Continuing on with the new house series ... I was hoping to be able to share some moving dates and plans this week but as you will hear still nothing is happening. Something positive might happen next week but I'm not getting my hopes up, I think we've just about run out of time to make this happen in 2021 now :(
A couple of things I forgot to mention with putting your name down on a new house:
Sometimes builders will do a part exchange where they will actually buy your old house off you. They don't like to do that though and tend to only offer it on 'selected plots' (usually ones they are struggling to sell), plus they will need a minimum different in cost such as +40% and will also underpay for your house (typically ~92% of market value). I don't think this is very common any more as demand is so high they don't really need to bother.
The other things that some builders will do it a help-to-sell type of scheme where they will help you to sell your house. This typically involves coming up with what they will term an 'aggressive marketing strategy' which is designed to get the house sold in some short agreed period e.g. 6 weeks. Again this basically means selling your house for under market value, being prepared to accept low offers, reducing the price regularly etc. until it's sold.
It's quite a minefield really which I've ended up being part of even though I'm not the one buying the brand new house.

Despite all bad things that has happened you are doing what’s most important, not keeping it internal but instead communicating. You will get through this! Hope you have some ways to let off some steam. For me it’s exercising outdoor and listen to music. All the best and thanks for the update!

Definitely share your pain with us! I like hearing about your life and the differences in cultures (I'm American). I also work in tech so that's interesting to learn you are too! I always wondered what you did for your 'real' gig or if leatherworking was full-time. Hope you get news on the house soon so at least you can have a date and a light at the end of the tunnel!

Thanks for the update, do use the estate agents to get updates as well as via solicitors, the EA gets paid a fee so they can do some work to earn it & exert some pressure & get some updates.

I’m so glad you have a beautiful place to walk and get out of the house! So sorry for this crud with the purchase, hopefully your new house is well worth it. Here in USA we can get stuck in the same situation, its called a contingency sale. Happens in areas with a really tight housing market (meaning places with few available properties). Please take care of yourself, even though your boxed up be as comfortable as possible and if you celebrate Christmas or another holiday soon, enjoy your regular traditions. Remember, this too shall pass.

Solicitors are as amoral as politicians. Money is their God and your situation is par for the course for them. You will learn a lot from this and as others have commented, you will get through this. Try to keep relaxed, too much stress can create very long term serious illness. Good luck mate.

I was call away back now, that is tough, easy to say but if you can turn a negertive into a positive, treat yourself break open the min pieces early and say oh below it or something like that :) At the moment it's hard with the way the world is. Hate to hear your still not getting to move. I can understand the lack of communication frustrating. Are you already paying on the new place or does that start once you move in? Kinda enjoyed the walking and talking video with you showing the area around you. It's beautiful area.

Sorry to hear about your house delays. Settlements on houses are never fun but it seems under current conditions it really is onerous for you. It could always depend upon the contract contingencies but here in the US you usually could get out of contract if the seller can't settle within a certain time. Seems you as a buyer in Great Britain unfortunately get involved in the sellers problems. Good luck and hang in there. Stay safe.

I definitely feel for you brother, I have a question. Doesn't it say somewhere in the contract that the people who sold their house to you have to be out by a specific date ?

No, because the building company refused to put such a date into their contract they also refused to put such a date into my contract. Again it comes back to the same problem, if I had insisted on that and they had refused I would have just been in the same position where my choice would have been to either put up with it or walk away. With hindsight I would have tried to get something put in place but of course nobody ever thought at the time it was going to go on this long!

Your solicitor should have advised you not to exchange contracts without a completion date - years ago a two week wait was expected, but now this usually happens on the same day... Good luck getting back in the workshop asap!

if I hadn't exchanged it would have fallen through, as I explained in the video they wouldn't have then been in a position to keep the reservation on their house

As a retired estate agent, I used to get so frustrated with the British conveyancing system, its so antiquated and needs updating. On top of that, you've got some solicitors that take on so much work and are busy trying to keep all the plates spinning at once rather than concentrating on getting exchange and completion finalized. I suppose in your case being that its a new build there are complicating factors involved. Shame is, that both buyer and seller want the process to happen as soon as possible.

Silence is the new norm, its disrespectful but its easier for them when they have nothing to tell you. WE see that same thing here in the states. People that dont want confrontation they just give the silent treatment. Its bad but when it happens to them they dont like it. thats the problem.

Brother Ian I'm so sorry to read of your troubles. Forgive my ignorance of this type of situation. But it seems this system affects three (or more) households from moving and getting on with their lives: You (obviously) then the seller from vacating your new home. Then the buyer of the home you are trying to move from?

Ian is lucky that he is not selling his house until he has moved into the new one (I asked in a previous video) so its him > his sellers > the building firm involved.

If you’ve not exchanged contracts yet you can walk away. I’d threaten to walk unless you exchange and set a date. If they can’t meet that date they can rent in the meantime until their house is ready. If you’ve exchanged contracts then a completion date must have been set which surely they are now in breach of and your solicitor at a minimum can charge them interest.

contracts were done months ago, they contain notice of completion only (which is what I'm waiting for) not an actual completion date which seems to be how new builds work. Unfortunately that means once they're exchanged the builders hold all the cards and since it's not me dealing with the builders there's very little that I can do other than wait.

@@Leodis.Leather I think you need to talk to your solicitor. Notice of completion usually means you will exchange and complete within a set number of days if the new build being signed off. You don’t exchange contracts before the new build is complete which means you should threaten to walk away.

you do exchange contracts before the new build is complete because if you don't then the people moving into the new build don't have a guaranteed sale, this means that they don't get to reserve their house. Builders won't leave your name against a new build plot if you have a buyer for your own house who could just walk away at any point, they would take your name off it and sell it to someone else.

Have you explained this to your solicitor?

I'm sorry to hear this.....but I'm confused. I live in the Uk and I've bought and sold 23 houses. Some have been brand new and some had my buyers buying brand new. I'm not aware of any situation where you could be in a fix like this. Assuming you gave an ultimatum to your seller and buyer prior to committing I don't see how this happens. Normally you commit subject to other parties contracts being in place. I wish you well but it sounds like your solicitor dropped a clanger.

we tried to get various things agreed (deadlines, long stop dates etc.) all were refused so it was a case of either walk away or wait and I chose to wait because I was a long way down the path by that point anyway.

There are shortages of certain building supplies at the moment in the UK, this is having a knock on effect for anyone stuck in a chain that involves a new build. Ian’s solicitor hasn’t done anything wrong, it’s just the 2021Covid and Brexit clusterf*ck.

Yes this is the problem, they wouldn't agree to any hard dates earlier in the year citing the building industry challenges. They are the ones holding all the cards, you either dance to their tune or walk away and they just sell to someone else. With hindsight if I'd known how long it was actually going to be I probably wouldn't have put up with it but I had no idea at the time.

I'm taking my share of your pain, honest, but just trying to get a grin at least. There's not much else to say except that your Tubers are all probably trying to do the Jedi Mind Trick on everyone delaying things. Keep on, fella, you'll do it. :)
