In this episode of ‘Editorial,’ Mr. Sujit Nair discusses the recent remarks made by the Supreme Court of India during the hearing of petitions seeking for 100% verification of Voter Verifiable Paper Audit Trail slips (VVPATs). During the hearing, the Supreme Court directed the Election Commission of India to investigate allegations that extra votes were recorded in favor of the BJP during a mock poll in Kerala. This direction came after Advocate Prashant Bhushan, representing the Association for Democratic Reforms, referred to a report by Manorama Online regarding complaints about EVMs registering additional votes for the BJP in the Kasargod constituency. The bench, led by Justices Sanjiv Khanna and Dipankar Datta, instructed Maninder Singh to look into the matter. The Supreme Court is currently hearing the EVM-VVPAT case, with today being the second day of proceedings. The Election Commission assured the court that the cited news report was inaccurate and committed to submitting a detailed report.

If Congress does a serious introspection and holds a mirror in front, it will know its problems truly. Possibly, many congressmen have done so and known the problem, but who will bell the cat? It is the leadership that is lacking. Rahul is simply not the material and he is not willing to bear the burden any longer. Sonia does not want Congress leadership (and money and power) to go out of her family’s hands. The best chance for Congress to revive and reinvent itself was in PVNR’s period, when he tried to bring in inner-party democracy by holding elections for various office bearers. The Congress leadership does not want to open up the party to true leaders. Till that happens, party will continue to perform badly in the elections for which it will keep blaming EVMs and Owaissis

@@josephdsouza1515 - It was done to ensure that commissioners selected to conduct and supervise elections are of high integrity, independent and fair. That there would be balance between the party in power and the leader of opposition which would ensured by the Chief Justice of India. When the constitution was adopted in 1950, clear cut rules were not framed for the selection of CEC and ECs. The president constituted the commission on the recommendation of the union cabinet. Till Indira Gandhi’s time, the INC regularly got a huge majority and fairness in elections was not a major concern. However, during her tenure, support for the INC began to erode and the election commission began to be increasingly manipulated. Accounts of all kinds of electoral malpractices began to become routine aspect of elections - voter intimidation and suppression, booth capturing, ballot box stuffing, political and communal violence, etc.

We have the highest respect for the Hon’ble Judges of the Supreme Court . At the same time they are not technocrats to analyse the technicalities involved in the machines used in the voting process. The machines used such as the control unit, VVPAT etc in the voting process contain the technicalities . In the machines chips are used which are controlled electrically and electronically. The process’ of loading the name of the candidate, party and the symbol are handled by the outsiders whom they are not under the control the Election Commission. Therefore the parties who are opposing the use of AVM in the process of must be allowed to explain technology involved in the machines and to demonstrate with the help of the technocrats. Similarly the Election Commission must be allowed to demonstrate that there are no possibilities for the misuse or fault or malfunctioning. Only after hearing and supervising the demonstrations run by the technocrats from both sides the court can render a fair and just judicial decisions.

Awesome sir. so far I understand one EC’s lame counter that VVPAT counting take 10-12 days….hence difficult according to them…. Something like TAJ MAHAL. Aaare baba I ask how much time Govt in this country execute its job on time…. Ek Gutter in Juhu takes 3-4 months to be fixed… That’s why we citizens can always wait for 12-20 days for right GOVT to be elected so that we do not want another similar Gutter situation. If the display in VVPAT shows incorrect vote i.e someone presses party X and it shows party Y (due to error mmm..mm) and if the display disappears after 7 seconds how can I make a complain and prove what was displayed is incorrect? there is no way to prove it.

One thing I need to say here as I have been a part of polling parties as the presiding officer in several elections in the state of Tripura. Before the actual poll starts, we have to go through a procedure of mock poll, in which 50 votes are polled, and during this process, votes are cast in favour of all the candidates including NOTA. Once this mock poll is over, the result is calculated on the screen of the Control Unit (CU) of EVM. Then the VVPAT slips are taken out of the box and are manually counted and are tallied with the result seen on the CU. This account is then duly recorded on a Mock Poll form. So, if there would've been any discrepancies in between the result as recorded by the CU and the manual counting of the slips printed by the VVPAT, it would be noticed by the concerned polling party and the polling agents present there, and accordingly, that would be brought into notice of the concerned authorities immediately. So how could there be a question of mismatch between the result recorded by the EVM and the counting of the VVPAT slips, during the actual counting of the Votes? Can a machine do one thing during mock poll and something else during the actual poll?

The EVMs can have firmware designed to swing lead counts for a desired candidate at any point in time of vote casting. It can be after a total of 100 votes, 1000 votes, 10,000 votes or even 1 million votes have been counted . A test of 50 or 100 sample mock vote count is meaningless to validate the machine..

Recently in a mock poll conducted in Kerala's Kasargod district, found defective EVMs. It found that the VVPAT slips produced for 1 vote of each party, BJP candidate got 1 extra slip.. meaning for every 1 vote, BJP got 2 slips.. Just found out the discrepancy in the last two days. It has become a controversial issue in Kerala. If this happened in Kerala where people are more conscious and educated, what is the condition in villages in northern states where people don't understand what's going on, where people are helpless . EVM is the reason why even when people of India in reality started to reject Modi and BJP, Modi still guarentees 400+ seats! HOW🤔🤨🧐

Elections for assembly in Telangana were managed in a different type of manipulation. Where ministers are running companies, they asked the employees to submit their aadhar cards. The electoral rolls were duplicated. While one is polled by the actual voter, the other one is polled by the polling agent who is bribed by the ruling party. A journalist, Mallanna went to PS with all proofs but no action was taken.

1) Germany or many European countries do not use EVM not because its population is too small. Its because they think EVMs can be manipulated. 2) Delay in counting is justified on the condition that we have a free, fair and transparent election. Earlier India conducted Elections on ballot papers and there was no delay. So delay is a stupid argument. Just use more manpower to eliminate delay. 3) In India, where we use party symbols, because we are a 3rd world country, where a simple voter doesnt understand anything about Software, programming or how evm works, Ballot paper is the best and the only option. Ballot paper will ensure democracy remains in India. 4) EVM usage is the source of Dictatorship, thats why some 'elite' sections are so insistent on using EVMs.

A best suggestion is that all the EVM programs should be audited by an expert coding engineering, all the votes should be verified with the printed votes, this will create a greater confidence and build the trust in the voting system. So no one will doubt the system anytime.
