On January 12, 2024. Officers from the Lake Geneva Police Department responded to the report of a woman passed out in her vehicle at an intersection. Officers made contact with the driver who was not responsive but was breathing. The Fire Department was called and she was transported to the hospital where officers were able to speak with her before taking her to jail. The driver was charged with “Operating While Intoxicated (5th Offense)” She was sentenced to 3 years in jail, 3 months of probation, her driver's license will be revoked for 36 months, and she owes $8,939 in fines.

@@kikki1386Agreed, it should never have even been allowed to get to two, let alone five. There absolutely should be zero tolerance: you drive drunk once, that’s it, you’re banned. If that was actually rigorously enforced maybe people wouldn’t drink and drive. Unfortunately being able to drive a vehicle appears to be considered a universal human right in America, not a privilege. Even after you’ve repeatedly demonstrated that you actively want to risk other people’s lives by driving whilst intoxicated, for some reason, society believes that you should still be given yet another chance to kill innocent road users. Madness.

Here in Wisconsin, most first offense OWIs are not a criminal matter. Most first offense OWIs in Wisconsin are civil matters, serious traffic violations. Second and third offense OWI is a misdemeanor. At fourth offense OWI becomes a felony. Sadly, some just don't get the message. Repeat offenders, and some first offenders, are supposed to have ignition interlock systems installed in their cars. Somehow, this does not always happen.

Try sentencing her to have the blow device on her car before it starts. That way the car doesn't move if alcohol present. Removing license they just drive illegally.

The Wisconsin legislature is controlled by the GOP. They have a super majority in the senate and are one seat shy of the same in the house. They take a lot of money from the tavern league. While only about 10% to 15% of Americans are alcoholics, they represent 50% of alcohol sales. We could EASILY pass a law that would prohibit 4th and 5th offense Drunk drivers from consuming alcohol. Just put a different color backround on ID pictures. EVERYONE gets carded. Make it a crime to give alcohol to people with that restriction. BUT........the tavern league gives the GOP lots of money......If money is speech, how can speech be free ?

It is a felony. She got 3 years in jail and 2 years probation. She should lose her privilege to drink. More often than not that is a condition of probation or parole.

I do Uber, and in my state MA I drove someone who said he had to give up his license after 3 DUI's. He said the RMV came to his house to do a driving test in which he failed; I had no idea that it was to that level. He said his 3rd was the worst where he had a horrible accident but no one was hurt. So they revoked his license and it was converted into an ID because the conditions they gave him were too immense.

I wish I had footage of my one and only DWI. Drank 19 beers, drank a pint of whiskey and smoked a bowl, drove 12 miles,made it 2 miles from home, then went to make a u turn to return to town to buy something from someone apparently, and went off the road and passed out. I remember nothing it was total autopilot for 8 hours. I came to at 4am, in the police station, 6 hours after the accident. I've never been able to see how bad I really was,and I wish I could publish it to show people the dangers of drinking and driving. I'm 5 1/2 years alcohol free today.

Seventeen years ~ good for you! I grew up with overwhelming addiction in my family. It took the lives of a few too soon, families were destroyed and it caused so much pain for everyone. I made the decision to take a different path. The disease of drug and alcohol addiction was not continuing with me. I never drank or took drugs or even smoked. I saw my (step)dad sober for over 30 years until he passed away. I was so proud of him. Keep up the good work! 😊

Just no remorse or even concern at all for putting everyone else on the road at risk after a FIFTH offense. At what point can we just force them to release all vehicles they own through sales or otherwise, blacklist them from ever purchasing a vehicle and permanently revoke the privilege to drive?

This is Jo-Ann's 5th DUI. The prosecutors and judges love allowing drunk drivers to be released immediately so they can continue their drunken binge and driving and endangering all citizens throughout the country with their drunken driving skills. Joanne will once again be released from her DUI for her sixth time with no accountability so she can go get drunk again get and her car and repeat her performance. She knows the whole routine she knows Larry's towing she knows the police station she'll go to to go through the paperwork all for nothing. Just a process for the prosecutors and judges to show that they were 'doing something's. It's pathetic and depraved what the court system is doing.

Thing is, we can't. It's sadly part of the illness. Everyone and everything in our lives are negatively impacted, especially other people. Some even die because of it, even before we do. When my hubby said he'd divorce me, I got sober. That was after 3 arrests for prescription fraud & loss of employment. Addicts are the most selfish lot you'll ever meet. Poor me. Poor ME! Pour me another drink.

Wisconsin lawmakers have considered confiscating vehicles of repeat OWI offenders. However, there's a problem. How will a wife, girlfriend, or partner get to work if they already share a car. What about driving kids to/from school, music/dance lessons, sports, etc? If the driver is single and lives alone, then the idea might work.

I really don't think not having a license will stop her from driving, she's obviously not too bothered about breaking the law with 5 previous DUI's. She most likely will not serve the full 3 years either so in my opinion the punishment for driving drunk should be harsher but it's sad to say alot of the time the "authorities" don't do much until they eventually kill someone. I understand addiction but the DUI is a different matter and can't be blamed on it because it would be really easy to not have a car then there's no way of driving drunk. Being an alcoholic means she's never in a condition to drive so there's no reason to have one but I understand tis is all just my opinion and others may not agree.

@@killercat5231 I certainly agree. And yes, addiction is a terrible thing but keep it off the roads. I have zero sympathy for anyone drinking and driving but, as you say, someone like this is never capable of driving. I suppose part of the problem is simply enforcement. Many people seem to just drive without a licence (or insurance) and hope they won't get caught.

A friend of our family lost her son to a drunk driver in the late 70s. It was the guy’s 10 DUI and his license had been permanently revoked after his 7th which had also resulted in a fatality. I don’t know what he got for first DUI death but the second only got him 5-7 years.

Her sentence was definitely justice served - 3yrs in prison, upon being released 3months probation, 3yrs license revoked (36months) and $8,900 in fines. Crime doesn't pay

😮😮😮 In Canada, there are only 3 chances then one loses their license for life. I think the strictest place is Alberta, I think it’s only 2 strikes than your license is gone forever! 😮

It takes someone being seriously injured or KILLED for judges to take dui's seriously and it's absolutely ridiculous and is way overdue for change, much harsher punishments even on the first offense and worse the more you get😒 🙄

Three years in jail and driver's license revoked for 36 months...the revocation is the same as the time she'll be spending in jail so it's not a punishment at all.

3 years in jail for 5th offense....I mean, it's a good start but I think it should be 3 years for a first offense and then it triples for each offense afterwards.

I disagree, 3 years for a first offense is harsh. Yes, after your first there needs to be harsher consequences. Judges need to stop dismissing DUI cases as well.

She needs to be mandated to take Campral or Antabuse and have her license permanently revoked. Maybe an ankle monitor that she has to video call every time she gets in a car to confirm that she has a driver.

After 5 DUIs she's clearly an old pro at the getting arrested thing and is taking her 6th time in stride. That doesn't speak well for the odds of her quitting booze anytime soon, unfortunately. I can only hope she doesn't injure or kill herself or anyone else.

Pardon me but HOW is this level of irresponsibility and knowingly putting lives in danger any different than felony manslaughter and/or murder? A DUI is a misdemeanor, yet drunk drivers, last I checked, take the lives of an estimated 11,000 innocent lives each year. And we just keep on issuing citations and playing the probation game. Honestly, I vote for changing the law to make it a felony offense to drink and drive. MAYBE things would change if the laws actually had some teeth!
