This is actually a pretty good method of Judge Judy to gauge the intelligence of the boy. It showed her that he not only understands the difference between the truth and a lie, but also all the things that are written between the lines that are subtext, like that you compliment a judge who is a person of power with a lie. The boy is indeed smart.

@MsYasami6 ай бұрын
@@zareien2290So this boy would not be a good witness, bc he lies to male other people happy, right?
@zareien22906 ай бұрын
@@MsYasami no. You are mixing up three things here. 1. Whether someone knows the difference between truth and lie 2. Whether someone understands manufactured complex social situations 3. Whether someone shows a tendency to be intentionally dishonest. The questions that she asks up until (but not including) the last one, are designed to see that he factually knows what a lie is. He passed those. That is the actual recommended test for determining whether a child (or impaired adult) has an understanding of #1. If you do not have an understanding of #1, then you are rendered incompetent to give sworn testimony, the judge CANNOT swear you in. Her last question actually shows that the child has a strong reasoning ability. He understands social interaction. This shows #2. This is not relevant for any legal test. Nothing in the interaction indicates that he is intentionally deceptive, because he UNDERSTOOD what was happening in that trap question. He understood that it's a joke. This does not make him an unreliable witness. Regardless, unreliability as a witness needs to be shown in relation to the facts of the case, not some random trap question by the judge

@garyoldham44497 ай бұрын
@@Gemna157 It's normal for people to recognize handsome and beautiful. There are different angles. It _could_ be creepy. Or it could be recognition that people have an advantage in life if they have good looks. My first thought was to comment, beauty is only skin deep. Good looks is not the most important thing. But it is fact that good looks is an advantage. We also generally prefer someone who is clever instead of dumb. Etc. Recognizing someone is handsome doesn't indicate a sexual response. In fact I am so in love with one woman and one woman only. That I might recognize beauty in other women but they just don't do it for me. They just don't look right. Because they don't look like the one I love. So I might recognize beauty but there is zero sexual response. Even more so for someone who is a handsome male. I might recognize that they are handsome. But there is zero physical attraction. Recognizing good looks does not equal sexual response. Then you should know, and judge Judy would tell you, you would have to prove someone is a creep instead of simply calling them a creep when you don't even know them. Innocent until _proven_ guilty is also something which protects _you_ from being falsely accused. But I do get it. Judge Judy shouldn't be hitting on this handsome young man! You see what I did there? I assigned some kind of malicious intent to her. She might have also said "you are such a handsome young man!" You see. Sometimes it's just a compliment.

Fun fact from a law student: this is an actual part of the judicial process. Children often times cannot just say an oath and understand the meaning behind it, so presiding officers admonish them using this method, to ascertain whether they can distinguish between a truth and a lie. @@roscaines-prentice3888I didn’t know that. I had never thought about children and the idea of being under oath applying to them. I appreciate the information. That information was never something I would need to know, I’ve never been to court. I don’t think that it is from my stupidity that I didn’t care to think about it, but just ignorance. Why would I not be ignorant to that fact?

@@roscaines-prentice3888most people don't. Legal education in most jurisdictions is not easily accessible to the average person, and if it is, it can be difficult for most layman to understand the intricacies of civil and criminal procedure, as well as how it plays out in a practical sense. This even goes for some practioners themselves. Also, most people don't frequent court enough times to see it play out. Also also, media typically excludes alot about procedure, and often makes a mockery of it for entertaiment value. Hence, fun fact babe.
