Social Security disability judges are turning more and more to the grid rules to evaluate claims filed by disability applicants over the age of 50.
My experience has been that disability judges prefer to use the grid rules when approving cases because these guidelines are much less subjective than relying on the listings or making a decision based on reduced functional capacity. If you are applying for SSDI over 50 or SSDi over 55, you have an advantage.
Social Security uses a bizarre system whereby the judge who tried your case does not actually write the decision that is issued. Instead, after the judge hears your claim, he/she sends your file and his/her notes to a decision writer located in a remote location. The decision writer, who may or may not be a licensed attorney, drafts a decision and returns it to the judge for review.
Because the decision writers do not actually observe your hearing, they have to draft a decision based on screen after screen of medical evidence, the judge’s notes and their own interpretation about what occurred at your hearing.
Judges are under tremendous pressure from Washington, D.C. to release decisions so mistakes by the decision writers are held against the judges. The grid rules do not require nearly as much interpretation so there is less opportunity for the decision writer to misunderstand what the judge was thinking. Thus, my experience has been that judges will use the grid rules to approve cases for deserving claimants over the age of 50.
I therefore make my grid rule arguments first in these cases.
