They also told a people who had their orders in by the deadline but weren't shipped that the orders would be cancelled. Even though by the stay, they are legal since the purchase was completed prior to the deadline.

People are starting to be aware. I didn't realize how bad it had gotten till I decided to get a 9mm in CA. The list, magazine size restrictions, and the crazy sporting rifle restrictions. Now I am aware and getting involved.

This same judge said that magazines are considered "Arms", thus are protected by the 2nd Amendment. He also stated somewhere that it may be okay for people to own grenades.

Just hope the good people of each State stop this "it's unconstitutional" rhetoric and realize the real criminals are in their collective governments, who don't give a rip about law, don't care about trampling freedom, and do everything within their power to get around the legal system that the rest of us are bound to obey. If we can just understand how the Left thinks and operates, we can get off our collective defenses and move to the offense. Instead of putting up with all the attacks from the lawless Left, we need to give THEM a heap of things to deal with.

His ruling on the stay is the piez de resistance. He wrote the stay in his terms ensuring that those who purchased during freedom week would be free of repercussions. If he had not ruled the stay the 9th would have ruled the stay and you can guarantee that the stay would have written different. This way the doors have been opened and there is nothing Becerra can do about it until case is decided at the upper lvl courts.

Judge Benitez did not cave in under pressure. He just realized that in granting the stay himself, he could both give us some extra time to buy even more standard-capacity magazines and grandfather them in, making them legal (pending future rulings). Had he denied the stay, then California's communist government would have gone straight to the 9th Circuit, who would very likely not have done the same--they almost certainly would have declared all of the recent purchases illegal. In doing what he did, Benitez not only did us a favor, he was playing a long-game strategy in which a couple of million additional magazines in the state serves to strengthen his argument regarding the commonality of such items; it also strengthens his argument regarding the confiscation of personal property with compensation. This is why he granted the stay, taking three days to file his order and giving us an extra day on top of that since it was a Friday. He pushed this strategy as hard as he could while giving the 9th Circuit no justification to reverse anything he did. Awesome job by Judge Benitez!

Logan Waltz In NorCal there’s plenty of counties to my knowledge (don’t quote me on that) that will issue CCW permits. In SoCal it’s different since the counties here are may issue. You can get a CCW permit here but you just gotta go to a county that’ll issue you it.

From the Countryside of San Diego County.., THIS WAS AWESOME..!! We LOADED...UP... on High Cap Mags like CRAZY. Every dealer/shop was Overwhelmed with orders, phone lines were all busy, factories were overwhelmed. Ordered mine on the 2nd, today 13th, Still waiting for mail delivery of mags. 5pm. Apr.5th was the deadline

A lot of companies dragged their feet initially but began shipping later in the week such as Buds and Midway. Some companies also stopped shipping and canceled orders at 5pm even though the order said it was legal as long as it was purchased before 5pm. The AG intially requested a stay be made by April 5th (requested the Monday after the Friday Mar 29 ruleing). After recieving proof that SCMs were being sold he bumped uo his demand that a stay be made by April 4th, threating to go to the 9th Circut for an emeegency stay. Judge Benitez issued a say on the 4th, protecting purchases til the 5th at 5PM PST. Had a stay been issued by the 9th instead, it would have not been as friendly. Dude, you talk a big talk but what it boils down to is that you don't want to lose your Rights and and don't want to lose your money in fines! That is it! Another thing that isn't being addressed is the manufacturer of high capacity magazines between March 29th and April 5th, so if you had a blocked or pinned 10/30 ar mag for example and you drilled out the pin or removed the block during that time frame it was 100% legal. I'm not a lawyer so read for yourself but no way to track that so....

Hey guys, I REALLY appreciate the words of encouragement. I was born and raised here around Los Angeles and there are few 2nd amendment supporters here. Those of us few feel under near constant attack for our views...at least I do. Just about every 6 weeks we hear about 4 or 5 new anti-2nd amendment laws being considered here in our state legislature. If it isn't tossed they will start banning numerous accessories because the precedent has been set, triggers, sights, grips, stocks, scopes, etc. They have already proven they will do what the want, this new ruling against the SHTF 50 BMG upper is just the beginning, with the 50 cal they decided to treat that upper as a separate weapon even though it attaches to the normal AR lower that is already serialized. If this is allowed to stand they will take away upper assemblies, receivers etc, you will have to run them through FFL as well. While the money hungry, worthless, 2A infringing POS NRA has done squat, the GOA has various law suits going. Fugg the NRA, the GOA is getting my money...

At least the Colorado mag ban is unenforceable. Everyone has 30 rd mags. Most law enforcement looks the other way because there's no way to prove when the mags were purchased.

@8:20 - If I'm not mistaken, all Magpul magazines have a date code/stamp. I have gen 2 mags from 2012.

Full 9th will immediately overturn. They hate the 2A. I know, I live in CA. It will be appealled to SCOTUS and John Roberts will say the issue is not ripe and refuse to hear it. Meanwhile we will simply continue to ignore the law, just like we always have.

He issued the stay with protections because if he didn't the 9th would have issued it without any protections and people that bought magazines would have most likely been considered criminals. He gave us the best deal he could.

The prohibition includes linked ammunition. There are people with belts of ammo from before 2000 and they put a dummy round 11 or 12 rounds from the end so that it stays a “large capacity ammunition feeding device owned prior to 2000”

I had previously bought some 10/30 Hexmags and 30 round mag springs from Brownells. In a SHTF situation the hexmags can be easily converted by pulling out the 10 round spring and the block and installing the 30 round spring. During freedom week I picked up a couple of Surefire 60 round quad stack mags which should be delivered soon.

This could be a good thing. 9th circuit affects more than California (Hawaii, Oregon, I'm looking at you), and if the 9th keeps the law in place, the current USSC will almost certainly overturn it.

I'd like to think so, but I'm not so sure anymore. It has become painfully apparent lately (especially with the his turning away the bump stock challenge) that Roberts is not on our side.

If the USSC (AKA SCOTUS) choose to even hear the case at all, that is. If we lose in the 9th Circuit, then the USSC may decide that since their decision is perfectly in line with all of the other judicial decisions concerning magazine bans, they'll let the status quo stand rather than make a radical departure. Thomas, Gorsuch, and maybe others can fume all they want if this is done, like they did the last time (co-writing a scathing condemnation of what the USSC did), but the USSC as a group do not choose to hear all 2nd Amendment cases, especially because Chief Justice Roberts, despite being a conservative, does not like dealing with these cases for some reason. Perhaps a better scenario would be if the 9th Circuit were to rule in our favor, which may well become plausible once President Trump manages to fill the 7 vacant positions on top of the 3 that he has already filled. The 9th Circuit would become far more balanced than it has been in decades, and with some luck they might rule in our favor this time. If that happens, then California's only option, since they wouldn't accept defeat, would be to appeal to the USSC, opening the door for the possibility of making all magazine bans unconstitutional nationwide.

@@rbrtck This is a fair enough point -- it's pretty rare that the USSC even hears firearms-related cases. I'd hope with the swap from Kennedy, we'd have a good chance at 4 judges choosing to hear this case, should it be escalated this far. We'd likely have the two dissenters from Guede v. BATFE, and I'd hope with something this ubiquitous, we could pick up Alito/Kavanaugh, but who knows.

@@nochitlins There had to have been someone else rejecting that case. My guess is it was Kavanaugh (Because precedent seems to be his primary focus). For this case, I'm guessing if it was Kavanaugh voting to reject the appeal, we would make it onto the docket. The majority of the decision from the CA judge is based on precedent, which would be more persuasive to him. I highly doubt Roberts would go against the strong arguments in favor of overturning (But who knows... at least he would be on record as anti-constitution if he did vote to uphold. Better to see your enemies clearly than not).

I live in CA and I don't hold anything again the companies who don't do business in CA. Look at all of our laws and policies. Why should the manufactures and wholesalers expose themselves and their shareholders to the liability of doing business or selling products here? I thank U.S. District Judge Roger Benitez for his courage in declaring the state law unconstitutional. I am disappointed that he issued the stay a week later but he has given us some hope.

Thank god for Freedom week! And those who took part on making that happen especially Judge Benitez! Although I don't expect much of a positive outcome from 9th circuit Court of appeals. But you may never know, surprisingly The 9th upheld the judge Benitez decision on prop 63. 2 yrs ago. Helping us keep our pre-ban standard cap mags without any criminal prosecution.

It was a wild week. Every local gun shop that sold standard cap mags had black Friday type lines on Wednesday. One shop sold out of Glock maga in one hour, they had 500. Also there were probably millions of mag repair kits that were already in the state. Also props to all the vendors who kept the prices at retail or lower.

This is a perfect example of communist California(which is where I live btw) overstepping its bounds on stripping its citizens of all our freedoms! I am absolutely for states rights, but there is downright police state regulations in place that we are forced to live in. I am saving my shekels to get out of here. That was basically the argument presented to push for the possession ban in 2016. “Sure we’ve banned acquisition, but grandfather clauses are hard, so we’re going back on our promise, hand ‘em in.” This ruling is their overstep blowing up in their faces.

The date stamp/wheel is used by many manufacturers of polymer products. Common method of tracking when the pieces were molded, not sold. On most of my Magpul stuff.

Instead of mag capacity bans they should focus on screening who gets a gun better. The issue is putting guns in the hands of sick people or with a history of violence (like giving a gun back to a guy who hits his wife for example)

That's not the problem man, and anyone with a domestic violence , felony, and some misdemeanors arent able to buy firearms legally, criminals dont go into gun stores. Your screening idea is already in place, and the only place its effective is at gun stores, and gun shows, not on the black market. Not to sound like a dick but you need to re-educate yourself
