Yeah it doesn't make sense. There are a few celebrities that obviously have work done (the Ks, Ariana Grande, etc) and also had a leg up and really aren't fooling anyone except the most vulnerable folks who they can then profit from, and it's really kinda gross. Because it's not even going to cost them much to be real, it just limits the huge amounts of money they are making by a slight amount.

Right! It’s so simple! It’s literally a hashtag and 2 letters! And it’s not like most people who might have purchased an item they’re promoting will be less likely if they see it’s an ad. Personally, whenever I see posts from celebrities especially, but even bigger influencers, I just always treat it as if they’re doing it as an ad or because they work with the brand and want to keep working with them and think posting about them will help or whatever.

I think that ignorance of the law is no excuse especially for celebs who have the dosh to hire lawyers. Influencers have made up ways to communicate gifts and sponsorships so their audience knows, but that does not mean it's within the prescribed language of the laws around advertising.

I found it really interesting! I'm not sure if this would be riveting to other people but I would like to know more about those people that show up in ads for a skincare product that then subsequently show up in other ads. For instance there is this woman who has been doing an ad for that needleless serum but I saw her face in another ad for some other skin care product. I wish I could remember what it was. How am I supposed to believe that the needleless serum is doing such great work when she is saying some other product is giving her glowing skin? It would be different if she wasn't one of these regular people type of "models". Do you get what I'm saying?

As someone who spends way too much time reading FTC direction for influencers, the #AD being at the end of the post isn't just sneaky, it's as good as undisclosed to them. The way that the human eye interacts with social media (especially with the added click of a "see more") puts the onus on the user to investigate to find something is an ad. The FTC's position is that the influencer must take responsibility to go above and beyond in clarity. Otherwise, the user will likely not see it, making it undisclosed in practice.

I guess in my opinion, the #AD over #sponsored thing is probably just to standardise the way people disclose ads. If they started making exceptions for #sponsored then perhaps people could start using different hashtags (like the #sp for example) and use the argument that it’s basically the same thing. If they HAVE to use #AD there’s no way of getting around it.

On top of that sponsored can mean that you weren't paid but still had to do an ad due to other reasons, such as you agreed to do an ad for free product. If the product is cheap enough it might not fall into the realm of ad. If I got a free face cream that has a retail of less than $100 but I only got it in return for posting about it with an honest opinion, I'd acknowledge that I got the product for free and I'd consider it sponsored. Meanwhile, ads are also sponsorships, but I'd say that a sponsorship is more broad and covers things that may not meet the legal definition for an ad.

My personal opinion is to always assume that if a brand is specifically mentioned or featured, it's an advertisement. Whether they were paid to say it or not doesn't actually make a difference to me, because for whatever reason, they have their own ulterior motives by posting about a specific brand. If you're skeptical about everything you come across like that and ensure you do your own research into it, you can generally find out if someone has deceptive advertising practices. The truth is you can't know if they don't say. So just assume it's an ad, and take what they say with a grain of salt. If you know someone in real life, know they use it, can see the results or whatever, then you can generally trust that. Social media is inherently untrustworthy since for 99% of it, you're only seeing the absolute best of someone's life or experience. Just my two cents. =)

What’s the difference between Ad, Sponsored, PR, Gifted. Ad / Sponsored - going by the ASA and my half a decade long career (👴🏼) working with influencers and as an influencer, these two terms are interchangeable / mean the same thing. A brand has sponsored the content you posted with money, in exchange, the influencer will advertise the brands products, therefore it is an advert. Gifted / PR - I find this is down to the influencer but really they mean the same thing. A brands PR department has sent out their products to an influencer as a gift. This means there is no verbal or written contract or any obligation to post / discuss the product. You’ll find most influencers really only talk about these products if they love them or they’ll get added to the giveaway pile 😜 Often brands will send gifting / PR without warning or on the rare occasion a brand will ask if the influencer is happy to receive gifting. But usually once a brand / agency has your address, they will send products when they hope for some free advertising

To offer another side, I think it's worth remembering that social media is not the only place this happens, and I think sometimes people can hold individuals to account when companies have been doing it forever. I read a magazine yesterday, and there was so much secret Chanel content in different parts of it that it was clear there had been a list of requirements from them in order for the magazine to be able to feature them. The make up artist who did the beauty article was a Chanel employee and used their products, the columnist said her ABSOLUTE FAVOURITE product this month was a Chanel moisturiser, product of the month was Chanel, the cover star was a Chanel ambassador, every article and fashion shoot had a Chanel piece in there somewhere, or it was mentioned in passing. It's sneakier and way more subliminal than a lot of celebrities who don't make it a secret that they're using a product because they're being paid or gifted, or even if they neglect to mention it. Every red carpet event, every tv appearance, even tv shows and films and product placement. I think the outrage has come since influencers hit the scene, so it feels as if they're taking the flack for something that's been going on for decades. When you watch the fashion section of This Morning, those clothes are not there by coincidence.

the sponsorship/ad wording thing can seem a little nitpicky, I thought so too at first. But then thinking it over a bit, I think the FTC is going for the lowest level of experience/understanding. Those who have been around social media a while know that sponsored and ad can be basically interchanged, but someone young and just starting out, or just doesn't grasp what "sponsored" is, can understand AD better. There's a lot of variables in people's understanding of concepts, they want to make it as simple/clear as possible to as many as possible.

Also older people, as my grandmother has an Amazon Kindle and she has bought so many products that me or my mom had to send back or just tell her not to buy it again. Specifically one weight loss pill that I thankfully found before my grandma could take it and when I looked it up, it is known for causing Kidney Failure and we have Kidney Disease in our family. She doesn't use instagram or tiktok (though she has seen them before because she clicks on links), but she does have Facebook and she found the weight loss pills from a person that advertised it on FB. I have no idea how she found this woman, but I guess she was a fitness enthusiast and when I checked, she said said she loved this "miracle pill" and that it helped her loose weight really fast, but never said it was an ad.

When I see #sponsored, I don't immediately think the person is paid for that post. I might think they were gifted the products. I definitely understand the idea is to sell me something regardless, so I guess that's the main takeaway.

Gifted and sponsored are different things to me, but if you follow a lot of influencers your perspective makes a lot of sense. Everyone I follow actually honors that differentiation so I never worry if they’re being honest, but your way def protects consumers better.

Logically, I understand the difference but I rarely stop to think if they've been paid to post it or not. I just lump them both into the category of "be wary". If I know the brand is involved in the post, then I know I would want to seek out other unsponsored/not gifted content to get a more "balanced" opinion if I'm interested in the product.

@@canwatchvideos essentially, I just approach all sponsored/gifted segments as the influencer trying to sell me on something and that they are speaking on it because it benefits them. Even if money wasn't exchanged and the product was gifted, a positive review (even if honest) could still benefit the influencer. Maybe they could get a future sponsor deal. So I treat all that info the same. I listen to it, and if anything catches my eye, I look at other posts/videos/articles that are not sponsored to see what the consensus is when the product's company is not directly involved. Basically, I don't think of it in terms of "sponsored" or "gifted" but "biased" or "sales pitch".

As a layman, I always saw a difference between Sponsored and Ad. When someone hashtagged Sponsored I always assumed the brand had sponsored them to use the product ie; they’ve just sent the product to the person but they HAD to do a post about it. Hashtagging AD is a lot more straight to the point and I know it’s definitely an ad then and nobody is getting confused.

I appreciate seeing # ad at the beginning of posts, it lets me know how real it is to a person. Interestingly, in Korea celebrities just dont talk about brands and when they accidentally drop a brand name it results in an instant "oops" moment. Also any bottled water or soda seen on a show or stream is usually taped up to hide the brand. Even people with brand labels on their clothing have the brands censored.

I love these videos. Such a good way to kind of branch out while still catering to your core audience. I understand ignorance, but the year is 2022, and I think we all know how the influencer biz works. People have been making money this way for over a decade, so it's not like they're admitting to some huge shameful secret when they're disclosing ads. I already know this is the way you make money, so I want the people I follow to just be upfront about this stuff. I'm way more likely to be interested in the product if the influencer doesn't lie to me.

I am astounded by the horrible, OBVIOUS filters these BEAUTIFUL women like Shea and Lisa utilize. On one hand, yes they are ludicrous and deceptive. On the other hand, when women this gorgeous feel they need to use strong filters, it's a glaring comment on how much pressure society puts on women to look "perfect." Aside from this, just WHY do certain groups of people think the rules do not apply to them. Some people have way too many warnings, but no real repercussions. It's time to do something besides monitor and mention. The companies and celebs should both be fined... I must low key mention the possibility of politics being involved in America. The Kardashians may be an obvious example of this...

I've spoken to a lot of people who assume that if it doesn't say ad then it's not an ad because they know the law requires it. Not realising that these influencers are actually breaking the law! The people I have spoken to about it aren't really into the KZfaq beauty community and don't follow people who call out these issues so are unaware of how much it happens! I'm glad it's being taken seriously now because a lot of people buy this stuff trusting it's good and actually have just wasted their money and lined the influencers pockets 🙈

I always forget how slimy influencers/celebs can be. I recognized that in the early days of KZfaq when undisclosed ads and sponsorships were literally the standard and pivoted to following only people who honor the differentiation between gifted and sponsorships. It’s been so long and I’ve insulated myself so well that I don’t have to question the honesty of the people I follow. I shouldn’t be surprised how bad it is, but I guess it is what it is. I agree with you. #Ad should be at the beginning because of the "Read more" thing. #Sponsored is being pedantic because, as you said, we all know what spon means. I also don't think it should be considered an "ad" if the celeb is just posting about a service they paid for and loved. That's no different to me tagging a clothing company I love after buying things from them. If it's not an ad when I do it then it isn't when a celeb does it (obvs their influence means the post has a different impact but it still isn't a legitimate ad). I'm potentially over cautious when looking for undisclosed sponsorships. I see a logo/brand tag in the photo, I assume a spon or some sort of relationship. I think it's usually pretty obvious.

I’ve realized after watching this that the people I follow (like you and Robert!) are all honest and upfront about everything they do. I think subconsciously I was picking up dishonesty and wouldn’t put up with it. The problem is that if you have a bunch of hashtags and you save #AD for the very end, most people won't see it. I think most people rarely click to see all the hastags on a post so if it's cut off, it's almost as bad as it not being there. They could do something like coordinate with Instagram so that insta could automatically put #AD first if it's detected in the hashtags for any posts

FTC guidelines also require the disclosure of a personal or family relationship with a brand or business when endorsing a product. It states that "tags, likes, pins, and similar ways of showing you like a brand or product are endorsements." So, I think that's why a some of these were listed

I think a lot of people see the word ‘ad’ and just scroll past because they don’t trust it, so in that sense I kinda get why the sponsors/posters don’t want to put it at the beginning at the post - but that doesn’t make it okay tho! Because of a lot of people, in my opinion, do such a bad job at tagging #ad or in any other way disclose it I’m always so skeptical scrolling through social media. There are people I trust because they constantly are very clear when it’s an ad or not. When it comes to services I’m even more skeptical! Because I don’t know if there was any money involved. But I feel like if they have an agreement like “Company do this for influencer, and influencer post about it” they should say it in some way? How do I know they genuinely like the company’s service?

Personally I feel like hashtagging Sponsored is enough, but also prefer if someone just writes ad. I think both of those work as long as it's clearly visible and not hidden in a wall of text or among 50 other hashtags 😅 Writing (brand)partner really isn't enough though, cause you can partner with a brand without them sponsoring every post so it's not really clear what it means 🤔 Also those made up SP or whatever hashtags are just BS

Hey James! So I've worked in customer facing industries for 4 years now and you really have to dumb things down for a lot of people. You can have the largest sign and the most obvious signs put up and people still manage to not see it. That's how dense some people can be. So to me, as much as it pains me to say, the FTC is not nitpicking but really having this demographic in mind.

In Germany you’re supposed to tag any photo with a logo showing as an ad bc technically you’re promoting them just by wearing or showing it

I wonder if they are picky about #ad vs #sponsored because they are using some digital tool to scan for these things? But I would imagine that in the year 2022 we could scan for multiple things with sophisticated parameters instead of solely relying on human review as a first step.

In the US there is still a little bit of left over stigma from the time when true *stars* didn’t do ads. (At least not in the US.) Doing ads implied a lack of extreme wealth. This is definitely changing due to the “get your bag” mentality, but once people reach a certain level of fame it can still be seen as not being A-level. (It’s all so stupid)

Personally think there should be a distinction and proper use of the term "ad" and "sponsored". To me (and the actual difference between the terms) is that a sponsorship would be similar to a partnership so there would be a deeper relationship and potentially money involved (although I know this isn't always the case). I would also be more likely to pay attention to a sponsorship as a person would be more likely to lie or hype up the product or claims so that they could potentially work more. So maybe doing really well on a sponsored post may lead to a long term deal, or being invited places or even working with the brand on a product or line. Whereas an ad to me is more of a one-and-done sort of thing so less effort would maybe go in to being deceiving. Idk if this all made sense once written out but to me, there should be a very clear distinction and use of the two terms.

It's important to remember the FTC is making standards as a US government organization, and some parts of the US have the education budgets of a peanut, so they are trying to make it so even someone with 0 critical thinking skills or education or knowledge of the world could stumble on a post and still instantly understand it was an ad.

I like how you explain this stuff, all the legal stuff. I do see #ad a lot more now which is good, but definitely a few common culprits who I just unfollow now a days. I don't see the point when the majority of posts are sponsored, we want to follow the people not their ads

I will never understand how these stars don’t just slap a hash tagged “AD” on their sponsored posts, when my mum, my dear old mum who I introduced to IG less than a year ago and is now a very active part of an international community of crafters (she’s an arts and crafts teacher), will clearly(!) tag every single post and story if an item or pattern is sponsored. My mum is 59, she doesn’t even have Facebook, but she learned within bloody days how to properly tag her reviews.

I assume if there's only one brand or one product mentioned then it's probably an ad for the product. That's not always true but if you see an influencer/celebrity wearing a full outfit with pieces from different brands, plus a full makeup look, accessories, and they list everything they used it's probably not a paid ad.

Personally, if I see “sponsored” I’m going to assume they’re paid. I mean even just playing sports in school, I know if my team was “sponsored” by a local business or something that the team was getting money from them and we had the brand logo on uniforms. I feel that’s common enough knowledge.

I think #ad/#sponsored needs to be at the beginning of the post. I also think this about like the Amazon finds videos on tiktok by people who aren’t necessarily influencers. I saw a KZfaq video of TikTok Amazon finds compilations that posted the links and stared the affiliate links of the KZfaqrs, even though they didn’t originally make any of the tiktoks. Mad respect for that!

To me, gifted, sponsored and ads are like three levels of advertisement. Gifted means the person got sent products without any message to post about it, but they still did nontheless. Sponsored means products + task to post about it and ad then means products + money + task to post about it. So yes, I do see a difference in writing sponsored as compared to ad. Just like athletes get sponsord by companies, usually getting fitted with clothing and stuff, without getting paid, because that‘s what the championships are for.
