Robert Durst stands trial for the 2000 murder of friend Susan Berman. The trial began just before the pandemic in early 2020 and was halted two weeks in. The restart happened on May 17, 2021, with the same jury panel.
The defendant’s wife Kathleen McCormack Durst went missing in 1982. Evidence and testimony would show that Robert Durst killed her, the prosecutor said. The defendant allegedly told Berman it was an accident and asked her for help. She served as his alibi.
Berman, 55, was shot execution-style at her Beverly Hills home in 2000, and the prosecution suggested that it was because of what she knew about Kathleen’s death and disappearance. As defense lawyer Dick DeGuerin would have it, however, Durst is innocent. His client only came across the body, panicked, and fled, he maintained.

Thought the part where Lewin hit him with plans to kill Gilberta and Douglas was some of the best of the two weeks of this never ending cross. Durst was lost, overwhelmed. 32:33 he’s speechless. Beautiful.

Lewin always has a well planned out strategy. He's arduous in his questioning - but there is always a bigger reason. Everyone who has ever known him says the exact same thing - you may not like him, but you have to respect him. He's good at what he does.

21:02 ABSOLUTELY GUILTY of premeditated attempted murder of Gilberta- this evidence seals the deal. He was going to shoot the security guard who caught him shoplifting as well as his brother Douglas. If he had not been caught that would be a kill list of at least 6! Lewin is a MASTER at his profession 🔥🔥🔥

As a side note i believe this selective hearing by Durst (i watched the majority of his testimony with his lawyer and he didnt seem to have the same level of deafness) is a ploy to make cross so long winded that the jury switches off. With a character like Durst i believe the prosecutor is doing an amazing job ... and he definitely has more patience than i do !!

I hang on every one of his words when he’s on one of his lie-tangents. If I were on this jury I would probably never blink during this cross or any other time. Lewin has the skills!!

After watching this for the 800th time - I really think NY Prosecutors should go after Debbie Cheratin(don't care if I spelled that garbage's name right) for conspiracy to commit the murder of Douglas Durst. Also - and I'm not a dog person - but what kind of monster would kill his dogs?!

A psychopath does not have the ability to feel emotions In a usual way. The dialog with his wife about does he sound like he should sound, does he come across as believable are direct evidince of not feeling emotion and trying to imitate how others would react.

@@jmj3297 I've watched nearly every day of Lewin v Durst more than once. It's so rich and deep, you need to digest it in small bites. I think was is "wrong" with us is that such an abnormal being is spellbinding to watch. I lived with someone like him for too many years. I recognize all the tricks Durst tries.

In most other legal systems the questions would be preface with is it not true rather than adjective straight lie etc would be easier for the defendant to answer yes. This prosecutors extremely complicated sentences to make the defendant to easily disagree and take off on rambling lectures.

Why do I have a sick fascination with Durst? I'd like to have a conversation with him. It's interesting that he had a tick where he blinked he eyes in his earlier years. Maybe he has some sort of autism or OCD. But on the stand we don't see that tick. I'm drawn to old people because they have a lot of stories to tell.

He had those facial tics horribly in the Jinx. He claimed to have been on meth, which I believe. He was grinding his teeth and his face was contorting all over the place. He’s a weird and fascinating dude.

Tic disorders aren’t caused by methamphetamines but can be exacerbated by them. Having said that, tic disorders are most often present as comorbidities of other neuropsychiatric diagnoses, namely OCD as well as autism spectrum disorders. It is very likely that he is being treated with a medication (either a low dose of an atypical antipsychotic which is the first line treatment for tic disorders (doesn’t involve treating any psychosis but rather the pathways involved are dopaminergic which is the primary pathway mitigating movement). Conversely, he may be treated with gapapentin which could also reduce the tics, but also increase speech latency which we are seeing. Lastly, abn movements of the extra ocular muscles of the face can also occur during rapid cessation of a particular class of medications (withdrawal dyskinesia). For example, if he had been prescribed quetiapine for off off label use to ‘sleep’ which many users of methamphetamine utilize to come down, then abruptly stopped, you could see rapid, involuntary movements of the extra ocular muscles bilaterally.

I found this for you “Only use cross examination for the introduction of exhibits, however, when an opposing witness is the only one able to lay the proper foundation for an exhibit. Admitting exhibits during cross examination is difficult and should be avoided if possible.” There are looser rules for cross examination. Lots and lots of documents and articles online about it.

He has more than proved durst is pathological liar. But come on Lewin……you don’t have to spend 20 minutes on each lie. He could have proved, impeached, etc that he is guilty and have only spent 20-25% of time he has used.

It’s long, but this is a VERY unique case, and Durst in a highly unique, HIGHLY dishonest individual. They needed this prosecutor because of his history with winning cold cases.

@@raolhooley It’s not because the jury is dumb, though. It’s because of Durst and his criminal history, and the sheer volume of lies. They won in Galveston because DeGuerin pretends to be a country bumpkin, but is secretly a master manipulator. That jury just followed him. This one already isn’t based on his one million desperate improper objections.

The attorneys have paralegals who search comments on social media to get a "feel" for how their approach is being received. From the several references to prosecution overkill I have read, I suspect they will tone this down

@@ritatinken5867 Sorry, we need to refer to him as PROSECUTOR Lewin? That’s not his actual title. I find him pompous, arrogant, and so much so that he has placed this whole case at risk for a mistrial and DEFINITELY for a rapid appeal. He is full of hubris, that is unchecked, especially by this judge who has allowed one of the most egregious deviations from a fair trial in recent history. The Judge-I’m not sure what to say…after allowing 38 hrs of a cross examination which actually made Lewin look like he was grasping at straws, he warned him that he had to wrap it up, then he let him keep going. He also made very biased comments on Friday. Like it or not and despite how we may feel, we live in America and as such, still have a constitution-last I checked it wasn’t written by Andrew Jarecki or Lewin. But you wouldn’t know that if you saw this trial.
