That's not simple at all. A whole big bunch of Grindr users are closeted. They wouldn't want to verify their legal identities on Grindr and be known. Also, Grindr is used by people who live in places where it's dangerous to be out of the closet.

Yeah, I don't know what the right answer is. Many Democrats want more censorship. It's indisputable that the big social media companies have used different standards when censoring people on the right and Democrats have been transparent about wanting to pressure them to go further. Many Republicans want to re-categorize social media platforms as publishers if they do any censorship so they have to choose between leaving everything alone and being open to lawsuits for content that users post. It's probably best to leave the law alone for now and let people decide whether it's worth it to continue using platforms that censor based on a political agenda.

Every country has digital borders, hence .en for England, .fr for France, etc. The US invented the modern internet, so American web addresses don’t say .us, but it’s the same thing. American law only applies to American web addresses, at least in general. Sometimes countries (as with France right now) will try to apply their laws to companies operating within their borders, and demand that those companies act a certain way regardless of what nation’s digital domain they are operating in.

It did sound like that. The Internet allowed people to become informed without experience, which was bad for the gerontocracy because the “older people are more informed due to having more experience” argument became null and void due to the Internet breaking the connection between information and experience.

@@aaronm.3843 probably because the ex boyfriend has no money, and court costs a ton of money. Which is why when the lawyer says let’s sue big tech, it’s because she’s looking to get rich, and the problem is Americans are in general way too litigious. If 230 didn’t exist their wouldn’t be an internet because it would be in court proceedings that would take a thousand years to go through them all.

Imagine you are hosting a website and as soon as someone uploads something illegal on your website you will go to jail or have to pay a lot of money. Someone selling tools will face legal consequences, if someone uses this tools for a different illegal purpose. This is what a lot of this lawyers want and what will prevent you from making your own social media or video site. Google and Facebook have enough money and strong filters to survive this laws. Vox totally missed this. Erik's story also seemed like something someone would make up to get some attention.

Nope. No actual identity was stolen. In my country this was clarified as a crime recently but not in the US. Because he didn't get bank info, soc security number, passport or something similar, this was not actual identity theft.

Sue the PEOPLE doing the harmful posts instead of the companies allowing those posts edit: To those mentioning anonymity the solution is relatively easy, you can use court orders to force companies to give you information on a given user. That way anonymity is protected until a judge considers it is relevant for an investigation Of course it's not a perfect solution, there are tons of corner cases where this doesn't work, but i think that in most cases this would be the best way to go

In response to your edit on the post, as with this last reply, people who know what they’re doing is wrong and potentially illegal will take precautions to ensure that, even if a court order forces a social media company to hand over the information they know on a certain user, they can not be identified.

@@occengineering problem is that I'm not the government. so if someone posts something about me anonymously, I cant track them down. I as a private citizen, don't have access to those government tools. and even if I did, good luck trying to prove that in a court.

Freedom of speech does not mean you are exempt from the consequences of your actions. I don't think we should limit people's freedom, but people shouldn't be allowed to post defamatory or harmful content without being held accountable. It's just common sense.

Section 230 is the reason you can be anonymous on the internet. Change that and sooner than you imagine you have to log into every site with a verified form of ID, because the website will want to sue you if you post anything controversial and it becomes problematic for the website. No, it does not need to be something ethically wrong: you could be posting a video of someone being murdered by the police as a form of protest and the website could come after you because the police dept sued for frivolous reasons. Killing section 230 is asinine, as many comments below point out. It is good as it is, and making it a political battleground does not help anyone, neither left nor right, so stop it.

While agree with you terrible example. Grindr in this case acted without care for their product. when i can contact your company, tell your company somone is impersonating me and you have not shut down the false acct you are at fault. More like a cop watching you get robbed and then telling you to call 911 for help.

The issue is these companies are allowing the platform to be misused for individual harassment and illegal content proliferation. They went after the guy as well just so you know, but many more people are going through what that guy went through because the platform is unsafe and unmoderated.

As a programmer I will add this: there is immense difficulty in detecting unwanted content and requires sizable investments to maintain and keep up to date. Manual reports of content also cost an extremely large amount to pay physical content moderators. Very difficult problem.

Companies shouldn’t have to be liable for everything that is posted (it’s impossible), but they should be liable for what they consciously choose to leave something posted when they shouldn’t.

I personally want everything to be as open as possible. Maybe lawsuits in certain times should also be. ISP should not be able to weld the sword. Companies should get a little less sword and shield. The one thing that I think would be the worse outcome is if the internet (as a whole) becomes more censored. What happens to companies is slightly different.

When you do that though what you are actually doing is handing the keys to the people money. When everything is totally open Russia oligarchs control your Facebook feed because they can afford nearly unlimited amounts of targeted advertising. The remaining Koch brother controls your representatives because he can afford nearly unlimited campaign dentations (not that buying off your reps is particularly expensive anyway). Walmart controls your shopping because the Waltons can afford to sell at a lose until all the other businesses in your town go out of business etc etc

But the thing is that every competing interest could deploy bots, not just Russia or the Koch brothers. Maybe rather than forcing startups out of the market by changing Section 230 we should just make certain kind of targeted advertising illegal in order to make it more difficult for bots to work. State intervention in these matters is good, but it needs to be carefully planned, otherwise it can do a lot of damage and not act exactly as intended.

Uhhhhh... why couldn't the vengeful ex-boyfriend be held accountable? The company should also be trying to stop abuse of it's system, but you totally left out the logical first step of legal action against the person actually comitting the abuse.

The fact that the guy got harassed trough a dating app and then he sues the app company is quite ridiculous. It is like being stabbed by a knife and then i will sue the company which made the knife. Nobody even sues gun or cigarette companies for anything, why should the internet be any different? In the first place the person is liable for his actions, the app company is liable only for their inaction. It would be like selling a gun to a person who says i want to shoot people there and there!

Ok so like i dont think that if someone is slandering or harassing someone online and thats affecting them legitimately in the real world then, they should be able to sue the person not the company involved, they are giving everyone a platform and just cause someones harassing someone else on their site doesnt mean they are to blame for not doing anything about it. If its that bad take the other dude into court.

I think the war on §230 is really similar on the scandal of article 13, another legal movement around the Communications Decency Act. Europe tried to entirely scrap §230 and make companies fully liable for the content of the internet. People were saying that it was a disaster because, if that happens, companies would have to implement extremely agressive filters that take down copyright infractors on the spot, before it is even uploaded. And that's all. The problem was not the law, but how the law would.make the companies react. And it is because the law is only as big as the ones affected by it enforce it, or get it enforced. The problem with War on §230 is the same, much like we could've never known how companies would use their rights back when §230 was enacted, now we cannot know exactly what effects any reenactment of §230 could have in our lives. This section has helped shape the internet as we know it, and any change, as small as it is, has the potential to have tremendous consequences on the internet as a whole, as the group of 100 companies that control maybe 98% of the entirety of the surface and the deep web, are forced to change their rules and rethink their models to see what other exploits they can use, and what they can no longer use, what new methods they use, what new tools are developed. This thing has become so big that any change could have deeply changing consequences, because of the unpredictability of the different companies at play
