@@sheldonengstrom4415our SCOTUS justices should NOT have a political or religious leaning this is what gets us cases overturned like Roe v Wade. The case was decided with facts, not feelings, but was overturned because of conservative justices fidelity to a fictitious piece of literature.

As a 32 year former juvenile probation ,parole counselor with 15 years of additional supervisory responsibility, I find it quite refreshing that this judge spent the time and effort to review this offenders record so thoroughly. Also to not accept a plea bargain speaks volumes regarding his insight and independent thought regarding his decision. This judge has my respect . Well done your honor.

I hope u were 1 of the good juvenile officers. I had been an abused kid . Extreme. And I kept getting in minor trouble. I got locked up back in 90s in Missouri in juvy for a year. I was 6 ft 1 at 13 . Ppl were at a loss of what to do with me.i only needed heard and guidance. Not locked up. Not ur fault of course. I just delt with alot of selfish corrupt ppl in the juvenile system back then

The judge used this guy's fifth amendment right as a reason to reject the deal now this kid could get away free. I agree that the judge should have rejected the deal but you can't use someone's constitutional rights against them.

@@GradertJ- No, The judge said you only get special consideration for special behavior. That’s like a criminal deserving 20 years in prison, but the prosecutor offered them a plea deal of 10 years, they decide to go to trial and lose and then they demand that they get the 10 years. You don’t get 10 Years anymore, even though you have a right to a trial if you decide to take that chance then you get the regular sentence. You don’t get a discount. It’s not a win-win situation for criminals.

District attorneys are overworked and courts are backlogged which is just one reason a DA will offer a plea deal and so many defendants take plea deals offered when guilty. Sometimes it is because the DA doesn't have time to try all the cases on their docket sometimes they're not 100% sure it'll get a conviction and it's just another notch to show voters their conviction rates when running for office. There are times when someone truly deserves a break and there are times they don't. I'm glad this judge understands this.

A better idea would be to write him a letter/email and include some of the comments or mention this video/link in the letter/email. His staff and or him might like getting a positive letter opposed to what they normally recieve... might just make their day.

As an employee in the Juvenile Justice arena, I thank you for reading the reports from the facility the defendant was in while awaiting trial & considering the information provided on his behavior & blatant refusal to comply with societal & institutional norms/rules that govern everyone for safety & security. Thank you for not being bamboozled by the more recent acts of attending treatment programming (which is already mandatory for all those incarcerated), especially since the motive is not for Rehabilitation but for acknowledgement to persuade a reduction of time sentenced. Thank you for actually reading the charges, the defendant's statements, & recognizing the con he tried to use deflectinghis role in the death of the victim. Thank you for holding the defendant accountable & for requiring his attorney to work & defend their client. Again, well done. Maybe this will prompt the defendant to actually change himself for the positive & keep others from trying to pull this nonsense.

This country needs more judges like this one! He did his homework and made sure people understand why he has come to his decision and has loads of practical experience with the system prior to being a judge from more than one source. He has a good overall rounded education to make the best possible decisions. He does his homework to make sure he isn’t over looking anything. So so many good qualities. We need more people in the justice system like this man!

Before you get the wrong idea, I agree with the judge's decision but, technically, he's been in custody for 4 1/2 years according to the judge. Whatever sentence he does receive, they'll knock those 4+ years off.

He should be spending the next twenty years minimum in prison. A person died during the commission of a crime.. irregardless of the fact the he didn’t fire the “fatal” shot he still fired at the vehicle. And this LAZY POS prosecutor deserves to be in jail with him for even remotely, considering this idea which they thought was acceptable!

This is the sort of crime where a life sentence with the possibility of parole after a set period is appropriate.... Say 15 years (so another 10 and a half minimum in prison, and then subject to being deemed fit for release after that time a lifetime on probation)

@@LJT7907 This happens every day in the US. Like the judge said, it allows the system to work...if everyone went to trial, the system would collapse. Former Officer Chauvin only got 22 1/2 years, and he was actually convicted of murder. I'm not saying he should walk free but, let's not act like this happen to others(Black, white, red or green) all across this country. The problem isn't the prosecutors. Regardless of what the prosecutor recommends, the final decision is up to the judge.

Gosh, it's fantastic to see a Judge that is so bright and articulate and actually put in a lot of time finding out the real facts. Once done he actually thinks of the citizens and tries to protect them. He also explains everything so everyone can comprehend what the reasons for the decisions are. I wish we had 1,000 more judges just like this one.

Not so fast. Now there has to be a trial. And media. And photos. And that all means heartache for the victim's family. It is this reason that families often accept plea bargains, and while we don't know the details here, or the family's reactions, it is nevertheless one of many considerations a prosecutor must account for.

Very well articulated. Plea deals have gotten out of hand…they plead not guilty until they realize how much evidence is stacked against them, then they seek a plea deal because the prosecutor forgets the victims and the families and thinks about the arduous task of processing a long case. So the lawyers seek to give the criminals a slap on the wrist. We need more lawyers and judges like this judge who are not afraid of the court rooms. Bravo…

I agree. However, not JUST education ~ but, experience! I'd venture to say that his experience before he was a judge made him so thorough and effective. Sometimes "book smarts" aren't favorable compared to first-hand experience. ~ for example, probation and parole.

I do not see how a plea deal for probation for a crime such as this was appropriate. I do not care that he was a juvenile when the crime occurred. A person lost his life during the attempted car-jacking He was armed with a gun, The co defendant actually fired the shot that killed the man. He shot as well. So this was a murder (When a death is caused during the commission of a felony it is murder. All involved in the crime are subject to the same charges. So how can anyone make the claim that probation would have been appropriate? I say a minimum of 10 years in the slammer. The DA should be ashamed! The Judge did the correct and morally right thing. Kudos to the judge for not letting this be rubber stamped!

I agree. Left a comment detailing about Judge Burns education and journey. I find the individuals who worked in adjacent “less glamorous” jobs such as a probation officer, have knowledge and understanding of defendants beyond those who do not. Judge Burns began his education at Brown University-Top-10 Ivy League school, so he was obviously accomplished coming out of high school. While working as Probation Officer, earned an MA and his law degree. So, he’s been to one of the most elite Universities in this country, then worked full-time in an often thankless role while gritting out his advanced education. I was born and still live in his district and I am so pleased we have jurists like Judge Michael Burns. (And…as Minnesota is basically “Canada South”-if trump wins again we will secede to the north, thank you!-I feel great kinship with you and my “Canadian Family.”

The crime they committed meets every requirement for them to be charged with first degree murder, BUT there’s people in that courtroom that agreed to 5 years of supervised probation. If it was my family member that was murdered I would definitely ask that judge to grant him the probation, & I bet you know why.

The judge did good job. Read all the pieces to make a fair decision. The DA agreeing to this plea is going to cost them the next election. The conflicting reports were enough to stop this deal before it got to the judge.

I suspect he is unafraid because he has extensive pre-judicial experience, and has extensive experience on the bench of having given compassion in past cases. He knows balance, fairness, perspective, and that this case does not provide the elements and factors to warrant the same mitigation as others he has previously adjudicated.

@@strummercash5601 yeah I don't think the improper use of societies is gonna change the context or make you safer now.. I just think since my dads murder .. if the man who beat him was kept locked up for prior offenses of the same ((assault robbery criminal mischief etc)) he wouldn't have been on the streets to kill my dad .. I hope you are safer ..I'm sorry for anyone's loss.. this way ..

@gemmalocatelli5916 Oh dear. I was having a sad day before, but hearing about your father, I feel further gutted. I am SO sorry and sad for his loss. As per text-speak, misspellings, and malapropos, I must admit, I am the son of an English prof. Mother who corrected me (fairly kindly) in public much to my chagrin. I followed in her wake and earned an MFA in creative writing. I WAS a member of the Grammar-Nazis. However, after an intervention and some years under my belt in G.N.A. (Grammar Nazis Anonymous, not to be confused with our siblings in Gambler’s Anonymous-G.A. nor the state of Georgia) I’m doing really well! My Havi sidekick, Honeybear, and I, just got word his lady-love, Angel, who was expecting, lost their puppies and is in emergency surgery including her spaying. We were to get a little one for HB’s effort. So, I’ve just gone from puppy-proofing our apartment to… I had already planned an Epson salt bath. Now hearing of and sharing in your greater paternal grief, I’m adding some now-legal weed and a cold Modelo to the soak. Again, I am so sorry for your loss, appreciate your sharing. Wow! I didn’t know this kind of Judge even existed in America today. Maybe there is still hope for the rule of law and the prevalence of justice.

I know right! Kind of sickening to read all these comments. Have great to judge is. I agree with you that boy was black and he would have Friday.
