And how about refurbished stuff and when you sell that? You can say: Refurbished Dell laptop. No one goes to Dell for warranty. And if they do Dell can just say it expiered. And btw... yeah if a lot of Dell laptops are still in the marked (or Dell components for that matter) it is a good sign for the company. Like using a Volvo Redblock engine in a different car and selling it, why not say: this car has a great refurbished Volvo engine.

I've said it time and time again. Boycott those manufacturers that think they still own a product after they sell it to a customer or take legal actions against the public for doing what they want with an item which someone had legally purchased. Those purchased items, once sold has become private property of the customer who purchased the item and is able to do what they want with it. If manufacturers are still wanting to have legal ownership and ties to the products or goods they produce, then there ought to be an international law that warns customers of legal actions that can arise against a customer when purchasing an item. A contract should be written out. Is this ridiculous? Of course, but it is no more ridiculous than manufacturers having 100% legal rights to products they legally sell to a purchasing customer. This would certainly put those business out of business. Until then, no manufacturer should have 100% rights to any product other than they are still liable for products proven to be unsafe or has caused death or bodily injury by law. It is stupid for manufacturers of having overreaching rights to their products. If they like their products so much, don't sell them. Keep them. But don't sue your customers. Why would anyone want to do business with anyone like that. You would have to be a moron to buy their products...new or used. These illegal actions and overreach of manufacturers needs to stop now. We need to boycott these manufacturers together and bring them to your knees. We have the power. If we don't, what are they going to do next, sue you for modifying cars or sue every homeowner for remodeling their house? This is going too far and needs to stop now with a class action lawsuit against any or all manufacturers that legally harass their customers.

Yeah, people use old humbucker Gibson pick up elements put it in a different guitar and sell it as: comes with Gibson pickup elements, and people know 1) what to expect, 2) that it 's good. Whether they will break in time or not... Yeah if they don't it shows the brand is good and they will be used more often in projects like that. What and why does a company want to do about it.

Well then, I think it's a matter of opinion, and you are not looking at the advantages of allowing for creativity and upcycling of a product. It' s additional free advertisement. As a real business owner, I would welcome it. It just means people love and want my product. Professionally and personally, I would not care what they do with my product, so long as they legally purchased iten item. I think businesses that sue their customers are buttholes and should not be in business. Take for instance...Levi's. That I know of, no one as ever been sued for upcycling Jean's. Many things have been created out of old Jean's, like purses, jackets and even modifications to their Jean's. You buy it, it becomes you property.

@@inden301 I don’t think so - legally as Chanel says in their disputes about selling their products even new in the box - the item is materially different and they will sue people selling their products. As far as someone using a designer logo to sell a product that they’ve “UpCycled” - it’s just like stealing. Ask yourself why the UpCycler wants to use this brand in their new creations - it’s because they are piggy backing on the marketing, branding, good name of that designer and those top designers have worked hard to create their brand and I don’t think legally anyone should be allowed to trade off of their brand.
@inden301
@inden301 Ай бұрын
@@908DealStreet I do understand their legal rights to their logo and branding, and yes, they can use it to sue their customers, But, then I say they need to advertise it to their customers that they will sue them if the product is not used for its intended manufactured purpose. It is still an overreach of the manufacture. As for me, as I stated earlier, I refuse to purchase products from manufacturers that I know are sue happy and may sue me for whatever reason they wish, using their logo and branding rights or unethical legal business overreach. Ask yourself this question. Whay doesn't every manufacture practice this? Why? Because they know it is unethical and poor business practise and business suicide. Just because you can do a thing, doesn't necessarily mean you should. Why aren't they aggressively sueing internationally counterfeit third world black market countries. I'll tell you why. It's easier to sue their everyday customers in the U.S. So, then I say again for the umpteen time, especially to people like you that don't get it. You have to be a moron to purchase from manufactures that use this practice. I will not respond any further to your future responses. If you don't get it. You never will.

She was using the material in purses, wallets, hats, earrings, necklaces and even cigarette lighter covers. I’ve been a subscriber of Corter Leather for over 8 months now. I love his videos as I would someday like to make small leather goods from scraps I’ve purchased from a tannery long since out of business. I have box leather same as Hermes--but No Logo! His stuff is gorgeous! But when I saw the video about LV execs trying to get their logo off of his selling platform, the first thing I thought was BEWARE! It so far ended up OK for the guy. But these companies have a right to their logo and challenging it is a costly mistake--second thing I thought is Rockstar Flipper taught us good!

I’m also surprised the exec he talked to didn’t press him with a cease and desist if he continued using the LV logo as a violation of IP. According to the video the exec just told him if he would buy any merchandise from the LV stores to cut up, he would be placed on a banned list for cutting up to sell LV merchandise. I really think there’s something lost in communication here. I think the exec actually told him to stop selling anything more with LV logos and the guy just thought he could continue to sell upscale stuff made from damaged material. I’d be careful because there are more executives out there, not just the one he spoke to. He’s already got their attention!

Imagine you've got a real good A brand kitchen knife. But it became rusty after you've lost it in the garden for a couple of years. And some blacksmith says: this is really good A grade quality steel. A big part is lost, but this in the center is great to make you a small pocket knife. And you sell it saying it's A grade ***-brand quality steel that came from a ***-brand bigger knife. I've seen KZfaq videos like that. My friend has a diner table that's made from old topical wood that came from a big expensive door out of India, with the old brand still burned into the wood. He bought it from a company which upcycles stuff like that.

Upcycling aside, the original items he was cutting up were also fake, which was a VERY big part of the issue in this situation. In both videos, you can see very uneven stitching near the border piping and there is a 0% chance that came from a LV factory. His rationale is that he's able to get them from estate sales in his area for around $50, which we all know almost certainly isn't going to happen with authentic bags. He even says that he assumes the bags were real, but he's not an expert, which is a big issue. The bags he's cutting up are 100% knockoffs. Him making/selling custom items and infringing on their trademark is one thing, but doing so with fake donor items takes it to a full blown counterfeit operation. People are complaining about LV "picking on the little guy", but the "little guy" is quite literally creating knockoffs to sell in tutorial videos.

Even if what you're saying is true, so what? Someone using waste to create a new product, why is that so wrong? It infringes on Luis Bitchon's immoral business model and brand name? I'm shattered! That LV bag, real or not was made by child labor in China. Their factories are the same factories that Zara uses for their knock offs. Of course some people are always going to defend predatory behavior. Why else would a brand like Balenciaga still exists?

I don't understand. I believe first you said he's not using their logo or name and then you said that he is using their logo but not their name. The First Sale Rule is a civil case and thus would apply. You started out by saying it's not a crime. The First Sale Rule is not supposed to cover criminal acts as I recall. Since he's that good with what he does, he should simply exclude the logo and the name entirely. You stated that it is lawful to cut up the product and reuse it. That should be the end of it . I'd like to see that law and where it comes from. Also, he should be able to flip that LV leather inside instead of showing on the outside or add another layer to cover it. If the case law says that he can do whatever he wants with the material even though it has a logo on it, then only one pleading need be filed in court, citing the appropriate law. LV may have been prepared to take it to the Appellate level if they lost. Also, investigators and process servers may have to serve papers in person and may be also tasked with spying on him and informing LV that he's not living in a 20 million dollar mansion but it's just an ordinary Joe trying to earn money with his hands and his brains add Talent and a jury would therefore side with him, not LV
