Fear of being punished is a negative affect? This fear is only present when punishment would be justified.

Fear is an instinct that is not necessarily rational, hence it doesnt require an individual to be guilty. E.g. fearing to be sentenced to a punishment for being falsely convicted, misunderstood by someone else or having misinterpreted a situation is enough.
