As of October, 2021, New Jersey has introduced a brand new cottage food law.

In this video, I'm going to go over what you can sell, where and how much. Cottage food producers must apply for a permit and complete a food safety managers training course. Orders must be picked up or delivered in person, which is kind of unique and a little bit of a challenge. Delivery in home pickup is allowed the types of delivery services for the product.
You can't use third-party delivery services like Uber or something like that. Starting a cottage food business out of your kitchen can save you a lot of money, Damon says. You can sell bagels, brownies, tortillas, cakes, breads donuts, cupcakes, cake pops, biscuits, scones, wedding cakes, even wedding cakes. New Jersey's cottage food law has a lot of similarities to other cottage food states. Items that are time or temperature sensitive like meat, meat.
Those are items that I'd have to be kept at a certain temperature, or I have a certain time window of freshness. New Jersey adopted new cottage food laws in 2014. You have to apply for permit and take food safety management training. Water source, if you're using a private well, that water source has to be tested as well. Labeling is required for all products sold under new Jersey's cottage food law.
The most important part of the label is the statement of declaration. This means that your product is being made in a facility that is not being inspected very important, that people who are purchasing your product under cottage food know it's from you. You can create an LLC in New Jersey online for about 10 to 15 minutes. Limited liability corporation filing will eliminate the responsibility or the liability from your personal life. And you personally won't be liable for any litigation or legal issues that comes up with food business.

Cool info! Been thinking of making and selling caramels at farmers markets! Kinda sucks I can’t sell it through a few mom and pop stores but if I get it just right and I see it doing well I guess I could use the local firehouses kitchen since it’s certified and make it an official business

well there is a way not "around" this BUT you can start at home and bring samples to retailers you would like to sell to with a sell sheet and then get Purchase orders and use a commercial ONLY to fill those orders.

Also what permits do I need if I wanted to occasionally "pop up" at a park that already has bbqgrills or if I brought my own and started barbecuing and selling that food is that even possible I see people do it... Already checked into it. The cheapest option for that is a food truck. You cant sell meat from just a grill. U need prep tables, washing station all that. It sucks.

great idea micro greens are HUGELY profitable I have not seen anything saying you cant sell these from home under cottage BUT I have also not seen anything saying you can ? So I would call your local department of agriculture office they have offices in every state ask them how you could do this from home

@@barbra429 your question is from a year ago when you likely have the answer but for anybody else reading your question now what he’s saying is cream cheese frosting needs to be temperature controlled to stay safe (it needs to be refrigerated) so you cannot sell cream cheese frosting. Other types of frostings when left out of the fridge won’t become a health hazard.

The title “is it legal just sell food from home in New Jersey” It’s very misleading. Your video is about the Cottage food law, which only covers foods that don’t require temperature control (Baked goods, breads, snacks, etc.).

unfortunately no due to the time and temp sensitivity of the food product you would need a commercial kitchen of some kind to make these. They see it as potentially hazardous food products
