In this video we have discussed taxation provisions in case of sale of inherited property or property received in gift.
If you sell an inherited property, you may be subject to capital gains tax on any profit you make from the sale. The capital gains tax is calculated as short term capital gain or long term capital gain based on the holding of capital asset. The tax rate for long-term capital gains (if the property is held for more than 2 years) is currently 20%, while the tax rate for short-term capital gains (if the property is held for 2 years or less) is the same as your income tax rate.

Ji, the ancestral house was constructed by jointly my grandfather, my father and his 2 brothers jointly. The said house was completed in year 1984. Then in year 1988 it's partion deed done for 3 pieces of same and one portion came in my father ownership. Now as my father is no more, it came to my ownership . This portion I sold to a person for example for 100/- and next month bought a new house for 25/- . So what would be the tax implications approximately?

Hi Sir, Thanks for informative video, I have one query that we all brothers have got agricultural land in our name after our mother death, the land get transferred among all of us brother, I have sold one piece of land from that agricultural land and purchase some agricultural land in name of my wife. Now in my TIS, sold amount is showing, shall I have to pay TAX for that, as mother was purchased that land on 35 years before.

It will be taxable if it fall within the definition of capital gain and capital gain tax to be calculated accordingly. Short term capital gain is taxable at slab rates and long term capital gain attract 20% tax. Take appropriate advice from experts before any action.

As per Section 55 - Cost of Improvement does not include any expenditure which is deductible under other heads. Since municipal taxes paid is deductible under "Income from House Property" head, it will not be indexed while computing capital gain.

If any NRI buys shares and keep them in Demat account he is not subject to pay tax till he sells them. Does this rule apply even for dividends received by him from time to time which he puts in his Demat account or he has to pay tax. Your feedback will be appreciated.

If the cost of acquisition is not known for a inherited property,as it is owned for last many generations, How to calculate LTCG. 2 At the time of inheritance , it was a rural agriculture land, but at the time of sale it is urban agriculture land, how the LTCG will be calculated.

Sir mujhe virasat me mili property ko sell karne ka plan hai. Dadaji ne kitne me kharida tha koi idea nahi but ab mai use 1cr me bechne ka plan kar raha hun. Maine us property me improvement cost bhi lagai karib 15 lakh rupaye jiska koi bill available nahi hai. Toh yaha mai kaise justify kar sakt hun improvement cost? Aur kitna percent tax lagega.. Please answee.

If property is purchased before April 2001 then you may take the fair market value as on 01.04.2001 as the cost of purchase and for improvement cost you should have documentary evidences so that in future if Income tax department require any clarification you can produce them against your claim.

Rural Agriculture land which is not a capital asset under income tax will not be taxable .

Sir what if I get Bank balance of around 1cr in the form of fixed deposits from my Maternal uncle's account after their death. Will it we taxable? My Maternal uncle was having no children and his wife died before his death. We filed a case in the court and now the cash of the above mentioned amount is transferred in being transferred in our bank account

Sir ji hamne 2001 mai property li thi 80000 mai aaj 17 lakh mai betchi hai Uspar 2 lakh banwai dikha sakte hai2004 ko banwai thi Kitne par fir tex dena padegameri koi or income nahi hai to adie lakh exmepted limit bi milega na please sir ji jabab jarror dijiyega

you can avail exemption limit of Rs. 2,50,000 in case you have no other income.

कोई प्रॉपर्टी विरासत में मिली हो तो सेल करते समय परचेज वैल्यू कैसे डिसाइड की जाएगी अगर उसका परचेज सोर्स पता ही न चले। या बो पीढ़ी दर पीढ़ी विरासत होती आई हो।
