The plaintiff says he was sitting in his mint Buick when the defendant lost control of his lawn equipment trailer and damaged the plaintiff’s car. The defendant and his boss refuse to pay for it, so he’s suing. The defendant says the plaintiff stopped his car in the middle of the road and caused a safety issue. They deny owing anything.

I think he lied. the defendant was on the wrong side of the road, and knew he was in the wrong His boss knew it too! The moving vehicle hit the non moving vehicle, weather it appeared to stick out a little the pictures showed there was quite a large open area.

Judge was wrong. Plaintiff was in a dangerous area, stopping on a curve and partially in traffic. The Plaintiff should have lost.

Totally agree. I like JM and she's on it most of the time, but why she couldn't grasp that you CAN pull over and still be crooked impeding traffic if you're not paying attention blows my mind.

Idk, road looked kinda wide to me. Also, what if they were just passing each other going opposite directions. The young man seemed to have plenty of room to miss with the truck. He should have watched the trailer if if was that close.

Where did you get your law degree? lol You can't just hit something because it is parked where you don't think that it belongs. You're also expected to maintain proper following distance.

The defendant said he had moved it, multiple times before the boss chimed in. If she wasn't screaming over his testimony, she would have heard him.

It doesn't change a thing. The defendant struck a stationary vehicle that was clearly visible and on it's side of the road.

I disagree with the judge. Plaintiff was partially in the street he is liable for his own damages. The pictures were taken after the plaintiff moved his car. The judge was too busy "flapping her gums" to hear the young man say that. Smh like the officer said he was impeding traffic.

A poorly parked or even illegally parked car doesn't allow someone to hit it. The kid didn't account for the trailer and cut the corner too tight, it happens very often.

@@deannadhunter If it had been in the defendant's lane, maybe one could push for shared responsibility. It was completely in the plaintiff's lane, the defendant left his lane so being poorly and/or illegally parked is no excuse. Had the plaintiff been driving in the same place instead of parked they would have likely collided, possibly with more damage.

The boss didn’t coach the teen. The teen had already said that the photo was taken after the plaintiff had moved up a bit.

As a professional driver you wouldn’t be driving fast enough around a bend to where you couldn’t stop when you seen a vehicle in the middle of the street. Nothing confusing about it

She does not listen 🤦🏾‍♀️ the defendant was very clear in his descriptions and twice she claimed he didn’t say what he clearly said. How do you know more than the officers who arrived on the scene? She shushed the owner cuz he wasn’t there, then proceeded to speculate how the accident occurred herself 😑

I agree with everyone here. She ruled wrong with this one. The young man already said the pic was taken after the car was moved up. She felt a way because the business owner put in his two cents. Her “reasoning” sounded almost personal. Weird

That's not exactly uncommon for her. She seems to miss or forget important parts of the testimony. We see it here and in several cases where she asks questions that have already been answered, someone twice. That and asking a question then shouting over the answer two words into it. There have been several cases where I've heard what I believe important testimony but just barely because she interrupts and starts yelling as they're explaining their case. She never acknowledges what they said so I can only assume she doesn't hear then over, to use her own words, her flapping gums.

This is a head-scratcher on JM's verdict; that said, the calm, accountable defendant handled himself well. Plaintiff, a bit whiney and behaved as if his actions played no part 🤷

I had to watch the entire case. I think she should have split the amount of 2900 between the defendant and plaintiff. The plaintiff was sitting in a dangerous spot and the police report stated he was impeding traffic. On the other side, the defendant did his his car. The car was not moving and the truck was. They both shared some responsibility.

Her rulings are starting to seem more from a personal stand point then what the law actually says because if he wasn’t stopped there illegally his car wouldn’t have gotten hit !

The defendant reminds me of our son, he worked for a landscaping company for a couple summers post high school graduation, brought back some great memories! The parents of the defendant should be proud, what a well composed, respectful young man.

On a narrow street it is so easy to be parked in the middle of street or the other side of the street while dropping someone off. See it all the time here, especially when doing a delivery.

Quarter pounder. Passener. Estabmamen. Sorry, my dude, but you could learn from this 17 year old. I have a lot of respect for young adults who work hard- and yard work is a ton of work. Even if it's his fault according to this, sh* happens, it'll be okay. He'll be extra careful in the future and that's never bad! I'd be proud of him if he were my boy.

Before the defendant handed the pics on the phone over and before his boss spoke, he said “in these pics we had moved up a little” and because she didn’t hear him she yelled at him and the boss when it was her mistake. She actually does that alot

in Ont Canada, a car isn't a classic til it's a minimum of 20 yrs old. It can be in mint condition, but it needs to wait a bit before it's a classic. I want to see pix of the bend and where the plaintiff was parked.

I wish this young man the best life has to offer. He conducted himself so well. I bet his parents are very proud of him. I feel it's the plaintiffs fault because he WAS IN THE STREET. In the pictures you can kind of see the car angled in the street. She was wrong with this one. So now that poor kid has to pay almost 3000 dollars. Ridiculous. 😮‍💨

How do you figure that? All the pictures show the car parked on the right side and enough room to pass on his left. The fact remains the truck hit a stationary car. This shouldn't have even come to court.

Ignore all of that. If something is in your path you stop or slow until you can safely move on. Let's say it wasn't Papa Buick's car, it was an ambulance or police car attending a call or loading a patient. Have a blessed week.

@@bridgetts4767 You can't just run into a stationary car and not expect to pay for the damage. If you looked at the picture the man would have had to park his car all the way across the street vertically to block the other side. The kid was lying. it was very clear.

@@bridgetts4767 Also, look at the damage. The trailer was scraped along the side of the car so it was not at such an angle as to cause damage in one spot. The two vehicle were basically facing the same way at the same angles.

I wouldn't necessarily say that, at least not with every 17yr. My son has been driving since he was 15 when he was 16 he started to take his grandfather's trailer to the dump when it needed to go. He is now 19 and he has proven he is responsible enough to drive with a boat trailer to launch it when we go to the lake. I think it depends on the kids maturity and driving ability, and this young man seems very mature the way he speaks. He is not saying.. you know what I mean and other obnoxious things some young people say these days.

Defendant clearly said the pictures were after it was moved. He never changed JM just didn’t hear. I think she is wrong. Also she always says to call police then now she isn’t buying the police report.

SO, how was the defendant supposed to know he needed to make a wider turn? Should you always make a wider turn when pulling a trailer? When I park/pullover street side I; pull as close to the curb as possible, and push my sideview mirror IN if parking. When rounding corners on my town, I've definitely been REAL close to a few cars that were unexpectedly parked and slightly sticking out, so I understand how that aspect happened. On my street people park on both sides, unfortunately most of the people on my st don't want to use their driveway/parking area🤔, and there's always someone who is 6in or more away from the curb. It's really difficult coming out of my driveway in any vehicle, and we ALWAYS have to swing out to avoid hitting someone's car.

I am making the assumption that you didn’t hear the defendant was driving in the opposite direction from the plaintiff..? Yes you do need to make a wider turn whenever you are hauling a boat, RV, trailer of any sort and even a uhaul.

I disagree with the judge. If your car is stopped in a place that makes other cars have to swerve to not hit other cars; if it obstructs other vehicles traffic its his fault. Of course tickets don't accidents, his obstruction of traffic does.

No one traveling the opposite direction should have to swerve to avoid a car parked (whether in an illegal parking spot, a legal spot or in the other lane) if they were able to stay in their own lane. It sounds like he took the curve a little faster than he wants to admit (have you actually driven 25 mph, UGH feels like you're at a crawl!!) The Defendant did a good job but he's still at fault.

If something is in your way, you STOP. If you are not sure you have room to pass, you DON'T proceed and hope for the best.

While I think she didn’t listen and was stupid many times. You can’t get away with hitting something stationary even if it’s parked poorly or illegally.

Bad verdict this time. He got the ticket from an unbiased 3rd party which clearly stated it was the old man’s fault.

Not a bad verdict, and you're assuming that the 3rd party was unbiased. As a truck driver I know that the moving party is always in the wrong. I hit a mirror of another truck while backing and it didn't matter that the guy was 6 to 8 inches into my dock, I was at fault because I was moving. I literally predicted this verdict and I'm not surprised.

I've always heard of unconscious bias and didn't realize how prevalent it is until I starting listening to these cases without looking at the litigants. If your honest with yourself you will recognize it and it's not really ok. Makes you wonder how it much it affects people in power such as judges, police, doctors and such. It's not suppose to happen but certainly does and surely can't fuck someone's life over.

Wait… when the plaintiff said his car 🚗 was in "mint condition" I was honestly expecting a souped up vehicle, with Mack Daddy rims and bling. Aesthetically, I was COMPLETELY underwhelmed 😩👎🏾 by the cars average appearance. Sorry 🤷🏾‍♀️😂

I actually disagree. No parking means no parking and whether he had the car on or not, he was parked and not moving. He was at fault. I rarely disagree with Judge Milan but I do on this case.

the gentleman was stopped. Parked means he has gotten out of his car and left it. He is not at fault

@@ladymissgd my sense was that the gentleman pulled over and that there was plenty of room for the truck and trailer to pass safely. My point was that there is a distinction between stopping and parking, legally (where I live, in any case). Cheers

the plaintiff seems confused/mistaken about what actually happened, I seriously doubt the little boy told him he worked for any officer...annnd there's no such thing as a "mint condition" Buick LaSabre, they've always been trash😅

You all must need glasses because even in the pictures the plaintiff's car was not in the opposing lane. He pulled over onto the right side of the road and whatever portion of his car was angled was still in the right lane, not the opposing left lane. If a driver coming around the corner is driving too fast and cuts the curve too sharply, then yea ... there's going to be an accident, as there was here!

Bad Ruling. If an accident is caused by someone doing something they're not supposed to be doing, then THEY are responsible for the accident and NOT the person that hit them. Obviously, there are some exceptions, as there are with most things. But in this case, the plaintiff caused the accident and is 100% responsible. Unfortunately, the fake pretend wanna be "judge" has a very flimsy grasp of the law. Even then, it is usually ignored and replaced by her emotions.

I'm surprised that the defendant's age and inexperience wasn't brought up during the case, as clearly, this was the overriding factor!
