A Florida jury awarded Maya Kowalski’s family an additional $50 million nearly an hour after deliberating on what punitive damages the plaintiffs should receive. The jury agreed with the Kowalski family's claims, stating Johns Hopkins All Children’s Hospital and its doctor's actions in imprisoning Maya were responsible for - and led to - Beata Kowalski taking her own life. Maya Kowalski and her family - who were the subject of Netflix’s “Take Care of Maya” - sued the hospital claiming its treatment toward the family and claims of child abuse pushed Maya’s mother to take her own life. This happened because of the stigma of medication in US. US is also responsible for OD spike as is a direct correlation from 2012 when they went after prescription medication. After that ODs of street drugs skyrocketed. Government and US stigma of medication is the issue here and kills people. Stigma of medication also assisted in my sister and brothers death. US tries to stigmatize MAT recovery now.

My understanding was that the hospital didn't want to settle because they wanted current and future employees feel secure with being mandated reporters. So they took it to trial. I know this family would give anything to have Beatta back. Bless their hearts.

yeah it is. Did anyone I cried my eyes out when I do you remember it’s like I was getting nervous it’s weird that finally she’s believe finally her mom has justice all the above. I don’t think she cares about the money. I know some people will say oh she’s a Golddigger. This is what she wanted money. This family wanted nothing in fact they were getting by somehow, it’s really awful but in that moment I was crying just heartbreaking and it was just wonderful but it broke my heart when Kyle just started crying sobbing he broke down these kids shouldn’t have to be strong but they are they shouldn’t be without a mom. They should have their mommy. She left them so much and it’s so sad. She had to sacrifice the herself for her child to survive. She didn’t have a choice she wanted to be with Kyle. She wanted the she said all right I think anyways well, Maya, I’ll never see her again. I have to do this. these kids should not have to be that strong.

I don’t believe I’ve ever seen a sadder case with better vindication than this one, nor a documentary that has made me sob more. The pain this family has endured is unimaginable. May God mercifully grant them healing from this trauma.

What i have gone through is worse than this. Only I have no one to care. My life has been cut short, my body damaged, organs removed and not one person cared. My own family allowed drs to damage me then stole my money. Its been 6 years and I have lost everything. This family here got it all. Millions of dollars, they were heard, loved. I am alone and fighting to live everyday. I will trade with this family anyday.

She knew it was her insistence that Dr’s give her possibly fatal levels of Ketamine and hers alone that got CPS involved and led to this whole nightmare. I truly believe that Beata was mentally ill. If the hospital had given Maya the levels/amounts of Ketamine that Beata was demanding and god forbid something happened to Maya the whole country would be demanding the heads of anyone at John Hopkins involved with Mayas care. I’m sorry but this case did ring alarm bells for Munchausen. Whether true or not we will never know. Maya did get remarkably “better” health wise after Beatas passing. The way the hospital specifically the social workers handled this situation it disgusting. They should be fired. They let their egos get in the way.

The tears were not about the money, it was about vindication for Maya and the loss of their mother. Thank you juror’s and prosecutors. The hospital could have avoided it by not creating an environment where employees were afraid to speak out about problems and where there wasnt sufficient oversight and communication to protect patients' rights and patient care. The hospital came perilously close to losing their funding for a number of good reasons. @@TMTM584

Im 17 with CRPS and im so happy for Maya for getting her story out there. So many CRPS patients have to deal with similar doctors and has been treated the same Maya has been treated. My story is very similar to Mayas just not as bad. To any CRPS fighter out there sending gentle hugs 🫂🧡🎗

I agree took yrs before I got help for mine. Back when I started the journey was called RSD and only treatment was painful nerve blocks , which did nothing for me but gained weight. God bless you and May and family. Hope they don't get dragged through the courts by contesting JH.

Could never have been without the thorough documentation of every single step, appointment, phone call, treatment, etc by Beata, and her refusal to sign off on the DCFS plan and release them from liability/admit wrong doing when she knew they weren’t doing anything wrong.

Exactly, these punitive damages are going towards the other families impacted directly by sally smith. I truly tried so hard to not only fight when my newborn sons new ss# was stollen in a medical record transfer. When I was told I was worse than a drug dealing mother because I didn’t want to stay IF AND ONLY IF it safe for us both to leave. (They discharged me and the office closed. I was removed from my room but DID NOT leave the hospital because I was awaiting my child’s release. Which led to me not having a room. A nurse kind enough to let me stay until her shift was over. 3am. I waited until y when admission/release opened for my son. Having never left the floor at all. Standing the last 3 hours in front of the door where I could get him. Error on their end. Yes. Did they make that statement in the morning and call cps for leaving him there? YES could I fight it or not? No because their error led to a report from a staff member that said they were not aware of the incident the day prior and I willfully signed his release papers stating they had not held nor could be held liable for any further actions. I was 19, didn’t know or think that they could include a way for me not to file for wrongful accusations but they also didn’t give me a medication needed. Rhogam for rh- blood (my son is rh+) they have caused me to have 3 late term 26w, 28w &24w miscarriages (when blood begins mixing my body with severe systemic lupus and TTP - which requires platelet transfusions) I can’t even bring damages for that! I tried immediately after each time!

It's also the practice of family members who truly love those in their care. Dr, Feldman is an expert in MBP, he stated that it was doubtful that MBP was evident in this case because Maya did not immediately improve when they separated her from her mother.@@npc123x

@@npc123xif MBP was the diagnosis here, Maya would be well since her mother died over 5 years ago, yet Maya has gone on to receive confirmation of her disorder by several different doctors, spent YEARS in physical therapy to have regained as much function as she has, and still has bad days and lesions from her disease.

I am so happy that this family finally got the justice they ALL deserve for this hospital despicable behavior towards this family just looking for help for their child. No amount of money will bring back Maya's mom. This was never about money but about the principal of how this hospital violated their rights to have an opinion about Maya's care. @@toni3901 The judge didn't lie or exclude important evidence to obtain the order, the hospital did. If they didn't deceive the judge they would never have gotten the order. I expected blame to land on the judge or family services but that's not what the evidence showed. They really worked hard to wreck this family.

And many children will be hurt by this jury decision. I hope she doesn't become dependent on this drug. Then that's the jury, her lawyers fault. Cause Dr. Hanna was given her high doses. That's why she was sent to JHAC

I am so happy they got their story out. They needed this for closure. Now to heal. .. hopefully, they will use the money to help others that went through the same but didn't have the means to fight against a monster size corporation. It should have never come to this. Not only did they destroy this family, but the money that has to be paid out will be a detriment to other children that need help in the future from that facility.. There are children in acute situations that could have used that type of oversight and don't get it. They targeted this family because they chose to go against the doctors' advice, and the doctors' egos couldn't handle it.

It's a HUGE deal to even get a case against a hospital to a court so this is a VERY amazing day. My mother was a victim of negligence and after seeing nearly a dozen attorney's one was finally good enough to tell me that it was a money issue because the hospital and clinic attorneys would keep pushing things back until my mother was dead and then it is very hard to get it to court. She died 6 months later with a tracheotomy, a feeding tube and oxygen and unable to even think about enjoying life. KUDOS to this family!

This was never about the money. It was about holding the powers that be accountable! A settlement never would have brought so much attention and Maya’s story would have never been known. This family is brave and fought when many would have taken the money and quietly walked away. Not only did Maya’s Mother die for her child but I believe she saved many other families from having to endure this unnecessary suffering!
