It's called a verbal contract and while it is legally binding the legitimacy of it can be called into question quite easily as there is no physical proof. If you make a verbal contract you want kept it's best to do it in front of witnesses or record it if you can't put it into writing.

@@t2force212 And I'm guessing from the comment "the original contract", there was a subsequent contract that did have physical proof, and signatures, and probably notarized. Which, while I'm no legal expert, sounds like an amended contract. Which would supersede the original contract. Otherwise, there would be a lot of people going to court over changes to wills.
