@@jonathanmkrtchyan7526 Harvey worked with Denis and they were very close at one point. Harvey left the DA office to join Jessica because she paid for his college. Denis felt betrayed because he has a strong moral principle and felt like Harvey was chasing money not justice. Which is why he has a vendetta against him. But in the entire show Cameron Denis for the most part only wanted to put the guilty people away. That’s why in these scene you see Harvey trying to convince him who is the one actually at fault.

@@vedantharwani9278 so frenemies? Why did Stephen refuse to answer Harvey’s questions but denis was successful at breaking down Stephen? When someone in court says I decline to answer what do you usually do as a lawyer if you want to get someone to talk in court?

@@jonathanmkrtchyan7526 Well I’ll start with I’m not an expert on American law but from what I understand. The 5th allows you to not self incriminate yourself. When a lawyers asks you questions in a court you have to answer truthfully, if it’s a criminal court you can take the 5th and not answer. Harvey can’t really do much, he could raise the matter in a civil court ( if applicable, it isn’t in this situation) other than that nothing. The reason Steven answered Denis’s questions is because it allowed him to control the narrative. Denis asked questions that incriminated Ava, not Steven. While harvey asked questions that would’ve incriminated Steven. So Harvey in this case needs to provide evidence to be able to prove his point because he can’t force Steven to legally say anything he doesn’t want to.

Stephen literally told Harvey what he would do if he put him on the stand and he did that anyways...I kind of blame Harvey for not having planned anything and just trying to show how "gutsy" he is in the heat of the moment. Should've just waited until he had more proof.

His plan wasn't to convince the jury of his client's innocence or Stephen's guilt. He was trying to convince the prosecutor (his former boss and mentor) all of the above by emphasising Stephen's invocation of the 5th amendment.

But it worked. Because Cameron did ask Stephen about ordering the killings of those people. Harvey wanted Cameron to know that Ava was innocent and that Stephen was the one behind the killings. And seeing Cameron asked that last question from Stephen does show that.

He can't actually selectively invoke his 5th amendment rights, though, precisely because it would create opportunities like this for him to make accusations without being subject to effective cross-examination. Once you start answering you have waived your 5th amendment rights.

It doesn't matter whether it's a criminal act or not, so long as it could be used to incriminate you. That's why you don't have to say anything at all to the cops.

Yep. Rights are dependent on jurisdiction not citizenship. Same way an american hre in the UK cannot plead the 5th.

There is always the "Clinton" defense. "I don't remember. I have no recollection. I don't recall." It is the pleading the fifth without actually pleading the fifth. And it really only has a chance at working if you are as old as dirt.

When you are testifying and you invoke the 5th amendment, you can't then answer some questions and not others, you have to not answer any questions, If you answer some questions you can be ordered by the court to answer all questions.

It would have to be part of the evidence that can be called in as an exhibit. Given to both sides. So that both sides would then argue whether the photo was doctored. About the only way around this is if it is a civil case without attorneys representing everybody and coming out of the woodwork.

Fifth Amendment rights are applicable to all criminal defendants, not just U.S. citizens. So a Brit or any other foreigner being tried in an American court is perfectly entitled to plead the Fifth in the same way that an American can. It's based on jurisdiction, not nationality/citizenship.

@@sandilsrinivasan2976 Obligatory, I'm not a lawyer and hence I'll respond to this question to the best of my knowledge. But if someone reading this comment feels that I'm not correct, please feel free to correct me - I would appreciate it. The courts have rules that you have the same rights as in the constitution as citizens, and all the same rights as citizens. The Fifth is a fundamental right and that right applies to anyone within USA, regardless of the fact whether they're a citizen of USA or not. I am not sure if it also applies to the "aliens" who enter USA illegally. The exception is situations which require you to be a citizen, such as voting, or some other issues such as immigration and things that specifically affect non-citizens. As far as I am aware, everyone within USA is protected under their fundamental rights, and hence it's important for anyone visiting USA to keep those rights in their mind - especially the Fourth Amendment right, which is right to a lawyer, if I remember correctly.

​@@dhruvgargi3360 The fourteenth amendment reads in part "nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws" note: any person, regardless of citizenship. Without the 14th amendment none of the protections of the bill of rights would restrain the actions of state governments, only the federal government. Americans would in effect have no constitutional rights.

No , it just means that you refuse to answer the question. The assumption is that only guilty people would decline to answer . But it isn't about whether or not you did a crime. It's about whether you did a crime in a provable way . Invoking the fifth amendment is not an admissable evidence of guilt in a courtroom.

@@Dictionary_ The 5th Amendment is almost like a get-out clause, surely? If you've nothing to hide and you're innocent why would you decline to answer? And if, say, you are innocent but don't want to incriminate someone then surely that would be perverting the course of justice and/or withholding potential evidence? Also, why swear an oath to tell the truth but still be allowed to decline to answer? Make it make sense 🤷‍♀️🤔

There's no such thing as a "British" accent and Max Beesley's accent (who plays Stephen) is using his real Lancashire / Manc accent. Christine Cole who plays Paula just has a middle class London accent, it's no better or more "British" than any of the others.

@@pruray Both Conleth Hill (who plays Edward) and Michelle Fairley (who plays Ava) are from Northern Ireland so they are British actors. They do augment their accents to be more Londonised but I assure you they know what they are doing. Their accents are a million times better than any American actor I've seen doing a London accent. Michelle's is still very close to her actual accent and they both sound like real people you could find in London.
