I see what you're saying but nose buttons have been around a long time and he didn't invent it. I took time and CAD designed my own from scratch and made numerous comparable design upgrades. The same could be said for him from the original nose buttons of brass and string. But he spent thousands of dollars to get a patent that only keeps others from competing in the market. It's like the Bowmar peep tuner. He took a product that already existed and made changes and sells it like he invented it. Which is fine, his is a little different, but it's hypocritical to order a cease and Desist for my nose button when he took someone else's design. The only difference is that the other company doesn't have a patent. He is legal, but anti-competitive. I'm sure they know that I don't have the money to hire a lawyer to fight, but I think it's a case I could win, as mine is quite different. Different materials,different design, art, and manufacturing process.

They threatened lawsuit, and I was sued by them for something different. This cease and Desist is basically the precursor to a lawsuit. Functionally it works similar. They asked for all sorts of discovery and wanted all of my sales records and tried to force me to remove my videos. I refused all of that and said I'll just stop selling them even though our products are different. Another situation where it doesn't make sense to hire a lawyer to defend a few hundred dollars in sales.

Yeah they claimed all of the charges were dropped. They actually plead guilty and paid $44k.

You're right. It sucks as a creator, but that is what I am dealing with. I think that the scope also has to be narrow enough that it describes a specific purpose, like all anchoring devices couldn't be included. I wonder if I just market it as a kisser if I could sell it still?

@@ApexPredatorOutdoors hey, I would first check out the patents on those devices scopes. I got a patent on something and the cost, to me was not worth it. You just need to market it as something that isn’t touched by their scope or intent. Like others are saying, he has his own probs now and will need all his finances for fighting his battles. If, in fact he is the poacher, he will be going down.

This one ended up pretty mild.. but unfortunately they are one of big guys money wise. They hired another lawyer to sue me for defamation over another video I did talking about their poaching case in Nebraska. Cost me $6000. That’s more than I have ever earned doing this channel. Thankfully I won’t that one because they withdrew the case for lack of standing.

I have always had my suspicions about their ethics... I made a video about them and the "Under Armour Incident" 2 years ago and in researching it I stood behind them, but was very questioning of their attitudes. Apparently when it happened Sara went off and started all sorts of shit and turned a lot of people off.

Go tell them on their Instagram! He is saying all charges dismissed. Yes some were but he says conspiracy was charged, But then he blames the lease owner!! (He was sentenced to jail I think..)

On their Bowmar Bowhunting Instagram they claim only that all charges were dismissed. Check out my community tab on the channel, I posted a pic of the legal documents as well as comments from them stating that they didn't want three of the deer back because they were too small. What a douche.

Yea, after many years away from hunting and recently returning... I got caught up watching some of their videos without realizing who they really were... I did catch a weird vibe pretty fast and searched to see if there was dirt on them...which I found. I do ALOT of target shooting and have been since 2016, and I have looked at their products from time to time... I even have some of their draw stops for an old PSE... Glad I know more about the people behind the products now.... I hate people that drag shooting sports and hunting through the mud. We are not a big enough group to have our "influencers" acting like fools.

I'm okay with hunting and taking a trophy but In my eyes the meat should be the first trophy. I hunt mainly for sustenance, but a nice trophy to remember the time and effort and struggle is always appreciated. The way Josh said in his Instagram post that he didn't care if he got the deer back because they were too small to mount was so disrespectful to the animal and gives hunters a bad name as conservationists. Despite taking the lives of the animals for food, I care about the long time survival of the animals ( and hunting plays in that) and only taking what I plan on using. The Bowmars obviously do not.

@@laylow8967 Thanks man! That's the problem in order to fight this I would have to have been making way more money to justify a lawsuit. I had lots of internet lawyers tell me that there was not much I could do without going to court. All in all I had only net about 300 dollars on these, but what hurts is that I can't give people these as an alternative to the Bowmar spike strip (as I call it). I'll redesign and come back stronger through!

It's not a copy at all. It's a vast improvement. My customers agree. It's also very different. The Bowmar's design is based on a product that has been around for decades. They were just the only ones to patent it. I figured my product was different enough to avoid the patent, and probably is, but I can't afford a lawyer to fight it.
