As a spouse of a deceased veteran, you may be eligible for thousands of dollars in benefits from the VA, but to qualify you must prove that you are a spouse of a veteran.
There are a number of different ways in which you can do that.
In order to be considered a qualifying spouse, you must either be married to the veteran or be in what is called a “deemed valid marriage” to the veteran. “Deemed Valid” is determined by common law marriage standards regardless of whether you reside in a common law marriage state.
You can apply for DIC (Dependency and Indemnity Compensation) if you can prove these criteria:
1. Prove you were married to the deceased veteran or were in a "deemed valid" marriage
2. Had at least 1 year of marriage by the standards in #1
3. Continuously lived together during your marriage (except for medical or civil reasons that you'll have to explain)
4. You haven't remarried since the death of your veteran.
These criteria apply the same way to same-sex couples.

If the Veteran is 100% rated disabled, that status IS always service connected, and if the his/her spouse have been married for 10 years from the date of the 100% award letter then the spouse DOES qualify. Currently - 2024 there is a Bill working it's way through the Senate that would not only increase the amount given to the surviving spouse but reduce the time to 5 years. The "Caring For Survivors Act".

But you forgot to mention that the cause of death has to be service related, if the veteran has received his 100% disability less than 10 years. They denied my DIC but I appeal the decision with a attorney .

DID YOU WIN? MY HUSBAND DIED MUCH MORE QUICKLY FORM ALS. HE WENT WITHIN 2 YEARS OF HAVING IT. MAKES NO SENSE BECAUSE IT IS A MILITARY DISEASE THAT I WOULD GET TURNED DOWN.

My former husband just passed away and he name me as the beneficiary for AOP 100%. However, he was paying into spousal benefit program for his previous wife who is also deceased but I am not sure If my name is included in that program. If he never remarried ; what are my rights to claim such benefit?

In addition to being surviving spouse provide evidence showing that one of these is true: The service member died while on active duty, active duty for training, or inactive-duty training, or The Veteran died from a service-connected illness or injury, or the Veteran didn’t die from a service-connected illness or injury, but was eligible to receive VA compensation for a service-connected disability rated as totally disabling for a certain period of time

My mother just passed and my father was a veteran and he died in 2016. He served in Vietnam as a Marine. My sister and I are the surviving children. What benefits do we get? Burial reimbursement? Please advise.

Hello! Can I continue to claim as a substitute for my deceased widow claimant Mother? Can I apply for any other benefits she is supposed to be qualified but she did apply while living? She died at 88.

My husband was a veteran.He passed away in 1994 at 53. I was on a permanent disability at the time .We were married for 23 yrs.We lived apart for a while for medical reasons a few yrs. Would I be able to get DIC benefits?

Was your husband service connected (was being paid by the VA for service connected compensation)for anything that is directly contributing to his cause of death? If not, that is basically a no.

If the veteran's eligibility was due to rating of totally disabling, they must have had this rating: - For at least 10 years before their death, or - Since their release from active duty and for at least 5 years immediately before their death, or - For at least 1 year before their death if they were a former prisoner of war who died after September 30, 1999

I'm requesting info for a cousin who's husband commited suicide a few years after returning from Viet Nam. He served as a door gunner. She went to apply because she was left with 3 young girls to raise alone. The VA turned her away so she had to work 2 to 3 jobs to care for her girls who are now grown up. She is alone now and struggles to make ends meet. Her home is older and needs much repair. PTSD was not recognized back then which he obviously suffered from hense his suicide. He also developed cancer they did not recognize at the time which made his depression worse. She has never remarried. I don't know what the income requirements are and if she would qualify at all for any assitance or benefits afforded veteran families now.

@@woodslawyers Hi, my ex-deceased husband was in the Vietnam from 1966-1987. We were married on 2/26/1992. We divorced on 1/2/ 2003. His Death was service-connected. He was diagnosed with Agent Orange and PTSD, and his cause of death was Cardiopulmonary Arrest, Non-Small Cells Lung Cancer, and Astral FIbrillation Hypertension. We were married for Ten years. My question is, Am I entitled to receive the DIC benefits? and he was married before our marriage and that marriage ended in a divorce, as well, and that marriage lasted 17 years. Is his first wife entitled to receive DIC, and if so, can two ex-wives receive DIC? Thank you for taking out the time to answer my questions.

Since you are already receiving widow benefits, the other benefit you may be eligible for is a survivor's pension. This is paid to veteran's survivor who meets certain eligibility criteria. The survivor's pension is a needs-based benefit, meaning that survivors must meet income requirements to receive the survivor's pension. Get a lawyer. They will work for you if they think you have back pay from the death of him until now. I heard one lawyer say they got back a quarter of a million for some women.

This is a tricky one. If we're applying the same definition of "marriage" the VA uses for eligibility for DIC, it could depend on if the widow and boyfriend meet the VA's criteria for a "deemed valid" marriage. However, if the widow has a boyfriend who she is not living with or sharing financial responsibilities with, it stands to reason that she would still be eligible for DIC.

Hi, I just watched your video. My husband just passed on December 27, 2023. He was a veteran. We were married in 2010. We met and got legally married in South Korea. I'm South African and he was American. In 2022 he returned to the US to set up a home and try to find work to support the both of us, while I returned to South Africa to visit with family. Unfortunately, he was diagnosed with a stage four glioblastoma brain tumor in January 2023. Due to financial concerns, my husband didn't want me to join him in the US at the time, although we communicated telephonically almost daily during this period until his death. He was receiving social security and some VA benefits at the time of his death. He told me that as his spouse I would qualify for some of this. The problem is that I'm still in South Africa and would like some assistance with this process of applying for benefits.

I was denied twice because the 10 year rule which is ridiculous. He died from in a motorcycle accident but was 100 percent total permanent but it had only been 6 1/2 years with that rating. My income from my job isn’t enough to make ends meet and I lost his income. I think it’s very unfair for survivors to be treated this way. My husband served our country and was injured due to someone else’s actions and yet he had to fight to get his disability even with his back injury causing him to be able to walk at times and then 2 years later finding gauze coming out of the area they operated on while he was still in. It’s sick how they treat our veterans and surviving spouses. But I guess since they don’t have to worry about finances and mourn the loss of their loved one they don’t care. They are rude when you call like you are bothering them. I have nothing good to say about the VA. They are worthless.

Hi I was denied SS spousal benefits because I was only married 3 mts before he passaway but we had a relationship for more then 20 yrs .he was my high school sweetheart .he collapse and was a diagnose with salvary gland cancer on Dec 2020 he was a trucker .and passaway on Nov 3 2021 he last wish for us to married so we did .but was even denied his funeral benefit .and was told that I don't qualify for anything.I am permrntly disable n recieved SSI .have COPD and Lupus and GBS.he serve 71/2 yrs in the army I have call several VSO and organizations who have only refered me to other person's it's been 6 mts of heartaches.I ve been seeing your videos n would like your opinion.thank you 🙏💗

I live in New Jersey and no this state is not a common law state.

In that case, your marriage would need to fit these definitions to receive benefits for your spouse: For VA benefits - www.ecfr.gov/current/title-38/chapter-I/part-3/subpart-A/subject-group-ECFR2f2f66751230c72/section-3.52 For SSA benefits - www.ecfr.gov/current/title-20/chapter-III/part-404/subpart-D/subject-group-ECFR219bf3e41a78e9f

I am sorry but I don't understand your video clearly talks about it doesn't matter if my state it doesn't accept common law marriage a spouse still can qualified I can prove that we were in relationship for over 20 yrs .I was advise by a VSO to get an attorney .
