This advice-as shown in the video--is GOLDEN! There's nothing phony-IT WORKS! I've been there. You can't imagine how disappointed they sound when you say; "I don't consent to any searches." Then they will say, "Well just means that we have to get the dogs." Then I say, "That would be a search also, and I would not consent to that either." They'll hem and haw and threaten and delay and insist they're gettin' the dogs, then they say; "You're free to go."

If you're going to be searched demand a state trooper to oversee the search of a town or county Cop, it may piss off the officer but it'll protect you as well! Providing your innocent!

Always a good idea to have a witness. Even if the judge disallows their testimony. Always have a witness, no matter what.

Best to record everything. " when I refused they said I think I can smell cannabis" Your justification requires an officer to act unlawfully in order to work. I find that a person can justify most any belief if he plays the "what if" game. As for refusal: "a defendant's refusal to consent to search cannot establish probable cause to search. A contrary rule would vitiate the protections of the Fourth Amendment." Source: 835 F.2d 1406 is just one such decision.

Pretty much spot-on. The "Vehicle search exemption" moves the judges decision to issue a warrant from before to after the physical search. The officer will still need to prove that he had probable cause to search and be able to list what he would be searching for.

A cop asked why I wouldn't let him look in my car, and I went into this long yarn, how one cop got into my stuff and threw it out, and caused me to be late picking up my old lady from the hairdresser, so she had to get a cab home, and she got mad and caused me to fall on the steps, and miss 2 days work, and got the boss mad at me, and put me on this crummy assignment, and, and ,and and every time he tried to talk, I just kept on talking, and wouldn't let him get a word in edgewise, and after about 5 minutes of this BS, he told me to go on and leave or he would shoot me..........Works every time.

15 years ago my friend had drugs on him and was loaded walking down a road. The cops pulled along side him and asked him "hey, can we talk to you for a second?" He said yes....etc... and went to jail. On the way to jail the officer told him "you know, if you had just said NO, there would have been nothing we could have done about it and you'd be free right now."

Well said for the most part. I've refused requests to search. Usually my refusal is met with much agitation, but so far no one has ignored me and searched nevertheless.

I'd love to see how this would pan out in court Driver: "Your honor, I didn't consent to the search, and thus the evidence they found is inadmissible" Cop: "Your honor, I affirm that he consented to the search" Judge: "Upheld in the officer's favor"

One thing they don't mention in this DVD, and in the sequel, is to always RECORD the conversation with your phone or camera. Portable recording devices are the best weapon against corruption.

Hell im going for a deputy sheriff but im not going 2 force searches on people thats just a waste of my time. I only will search if I m 100 percent certain something illegal is present or watnot.

***** Explain the disparity in violent crime rate then. Sweden and Finland have lower violent crime rates than the U.S., and it's not even close. You may be hearing about a lot of crime through whatever passes as newsmedia in your countries, but trust me, NO Scandinavian or West European country has it as bad as the U.S.

Keep in mind that a traffic stop should take only the amount of time it takes to deal with the traffic violation. If he hands you your traffic ticket, the traffic stop should be finished. A you tube attorney Steve Lehto, Lehto’s Law has some video on this very subject.

Thanx for speaking publicly about this issue, its a real subject that needs to be handled aggressively. Taking action against injustice would mean calling your senator and voicing your opinion, that's the 1st obvious step. There's no decision makers on KZfaq reading comments and taking note, to think so is nuts. KZfaq comments are not going to change the world. wake up people! Everyone can make at least 1 phone call. The point is that sometimes, they MAY not get a search warrant and you MIGHT get off the hook if you refuse the search. Another reason is if they search you anyway, you have a much higher chance of winning your case if you bring it to court.

I've watched the full video this is taken from. Search "10 Rules for Dealing with Police (Full-Length)." It's very good. It shows you the right way and the wrong way to deal with police. The guy who does the narration is an experienced criminal defense attorney who knows his stuff.

1) If you don't wand them to search you are either hiding something or annoyed at cops for some reason 2) If you are hiding something, is that something illegal because of a corrupt government or is it Illegal because of other reasons? 3) If you're not hiding anything at all, are you worried that they are a corrupt cop and will plant something there to meet their quota? I think those are the possibilities, there may be more but that's all I could think of right now. Either way, you have rights.

In other words, you are at the mercy of the LEO as it depends upon their character, past experiences, what side of the bed the rose from, time of day, drugs in his system, whether he is getting any, financial problems, etc.

That's when you call a lawyer asap when we are being detained or searched without a warrant. That's also why phone cameras and video come in handy. You can video your encounter with a cop no matter what he says.

Be careful because this varies from state to state. Some states allow the officer to search in the areas of the car you can reach and your person without cause.

You're right. I have never been a peace officer, but I'm openminded and reasonable enough to realize it's extremely difficult at times. Every time you get out of your cruiser to confront someone, you have no idea who you're dealing wtih. I'm not against law enf. officers, nor am I against law-abiding citizens protecting their rights. I've heard of so many instances where the justice system has failed a good citizen. I've also see dash cam footage of a cop getting beat up or killed. Sad.

Good stuff i have a true story that happend to a friend of mine. i lived with him at the time and had the day off . he got pulled over on his way home from work by the cops because he was out at nighttime and he refused to let the cop search his car the cop replied i would really like to search your car it would help me sleep better tonight. again my friend said no. so the cop calls for help and makes him stay their for over 30 minutes while they talk about life then finally they let him leave.

I wish I knew this 2 yrs. ago in Mississippi... I was detained and searched on the side of the road for driving a rental Dodge charger. I was returning from dropping my daughter off at college.When I said I didn't want to be searched, I was intimidated by all kinds of tactics including bringing several other officers in cruisers to the scene. I was then told they were bringing dogs and could search anyway and this would cause me to be detained for hours. Of course nothing was found.

If they have reasonable suspicion that you have been involved in the commission of a crime, are in the process of committing a crime or are going through the motions that would lead up to the commission of a crime they can search. The key word here is "reasonable" which of course is up to the LEO and/or an indication from a search K9. Otherwise they must get a search warrant from a judge to gain access to your vehicle if you say you do not consent to a search of your vehicle.

@tippaintball1: Officers need more than just suspicion to search a car. They need the same probable cause that is needed for a judge to issue a warrant. Research the "vehicle search exemption" for more info.

Nuff said. This shows exactly how much you know your rights. if you can't make the difference between a pothead stopped by a cop, and a normal citizen stopped by a cop, or a cop who is corrupt or simply a moron, then I can only say that this is very sad.

The best way to not get busted is to take the time to pull apart different interior panels on your vehicle. See if the bottom cushion of your back-seat is removable (common in Japanese models). Any place that someone wearing Kevlar gloves and a bullet-proof vest is going to have a hard time getting to is always great. Make sure it's a pain in the ass to find your drugs. Look under the hood. Always let them search your ride. If a dog barks, they can rip your car apart.

@kokoth Actually, an officer needs "Reasonable Suspicion" to conduct a limited search, like getting the vin number, a canine sniff, and patting for weapons. DEPENDING on what you were stopped for, the officer will ask to search, you can refuse, but the officer can still search. If it was something like a tail light out then asking to search your vehicle and you say yes, but not the trunk, and he finds a gun in the trunk then arrests, the case will be invalid because of absent probable cause.

You can always refuse a search, that's your right. However, if there is probable cause that allows an officer to constitutionally search you or your property, you can still voice that you don't consent, although then it won't matter because you don't have the option. Always say you don't consent. Just make sure they know that you don't approve of the search, and don't do anything (drunk driving, etc.) that takes away your right to say "no".

@TaylorGang457 If they can see it without opening the car (through windows, through doors) they can search. Never allow a cop into your home without a warrant. Keep things you want hidden in your trunk or buried under something. I've refused several searches.

I am a police officer and I would not ask to search if I did not already have reasonable suspicion. I don't make a habit of just asking everyone I meet if I can search their vehicle. One of the things we were taught in the academy is, if a person refuses search, that ship has sailed. You can not search after initially refused without probable cause or you risk anything found as a result of that search.

nope. they can say they smell it, either pressure you into spilling, pressure you into giving permission to search; only if anything illegal or incriminating is within plain sight can they search your car. or you have warrants or were driving extremely recklessly. If it's a normal traffic stop, has to be in sight, or you can refuse, then they will call in a search warrant of your car and then search it.

@badasspontiac1: Police usually do not need a warrant to search an automobile. What they do need is the same probable cause needed to bring in front of a judge, who then then decide if there there is enough justification for a warrant. The "vehicle search exemption" simply moves the justification process from before to after the actual search. Not enough probable cause? then anything found during a search cannot be brought up as evidence.

They often do things they aren't allowed to - if you feel you've been treated unlawfully it's up to you to report it afterwards. Cops constantly impede on civilian rights primarily in low-income areas.

@nobleneonstyle You are correct. The more out of line you are, the easier it will be for them. Cops may lie, but they have to base their testimony on SOME truth. Don't get cocky, aggressive, or macho, but remain assertive. Be calm, maintain your composure, and stick to your guns.

they have audio-recording devices on their person, along with video/audio recording cameras in the squad cars. Add onto what they have by having your own devices recording (it is legal in almost every state, check your state law) from your vehicle, and from your person. If a cop assaults you without just cause, this can be the difference between you going to jail for their lies of "they resisted arrest", and you having a case against them while being a free man/woman.

now, in most american cities, marijuan is considered to be a lesser offense. So you will be able to get by with a citation if you cooperate.

@seanpull Actually it wouldn't have put me behind bars. Because he didn't ask me if I had any weapons, just asked if I had alcohol. The handgun is mine and it was unloaded, separate from the ammunition. In Tennessee you can have the handgun/firearm in you vehicle as long as it's in plain sight and unloaded and out of reach. So the only thing I did wrong was covering it up, and I could've just told him I had it open, but it must have got covered. So I made the right choice. I cooperated.

I'm sorry. Researched a little and found out you are correct. He does not need a warrant to search your car, and he can also search your car if you get arrested. He only needs a warrant for your house. Probable cause exists only if the officer has factual evidence (real evidence, supported by facts), a suspicion alone is not enough.

I've been searched once, he found my friends hash. He didn't really care since my friend had a med card. The funny thing is he was a lot more pissed that I was driving a 50 year old car with a registration sticker from 1983, no insurance, no back window, and barely an exhaust. He could have impounded my car, but I got lucky since he ended up being a gear head to. I got off Scott free. I guess not all cops are bad. That or I'm just lucky as hell...

If the dog smells anything though it doesn't matter whether you consent or not they will still by past the 4th amendment the right approach would be to say no "Im not hiding anything from you sir" & not " no sir, I have nothing to hide from you & then say but I do believe as an American in exercising my right to not consent to any searches or seizures, by the way seizures would be patting you down to be nice you could say I don't consent to a search but you may frisk me if you like because unless they feel a gun you wouldn't have to show him & the reason I said I'm not hiding anything is better then my 2nd example is because Its actually admiting some sort of guilt or having a sense of fear after all the 1st two words are "I have" it's like when somebody says i don't KNOW most of the time what they really want to say is "NO"

That's true, even if you don't concent, and they have no probable cause, if they do a simple walk around with a dog and get one hit, that is probable cause for search

Some of them are random. If the police officer has a warrant, then and only then, you will be obliged to let him search your car. I usually accept searches, because it's only me who uses the car, so I know exactly what they will find. But if I would share the car with someone else, saying, my cousin, I wouldn't accept any searches.

The point is that if every one who is asked for consent, refuse to consent to searches, cops won't waste their time on BS stops, and move on, knowing that 1/3 to 1/2 of their workday will be wasted on a routine traffic stop + mebbe nothing else, while waiting for a warrant.

well in most states they make you sign a consent form in order to get your liscence

They need the same amount of probable cause needed to bring to a judge, who would decide if a warrant is necessary. The only change is that the judges decision is moved from before to after the search.

Nah, I've said what I had to say. Only thing I would add is that ignoring a problem, because it's not your own, helps neither the honest cop who gets wrongly grouped in, or the dishonest one get caught. I would also add that, to me, it's more of a systemic problem than a matter of dirty cops. I would hope that you're never submitted to it to find out firsthand. Keep your nose clean and pray you never have to. Peace (yep, that one was to you) :-D
