He's the star of the show but he doesn't know. In this video essay, I look into the hypothetical legalities of the Truman Show through the US legal framework. I'm not a lawyer but I do love the Truman Show and hypotheticals. Please let me know if I've missed anything in the comments.

Good video. Some additional legal issues: 1. Wrongful imprisonment, 2. Illegal surveillance within Truman's house (a huge 4th amendment issue), 3. Illegal use of name and likeness after Truman became an adult. Paying him back wages is only part of the problem-they recorded and broadcast him without consent.

Also, the way they said "First child to be adopted by a corporation" implies that there are more people who have been adopted by other corporations. I'm imagining the world outside Truman's dome to be filed with people like Community's "Subway", who exist solely to promote their parent corporation.

Another one is that Truman, although technically a resident of Hollywood, would never have been able to register to vote in the state of California, therefore denying him his lawful right to vote.

@@Alucard-gt1zf TV in the Truman Show is probably staged instead of censored. It could have real news, but it wouldn't be the same broadcast the free people have and some news would probably be delayed at least a day so they have time to stitch it together. About voting, even if you broadcast to him the real candidates with their real propositions, that having to be censored for him would make his vote fake. Sure, many networks choose what they want to broadcast following their own bias, but in this case it would be evident and the network here has a monopoly on the information he receives. He can't switch to a channel that tells a different story.

I got my Bachelor's in Psychology and damn the first time I heard about the Little Albert experiment shook me to my core. Followups are limited but the "ratlike animals" he was traumatized of included pretty much any four legged mammal, including dogs and cats. He died at the age of 6 petrified of everything. His mother was compensated $1 for the experiment, an experiment that she did not consent to and was only informed of after the fact.

@Lernos1

It should be pointed out that there is no conclusive proof the 6 year old was the Little Albert from the experiment. There is no proper trace of him left after he left the hospital. If the proposed 6-year-old, Douglas Merritte, was indeed Little Albert, it raises questions. Douglas died from hydrocephalus, and he most likely couldn't see very well at all, which contradicts the entire idea of the experiment. The original comment makes it sound like the experiment somehow led to the child's death, which is obviously not the case. There is nothing to show that Douglas was "petrified of everything", nor was I able to find anything about the $1 compensation. According to another theory, Little Albert is William Albert Banger (he was the appropriate age, his mother also worked at the hospital, he was called "Albert" his whole life thanks to his middle name, and his physical parameters matched the Little Albert descriptions), who died at the age of 87 and was perfectly fine except for his inexplicable antipathy towards dogs, which is hypothetically linked to the experiment. Don't get me wrong, that experiment was still pretty brutal. But it may not have ended up being THAT dark after all.

@@joomping-rng it was for a while but investigators have boiled it down to one, or both, of 2 people. In Universe, the showrunners must of had hoops they went through just for the the shows existence. It's is possible they had an exit plan incase Truman wanted to leave the show and they couldn't stop him. He was the Star of the show, so they may have kept a good actors salary for him, saved up over the years. possibly to reduce in universe legal issues. They had many actors on the show so paying Truman indirectly wouldn't make much of a difference.

In all likely good, they could prove sufficient education given they have video of his school years. This is important because a corporation of this size and sophistication would have had him sign an employment contract when he got his insurance job. This contract would have likely included permissions for his real job of being Truman. Similarly his college contract likely had similar fineprint and legalese. Could it be said he signed under duress? Maybe. But they have a lot of footage showing that he made active choices and had many happy moments in his life. I'm betting no one goes to jail, but Truman does get very rich. And dies alone in a mansion in a constant state of paranoia.

5:10 - They can definitely pay for expenses reasonably related to Truman's welfare (e.g. food, clothing, etc.) before he turned 18. They *might* be allowed to pay for the whole production, but that's much more of a stretch. Once he turns 18, this all gets much harder to justify as well, because the corporation can no longer argue that it was acting with any sort of parental discretion, and so they probably cannot expense anything other than actual food and rent. But even that becomes problematic because the Fair Labor Standards Act sets a number of complicated restrictions on when and how you are allowed to deduct those things, and it is not at all obvious that this scenario even fits those rules in the first place. The FLSA mandates double overtime for anyone working more than 80 hours in a week. If we assume that Truman was working 24/7, then they owe him (at least) $7.25 an hour for the first 40 hours of each week, then 1.5x base pay for the next 40 hours, and then 2x for the remaining 88 hours, for a grand total of almost $1900 per week, or almost $100k per year. If the state sets a higher minimum wage, then all of those numbers go up, obviously. Now, it is somewhat plausible that his "life insurance" job was paying better than that, assuming it's skilled white-collar labor. But that's not good enough, because overtime pay is not properly calculated based on minimum wage. It is calculated from a person's negotiated or actual base pay. If Truman was told he'd be paid (say) $20/hr for the fake job, then the judge might decide to use that as his base pay for the (real) acting work, and redo all of those calculations from there, netting Truman a huge windfall. If it was on a salary basis, then the judge could convert it into an hourly rate based on the number of hours actually or customarily worked (which was on TV, so obviously discoverable). The resulting wage claim, over at least Truman's entire adult life, would be quite large, and possibly bankrupt the production company.

The big difference between said summer camp and the Truman Show production is that you agreed to the conditions of your employment. Truman, however, never agreed to his continued employment in adulthood and that would clasify him as a slave, something not only illegal, but unconstitutional under the 14th amendment.

All the laws regarding privacy (mail privacy, communication privacy, personal privacy), employment rights and regulations, counterfeiting of documents, education and school attendance, all the laws regarding ownership... let's put it simple. Less laws were not broken than laws that were broken.

Question. If he was seen as the first legal adoption of a child by a company. What would they define slavery. When it was legal a lot of both adults and minors where technically sold to companies who owned them. (you could argue that they where back then seen as a product. also how would a KZfaq family now been seen. there are enough where the parents film effectfly everything of themselves and there children. they make a living from it.
