I covered this story. The cops also tried to say she was under the influence of drugs. They drug tested her. Took a blood test and she was clean on everything. Idk why this was never mentioned in the suit. I covered this story years ago for the news.

Seriously!! I mean it's disgusting what cops are generally allowed to get away with. AND as a side note that I've just been thinking of lately is how ignorance of the law is not an excuse and we can still be found guilty . At the same time cops are afforded Qualified Immunity, where they can be found innocent BECAUSE of their ignorance. How does that make any sense?

They’re college students, and so are the officers, they got a badge and thought it was a “do whatever you want” ticket, and this lawsuit surely is going to remove any future work in law enforcement, if it hasn’t already, the victim can surely find their name and inform their employers or future employers of their assault

@@Minecraftisbeast47 know your rights. New York Times Company V. Sullivan, 1964. You have a RIGHT to speak to GOVERNMENT or PUBLIC OFFICIALS in any legal manner you choose. This includes using language that is "Vehement, caustic and may sometimes include unpleasant personal attacks." If a cop arrests you for getting irrate sue the shit out of their town because they violated your rights. You can address them in any legal manner you choose as long as you don't issue a verbal threat. You can call the pigs etc and if they retaliate they attacked you and violated your rights just fuck them in the ass by fucking the town or city in the ass.

Something tells me that hiring part time college students as police officers as a summer job for credits is a terrible idea. This shouldn't be treated like a part time Burger King gig, being a cop requires a lot of mental maturity that most college kids just dont have.

No, I think it is a great idea since 95% of a cop job on the beach/tourist place is just go around and give warning, tickets and just be ''present'' to keep the peace and order. The real problem is they should be mandated to call a real officer to be present if they want to execute an arrest. This whole situation would of never happened if they called backup for a permanent officer when they decided to arrest her.

Settlements are not an admission of guilt. They are damage control method to prevent possibly multiple times more costly litigation. In this kind of cases, the city has absolutely nothing to win. They can only loose. They assess the situation in strictly financial terms and more often than not a settlement is the best course of action. No matter what's the case, they should never be handled with knee-jerk reactions such as yours.

I'd love to see someone on trial for murder use this as their defence. "Your honour, after a thorough internal investigation, I have concluded that I did not murder that woman. I remand myself into my own custody. Thank you for the court's time." And when the judge calls them out for ridiculousness, they then turn and ask "Oh? So that's ridiculous? The cop who was in here last week said the same damn thing and you let HIM the fuck go!"

I don’t think this is the most fair breakdown of the situation. I do agree that the police officers should have been less aggressive and D-escalated the problem. They also should not have punched her. But she did try to run from police which is really stupid. And she continually mouth off which yes the police also did but in this situation, both of them did awful. Don’t try to spin this into a police are just evil situation. In this case everyone was in the wrong and it would’ve never escalated to the situation if the girl hadn’t of helped it escalate to that point.

That first cop left out a lot of important information information when telling the other cops the real story. That he actually tested her with the breathalyzer and she had no alcohol in her system. He left out a large portion of the truth.

@@keygan3507 closed container and breath analyzer show very clearly she was not drinking. where is your shame? how can you accuse others while being stubborn and blind yourself? nothing they did after initial contact was appropriate and judicial system confirmed it. if damages awarded after encounter of 10 minutes reach over a quarter of million dollars there is something very wrong with that encounter. that is a clear sign that neither of those temp cops is suited for any authority, let alone law enforcement, role. they lied, escalated, used lie to execute unlawful arrest, intimidated an underage girl and assaulted an underage girl. two pretty girls on the beach get harrased by temp cops with authority complex and it turns into a fight where a guy punches an underage girl in the face, several times. how do you defend that, dude, how?

@@krane15 and that is a clear loop that removes all personal reaponsibility. it is a legal "carte blanche". i understand that origin of that practice comes from "thin blue line" and "department policy" mentality where individual would perform actions he may not personaly support but i do find it at origin point of many issues because it, together with "cops do not need to know or follow the law" gambit of quallified immunity, is unique to us law enforcement and just can't happen anywhere else with robust judicial system. if individual can be absolved of consequence in a system where consequence is basis of deterence legal doctrine, how do you keep that individual from breaking the law (que judas priest)...

I'm going through training right now that in part discusses physically restraining people. It should only be used as a last resort because of how traumatizing it is. That girl wasn't doing anything wrong, but bc they escalated it so much, the situation turned into a struggle. When people are being involuntarily restrained, the first thing that happens is panic and fight or flight. I don't blame the girl for freaking out.

It’s because that money doesn’t come out of the department or the officers pockets. It’s come out of tax payer money, we are paying for their “mistakes” against us. Why would they stop and improve themselves if they face no repercussions and even if they do they won’t get charged because of the almighty blanket of qualified immunity.

It seems to me that the reason for this is that cities settle because, regardless of their stance, they see it as better than losing a lawsuit and having to pay much more. The city technically wasn't admitting a "mistake" by settling.

Nevermind that the young lady could very easily have been more cooperative with the officers and had less attitude. Simply agreeing to pour out the alcohol would have been easier. She got caught. Now, during the arrest, did they need to punch her? No. But, from the beginning of the encounter, being intentionally difficult and escalating the situation with just about every action means she should admit that she had some accountability in the incident. Personal accountability is going out the window and the victim mentality kicks in placing blame on everyone else but themselves.

I grew up at the Jersey Shore, a block from the beach. The towns hire these "class two police" who have no training. If they do well they go to the academy. The problem is they are all trying to make a name to get to the academy. So they arrest kids for nothing. It also leads to the security in the area being garbage. Every failed class 2 or people they wouldn't even take ends up in a security job with a chip on their shoulder.

Milwaukee Wisconsin, once known as the "Beer Capital of the World" ... You can't buy alcohol anywhere in Milwaukee after 9PM except in bars. not sure on the justification of that law. If a person wants to just sit at home and enjoy a few drinks in the evening, nope, not unless they bought that beer before 9PM. It's better to drink in public I guess. I'm sure that doesn't lead to more DUI and public intoxication arrests.

Not insane. In the scenario you describe, if that alcohol is not locked up, it would be as highly irresponsible as leaving an unlocked gun in the house with only minors. But then again, your premise is flawed. If you leave minors alone in the house and unsupervised, a crime MAY indeed have been committed, regardless of what is in the house! Social Services could take the kids away DEPENDING ON THE SPECIFIC CIRCUMSTANCES OF THE CASE. While some minors are infants, not all minors are infants. If you can't safely leave your kid home alone for a while starting from roughly 8-10 years old, you have most likely failed as a parent with a few obvious exceptions. You are like those who want all kids taken away from those of a different religion than you because you view any way of raising a kid other than your own preferred way as abuse.

I love how our legal system says you're innocent until proven guilty, but you're always under the presumption of guilt by police until proven innocent in a court of law generally. This makes the law in general a bad joke.

Everything you do is illegal. Say the cop is having a bad day and decides to kick in your door. Do you have prescription drugs? Suspicion of drug possession, charged with ten years in prison. Do you have a firearm? Suspicion of illegal weapon possession, 15 years in prison. Say they illegally pilfer through your electronics. See that one chick, 5'6-5'7 with double D boobs? Like the average porn star on Pornhub? Cop thinks she's just shy of her eighteenth birthday. Suspicion of cheese pizza, charged with five years and lifetime sex offender registration. Make any political posts online? Like say you said something in the heat of the moment you shouldn't have, about Biden or Trump or Elon or Gordon fucking Ramsay out of anger... Something we all do. Cop thinks that it's a threat. Charged with domestic terrorism and you face 25 fucking years in prison. Now say you're wearing a white shirt like the guy who killed someone last night, in fucking Gnome Alaska thousands of miles away. Charged with murder and you face the death penalty. And because it's all out of 'good faith,' the cop gets away with it scott free.

The cop threatened her with being taken down and never said she was under arrest. She was lawfully exercising her right to self defense. She was not resisting an arrest She was fighting off and illegal threat of assault. Just look at the footage. I hope the students got expelled from school.

Yeah even though that's not how the law sees it most of the time. I agree that's how it should be. I think the levels of punishment for even stuff like resisting are too high , I think resisting arrest is a natural human response , people don't want to be locked up it's fight or fight.

I really appreciate the approach of this channel to give a reasonable understanding of both sides of the policing part of the law. Giving both sides a grade on how they respond to each other helps to understand both the burden on police officers and the proper treatment of citizens rights.

I live in NJ and grew up 15 mins from Wildwood. Imagine a state where cops are encouraged to walk around the beach to search for anyone drinking. And then when you prove them you weren’t drinking they look for the next issue to escalate. This wasn’t a rogue cop, this is the mentality of the whole force down there.

Sadly I reside in this horrible state of New Jersey. Where taxes are through the roof and cops in our state are overpaid assholes who have power trips trying to always find something because they pretend that they are doing real police work when they don’t know what real police work is… they get off to hurting and jailing the people who pay their salaries!! They act so tough with guns on their hips knowing that in New Jersey it’s almost impossible for us to have guns… they truly need to be locked in a jail cell with inmates for how they treat their people in their communities and how they are so quick to arrest people. It’s crazy it’s like it makes them feel so good inside. Most cops in New Jersey are pencil pushing scum. I have had enough of it. If this was me I truly would have said to the cop your giving me one more chance for what ?? Your threatening me while you have that gun on your hip your such a real man.. then I would have let him get close to arrest me and I would have put him in headlock. Better yet I think I would have waited till he punched the girl in the head and that’s when I would have grabbed his ear and twisted it… it’s so upsetting knowing New York cops work so much harder are soo much nicer and get paid much less then jersey cops who mostly deal with traffic tickets and domestic fights where they enjoy showing up and taking control and acting all tough… it should have been jersey cops that got killed at that domestic disturbance that happened in New York few weeks ago. God forbid a jersey cop had to deal with that. So to everyone on here New Jersey cops have power trips !!!! They for some reason think they are the law !!!!!! Of course because of the stupid shit government we have here in jersey they are given more leeway meaning we the people need to start stepping up and stepping in because there are more of us then these tough guys. They don't have any authority other than what you allow them to have. They are offering to contract with you; they are doing business. You can ask them, "Are you here to do business for the corporation?" and if they say yes, then respond, "I'm not for hire and I'm not doing business with you." That's it. Repeat if necessary. Statutes are not laws, they are corporate by-laws. There must be a substantial contractual nexus between you and the corporation "STATE OF NEW JERSEY" and/or "CITY OF WILDWOOD" for their statutes to have any force.

I'm not sure about New Jersey law, but in a majority of the country, you are not required to blow into the preliminary breathalyzer. It is optional/voluntary. If you get arrested and taken to the police station however, you have to consent to blowing into the high calibrated blood alcohol machine or be subject to additional charges.

A lot of communities cannot afford $325,000. Preventing such mistakes is not difficult. Years ago I found myself working nights on a pediatric Hem-Onc unit caring for the sickest kids in the hospital apart from the ICUs. My only training was as an EMT, and I got no orientation to the unit. I coped by breaking every decision I made into either of two categories. (1) A decision where I knew what to do. (2) A decision where I did not know what to do. For the second, I asked the nurse I was working with and that moved in from (2) to (1). After I few months I knew that job well. Police departments could adopt a similar policy about arrests. Rookies get told very clearly that if they have any doubt about what to do, they ask someone more senior. And make it clear to them that a single failure to do that will get them fired.

I'm so tired of police officers almost never being held personally accountable for their criminal activity, but instead for taxpayers to be held accountable for their illicit activity. This needs to end. Require police officers to get insurance to cover any legal judgements against their employers for their behavior. And let the insurance companies decide how much each officer needs to pay for insurance, given their training, track record, and other factors. And if the officer can't find an insurance company to insure him or her, then he or she cannot get a job as a police officer. I'm so tired of taxpayers footing the bill for the criminal activities of people who believe that they are above the law.

Going to disagree, these problems are almost always agency problems, and the agencies should be held responsible for poor leadership. At the very least they have poor recruitment and training. Often poor leadership across all levels of the agency because no one is held liable for poor command decisions. For example simply pairing a class 2 officer with a regular full time officer might have prevented this situation. You don't let a probationary officer all on his own, you might give him his own car toward the end, but the FTO is always dispatched with the probbie.

I like the idea of requiring officers to get liability insurance, coupled with required reporting of complaints and incidents. Bad cops would get flushed out because insurance companies wouldn't sell them an affordable policy.

The police didn't do anything wrong... the girl had "constructive" control over the alcohol! There was no adult there, at that time, she was the only person with the alcohol. If her aunt was there it would be different, the aunt cant claim control over the alcohol if shes not there!! She acted like a brat and got treated like one.
