay your rent that month. Or can cause financial strain.

An employee is entitled to paid time off without charge to leave for service as a juror or witness. So that’s not a good enough excuse. The witness didn’t want to be there because the defendant thinks his lies would be stronger coming from just himself than have someone fumble the case on his behalf

@@M2161 i think you’re misinformed, not all employees receive paid time off for jury duty. Maybe your employer pays. But mine in California does not. And the stipend for jury duty is like $15-20 PER DAY. So I’m not sure where you’re getting that “entitled” from.

In this case I feel the defendant wasn't given the opportunity to fairly plead his side. The plantiff could have got the photos once printed and gave them to the guests.

The defendant should have picked up the photos and given them to the woman, if he knew they had printed after all of that chaos. Not expect her to know that after everything was broken, to now go back over to the printer and see if your photos are there. He didn't do that and that added to his loss. The defendant just does the minimum, which is fine, if all goes well. You can tell he is not big on customer service.

@@simonc1039 every judge has talking over people, interrupted people and yelled at them. She said something to both of them for not having their statements notarized. She even interrupted with the plaintiffs how she acted in. This case is nothing new. If the Ma home took the pictures and it was present at the party when they packed up the mother could’ve gotten them. They were brought to court instead.

The judge got emotional and stopped listening, he clearly said the pictures printed out and were sitting on the printer but all she heard was the picture were in the computer which is not what he said.

Why isn't he here? He had to go to work.....This is pretty important. He couldn't take the day off?.....um, the day you award lost wages will be the day that someone can afford to guest star on your important TV show. Until then, there's rent, bills, food, child care, medical expenses, etc that are a bit more important than the ego trip of being on a TV show.

I don't know why people keep saying this. You're missing the point of a photobooth. It prints pictures immediately and adds decorations etc to make a souvenir. Something to take away from the event. Of course everyone had mobiles to take pictures and do selfies, that's not the point. Photobooths are hugely popular. Do you go to a wedding and say why do they need a photographer when everyone has a mobile phone and could just take the pictures? of course not. It's something different.

She didn't listen. If the printing of the photos was DELAYED but that once the booth was back up and running and the prints were then made and printed while the party was still happening, then there was only the 1-1.5 hour reduction in use of the booth. JMM was not listening.

The Plaintiff had a letter from someone stating "no one bum touched this man". That is definitely someone writing a letter where they are told what to "say". The Judge was a bit too short tempered with the Defendant and a bit too reliant on un-notarized, obviously made up statements. If she's going to make up her mind about a case while going over the evidence pretrial, she needs to hide it better.

Wow, there have been some cases that I have seen her loose her cool at. But this is by far one of the worse ones. Nobody was being rude but her. She definitely was not listening. The worker was there to work on something else. In the beginning, the plaintiff’s boyfriend states that when the Photo Booth broke down, he had to go tell the worker to go fix the Photo Booth that’s when things get hectic because there was no one else to help handle the other stuff the worker was supposed to do while he was trying to fix the Photo Booth.

I get the defendant saying that the booth DID print out the pictures but if that were really the case, why not give them to her or even bring them to court to prove that they were printed. He lost this case because unlike the plantiff he had no proof of anything! He didn't have the MC with him, he didn't have messages proving it was back up and running, he didn't have the pictures. The reason the judge ruled for the plaintiffs due to the person at the booth not being there for the suit. The defendant is testifying what was told to him which makes it hearsay due to the paperwork not being an actual affidavit. I had to recant what I wrote previously.

I have been to many events with the photo booth and the props. They're fun and are memorable from partying nights.

The defendant lost the case because of the messages. If They were there how come he had them and none of the guest. She even said in the messages she was happy with the DJ but not the outcome with the Photo Booth. Also his own DJ didn’t even state that the pictures were back printing out if this was the case he should’ve just shown her at the party or it could’ve been given to her at the end of the party when they were cleaning up setup instead he had all the pictures for court or some as he said its common sense. Nothing about this was prejudice at all.
